  • My GC got approved almost a three weeks ago. I stayed with my employer through the whole GC process till now. Now I want to move on with better job/salary.
My attorney suggested to stay with the company for atleast 6 months as it may cause issues during the citizenship application. He also mentioned, employer has the right to revoke the approved green card.

Is it really true, employer can revoke the green cards, just merely for switching jobs.
I have my doubts that they can. Did anyone else heard anything similar.
I tried looking at the web but could not find any written law by USCIS on this.

  • Most of the EB2's are very happy with the bulletin (which they should be) but I also see most of them are non-donors (or the free riders).

Thanks IV as always for the updates and keeping the hope alive.

Agreed that I haven't contributed (yet) but that's a mighty big acquisition from your end on calling all of us EB2's free riders without any considerable data to prove it.

I think it's within our best interests to remain united until things are straightened up but I sure can understand your bitterness and hope the best for you too.

    E. EMPLOYMENT THIRD PREFERENCE VISA AVAILABILITY
Demand for numbers, primarily by Citizenship and Immigration Services Offices for adjustment of status cases, is expected to bring the Employment Third preference category very close to the annual numerical limit in June. As a result, this category is likely to experience retrogressions or visa unavailability beginning in July. Such action would only be temporary, however, and a complete recovery of the cut-off dates would occur for October, the first month of the new fiscal year.
    "
How do you see above message in the June Visa Bulletin? This means it is illegal to use all of them with in 3 quarters????

I don't wish to sound like Bill Clinton, but it depends on how you define "is." In this case, if they are using "annual limit" to mean the entire annual quota, then they are admitting that they have broken the law and issued too many visas in the first three quarters. Worse, they offer no explanation for having broken the law.[/COLOR]

Well, they could be talking about a subset of the annual quota, such as the quarterly quota. From the context, I don't think that is the case, but I'm also not used to seeing the State Department flat out admit illegality, either.

Well, if they do broke the law, can we do something about it? Like class action law suite???

Let's see if they did, first.

class action lawsuit?? for using up too many visa's too fast?
wow. for once (& only once) I feel sad for USCIS. They are damned if they do, and damned if they dont. Usually all talk of class action lawsuits have been for visa numbers that they wasted by approving too slowly. Now another one for going too fast... :D

  • if she can get the tests done in India, there are USCIS approved doctors in Chennai, Mumbai, Delhi and Calcutta.

My spouse is landing here on Aug 15. That leaves only one day to get medicals done. Any suggestions on how to handle this ? Can she skip skin test and take X-rays directly ?

  • I do not know in which city of India you took out your PPF.,
But I heard you have to pay atleast 5% to get PPF back in Hyd.,
Hope corruption will not be that high by next 20 years in India!!
I can attest to that. It's not unusual to have to pay bribe from 10-25% to get the PPF money. And even that takes weeks/months to complete. I've personally known relatives in India who had to do that. It's not even considered anything out of ordinary there. Good Luck R2I's.

  • Houston Indian consulate is horrible. Just horrible. They are rude and totally anti-customer friendly. It is unbelieveable how rude they can be. I have tried to contact him numerous times in my last 10 yrs in US and never was I able to get a reply to my emails/faxes or phone calls. I had trouble when i was an indian citizen and had to renew my passport, had trouble when I had to get tourist visa, had trouble when i had to get my indian passport cancelled and trouble when i had to get some misc. services for my daughter. They keep changing rules (example they changed the way they give tourist visas to people of indian origin, they changed the rules and prices to even just surrender the passport).Everytime my only option was to drive all the way to Houston and be at the mercy of their rudeness. I do not see any point in External ministry of india helping because they are equally worse. It sad and dealing with beauracracy is just a part. The whole problem is that they are not accountable. I dont even know whom to complain for the fact that I cannot even get somebody on the phone and have to drive all the way to Houston just to get a minor question answered.

  • I'll belive it when i actually SEE it happen. Rediff and TOI report all sorts of stuff that is sometimes far from the truth. Remember when the bill was introduced in senate and was being debated, they published that the H1B increase bill has been passed! Let us get official word that this has happened and we can be happy after that.

  • I agree that "It is an irony that most people here who raised valid concerns have "red" reputation". I don't know how it works. I know it doesn't matter but I just added +ve reputaton for ck_b2001 and Lisap.

Anyways, I think the moderators should not forget that this is an open forum also. And it has become popular because of people like us. As of now I am using this site as a forum where I get some info/experience from people like me regardng GC. Its an important thing (to get GC) and a painful process. May be thats why this site/forum has got so many serious members, spending time and sharing their so much personal information.

But to me (its just me), GC is important but not a life/death thing and there are lot of other things which are more important to me other than getting GC. Frankly speaking, I will spend time and money in those other things at this time. May be sometime later when I will be more comfotable and have more exp. with persons here, I might participate actively here too. And I believe lot of others might have similar thoughts.

