    Pl. let me know If i go for stamping even with out any paystub from the new employer? (joining after 15 days(1-15)) My new employer has agreed to give a letter of employment. Is that enough for the stamping?. If the consulate officer asks for the latest pay stub in my case, can I tell him that I do not have and I have only the old employers pay stub?

    Yes - that should be good enough. You can tell the visa officer that you just joined the new employer and still do not have any paystubs from them. Get a letter from the new employer with the starting date. That should be good enough. Take all the paystubs from the old employer. Just be truthful and honest and don't worry - you should get your visa without any problem.

I am in the process of filing EB2, MS +0, with same company: different postion and 30% job req changes, prevaling wage is different level. I did my MS before I joined this company. My lawyer is saying we should be fine: any suggestions.

    My six year visa expires in Sep 07, 2009

    a) How much in advance we can submit HIB petition. I read some where H1B can be applied six month in advance.
    b) If we apply six month in advance, can those dates be from Sep 08, 2009 or the date of submission.
    c) Can we include the dates for some one is physically not present in US
    d) What supporting documents are needed to prove that some one was not present in US?

    In OPs case, one can maintain the status without getting paid - they just need to prove there is an employer-employee relationship exists. You are correct, if the employer simply dumped you on bench

    u dont need to worry about that because the seller pays both the buyer and the seller's commission. all u have to pay is closing costs.

  • I am in ROW, EB2 if they processed the interfiling, EB3 if not, with a PD of Dec 2002, and receipt date of 5 May 2007.

    My application was filed with Nebraska Service center, they moved to Texas (with SRC* receipt number), they moved back to Nebraska in October 2007.

    Even on EB3 my PD is now current.
    When they passed 60 days late according to processing times I raised a service request. They claim that they have 45 days to respond. Their 45 days will be up on Thursday, and I still have no response.

    So here is my plan...
    On Thursday call again. Raise another service request?
    Make an Info pass appointment ? - not sure IO could tell me more in person than over phone.
    On Thursday go see Congressman's office.
    Come May 2008 (one year since filing I485) if there is still no suitable reply to service request file WOM. Their lack of response to service request should annoy the judge hopefully.

    When I last spoke with an IO she thought that the notice date on the transfer notice was the processing date to use (Oct 2007) not the receipt date on it (May 2007). I believe she is plain wrong, and she was silent when I asserted that I believed she was wrong, and that's why the original receipt date is kept on the transfer notice. If someone has a link to the USCIS rule on this it would be helpful.

    Being ROW, I do not think your case might have been stuck in Name Check. But it could be the possibility. I would take one more infopas and ask IO regarding name check status. If case is still rotting in name check then fighting strategy would be different, I guess. As far as WOm is concerned, all stories what I have gone through on different immigration boards, most advise to wait for 2 years before thinking about WOM route.. I do not know how far that argument is valid..

    I think due to rescinding of the July visa bulletin dated July 2 there will be severe retrogression starting October 2007. Your friend should apply for I-485 now and he can turn in a follow-up I-485 for his wife after he gets married. You have to just hope that the priority dates do not become current before that. If there is any inklink of that happening in Oct bulletin I think he should try to get married sooner.

    First idea: put the lens to manual focus, and try that on a tripod. Perhaps the focus point got moved, and the camera is attempting to focus on black sky? This test would attempt to eliminate that.

    As I stated originally, the first half'dozen + photo's I took of the moon where over the course of 2 nights... and each of them were taken "handheld", with "full'auto" On. All the other settings were out of the box defaults. And every one of them were "in focus" as they appeared in the viewfinder. 2 weeks later when I attempted somemore moon'shots was when I realized that something was different. "Every" shot from then on of the moon was as I've been discribing. I've attempted more than 2 dozen shots via "Manual focus while on a Tripod, using the Timer". And the results are identical to the current "hand'held" photo's. As for the focus point... I've set the camera to lock in via "single area" bracket selection as discribed on page 67 of the manual. I've even gone as far as to focus in on the moon in "auto" mode and then switched over to "manual" mode, set the timer, and still the same thing...

    Manual focus and exposure bracketing are what you need to do.

    I've just read into these again and was wondering if these are settings that could have been changed without me knowing? Or perhaps realizing? I'm presently at work and the moon is just coming into view... I'm going to head home in a bit and pickup my camera and try checking & or changing these settings to see if it helps...


    As an alternative , spotmeter the moon to figure out the exposure and/or use the histogram.

    I'll attempt this aswell...

    Does anyone has exact numbers on how many EB3 ROW cases can be approved in a given fiscal year?

    140000 is the total worker -> immigrant visa numbers.
    28.6% of which goes to EB3, which becomes 40040. That is for everyone: China, India and Rest of us.
    Subtract the 14% of that number (that is the dedicated number for people born in China and India), it will become 34435. That is your theoretical number and includes applicants' wives and children. Now, unused EB1 and EB2 will come down to be used by EB3, so the number may be lower or higher.

    The Mexico F2A and Employment Third preference cut-off dates are �unavailable� for both August and September, since those FY-2008 annual limits have been reached. The Visa Office had originally anticipated that this would be a temporary situation.   • I am currently with a company through which I filed my I-485. The filing was done by the company laywer. If I invoke AC21 after 180 days of filing and change to a different company, how would I ensure that USCIS removes the current lawyer as the attorney of record? This is assuming that I want to represent myself and not use a lawyer after switching to a new company.

  • Regardless of the nature of the outcome from USCIS, I think we should all take 5-10 minutes out of our busy lives and all the "predicting" and dash off a quick note of thanks to Congresswoman Lofgren for taking our cause to heart and using her position to ask the right questions that has led USCIS to consider some action to alleviate the pain they caused us by creating this mess. I figured we could show our appreciation for what she did to help us out.

  • The OP poster was not scorning against the average american, I think you are mixing two issues up, I am sure he has done his share of charity work, and he probably sympathizes with families who don't have a job, I don't think you can direct your anger against him.

    This is a capitalistic society not a communist or a socialist society, the market will/should balance itself out, new industries come up, people get hired, if the attitude of the people is protectionist, which it is, it stifles innovation and growth, which in turns stifles the growth of new companies, which in turn would have helped the folks laid off get a job. Being emotional is OK, but one must be pragmatic. That said, i believe charity begins at home, one must take care of its own kith and kin before extending arms to others.

    No I am not Indian, but that still makes me a H1B and greencard aplicant. So please, Antis might dislike us but that does not make them racist and hatefull against only Indians, you are not the only ones in the boat...dont make Indians the only important people here.

    Plus a lot of the antis are probably people who lost a job and are finding someone to point the finger at, not right, but understandable.
    I have Amercian friends who went from a good middleclass family to now being on foodstamps and not knowing how to feed their kids the next day, they dont hate me but they are upset and frustrated and scared...
    Fear drives people to find a black sheep but let us not jump in there too and start hating...

    I am not familiar with ur line of work. I am into manufacturing.I used my AC21 and working on EAD now.

    You can invoke AC21 and work either on h1b(provided newcompany transfers) or EAD. It is highly advisable NOT to port on a pending I-140.

    I am having similar problem, I have my I-140 approved in 2007 485 filed in july 2007. I got laid off, now I want to change job with project manager title. is it safe to do that but my core technical knowledge will be same as before in the job description.