    My point here is that:

    1. This is an open forum (like immigrationportal etc.) to discuss/share views/exp about GC process. So let it be like that only. If its not, then I will ask moderators to "please close this open forum".

    2. IV is a very good cause, but all of us (affiliates to moderators) and moderators should try to explain this in any way they want but please NOT BE PUSHY, AND ABUSIVE.

    3. In this way, who so ever wants more participation, let him/her come forward. But at the same time, if anybody is not convinced or don't want to participate, then let him to do that also. Why PUSH.

Good Luck to all of you

Very well said. Thank you for the support- I appreciate it.

  • You know that's my point. do you really think we can't do nothing more?.....

we are highly sklilled smart and great immigrants creating the new America of the 21st century we can't just say, thats it lets wait.....

This country is about money, and we have the tremendous advantage that elections are coming, lets see the big picture.. why dont we jump to the next level from street protesters to work with one of the candidates or 2 or 3 , if they see money they will push our cause. Lets work on that now...

So those guys who attended the hearings or met with senators. what was the result? what did they accomplished? did they get the opportunity to participate with the senator or law maker in an action plan? or we just wasted that opportunity asking for autographs? please those guys post your comments.

I'm no negative just wondering how to measure the success of the rally?

  • Is there any update on three bills in house. I have checked the hearing schedule for all committees and there seems to be no hearing scheduled for any of these bills. House is in session till September 7 and after that District work period and convention shows, which leaves us with just 4 weeks from now and after that It reconvens from September 9 with target adjournment date of 26th september and i m pretty sure no congressional rep will like to cast vote on any bills before going into election....

Prospects seems bleak now... Is there anything we can do...any last attempt that is required? If so...Let us all know...

  • Bottom line is that u got screwed. Labor is for a position with your employer. He may choose to give to anyone he wishes. Labor substitution thus was not illegal act on his part as it was permitted by the law.
    I-140 is his stuff .
I-485 is ur stuff but in absence of I-140 it means nothing.

Your only case is if he has violated any of the H1 provisions.

    Fellas,

Found this news clipping on an Indian newspaper Today. Below is the Link to the news Article and what it says. It's naive to conclude its gonna happen overnight but the issue of getting back our Social security is catching up!!

New Delhi, Dec. 4: India and the United States will discuss the issue of a totalisation agreement next week to allow Indians working in America to avail of social security benefits that they pay while working in the United States. Visiting US secretary, US under-secretary for international trade, Franklin L. Lavin said, United States and India are trying to reach a closure on the matter and the United States will be taking up the matter next week.

Speaking at a function, held in the capital on Monday by the Confederation of Indian Industry (CII), Mr Lavin, who is heading the largest-ever US delegation to India of 250 companies, also revealed that the United States has approved the opening of a consulate in Hyderabad to encourage business with the State.

Noting that the US was looking at various ways to make business with India easier, Mr Lavin said, the idea was to have an independent economic relation. We have consistently said that companies have to be serious about doing business with India on a standalone basis. It is not a question of whether to invest in India or Brazil or China, but a necessity. We want to make it easier to do business with India, Mr Lavin said.

On the Doha round of talks of the World Trade Organisation, Mr Lavin said, We can expect an outcome if Brussels, New Delhi and we, each show our willingness to take things forward. He also said that several initiatives have resulted in greater Indo-US business cooperation.

These include the Open Skies Agreement in civil aviation, as a result of which passenger traffic has increased 60 per cent in the last one year, reduction of tariffs on industrial goods, a raise in investment caps in retail by India and efforts to liberalise entry of foreign education institutes. Mr Lavin, however, pointed out that there are a number of challenges facing India-US business ties.

    1) Try state group insurance
Texas and for that matter every state has a group insurance coverage for folks
who donot get coverage from any other insurance provider.

This is a coverage that you will get for sure, only document you will need is a written paper from insurance company that one cant be insured.

Check the state insurance board website.

    2) check free clinics, these clinics will provide complete care ( you can pay them if you like)if you dont thats fine too. I suggest paying them if you can even if its a bit high, as someone who cant afford may one day get to use this service too.

    3) Ask yours employer's insurance agent, group insurances gurantee insurance.

Donot worry, life works in interesting ways. As last resort one can go to home country for delivery.

    donot worry.

Thank you very much. I don't have group insurance so cannot to my employer. Bought individual insurance and they said that they would not cover maternity.

I will try to explore your option tomorrow.

    Thank you very much.

I know that I can over come this hurdle and also could suggest other friends (who have this problem) with what I found out.

Life cannot stop for these small problems.

Life has to go on and on..

Hope we all will reach to the destination very soon, I mean get our green cards very soon. And to reach our destination one should not sacrifice the goals and life decisions just for GC.

I wish good luck to one and all.

    Thank you very much!
