I have suffered a lot due to this stamping business and I have a thread on IV "STUCK IN MONTREAL" I was there for almost 2 months with 2 of my sons and wife. My oldest one lost his full smester of college, 2nd one was only in 4th grade and got lucky due to his excellent record in school and hence was promoted, due to this stamping business and I was poorer by 30K. I will do whatever needs to be done to get this bill rolling and am ready to share my story with any one..
This was my 3rd stamping with the same employer and 2nd one was also in Toronto in 2005 at that time I had no problems and this time my salary was almost 30% more tan the last one in 2005.

ramus, follow my posts in the past 20 days and you will see i have posted many posts for this AP expedite. I have a travel coming up shortly and I had only exactly 90 days from the date of application and date of travel. My application was approved recently along with my spouse. There is even a post where I listed out all the steps I took to expedite and finally finally only the local congressman phone to USCIS helped. its just unbelievable, but its possible. I have tickets that even if you postpone the journey I will lose money. I said to myself enough we lose with USCIS, and so decided to take all and any steps to expedite and get it done. just follow my posts (like start reading my past 20 posts) and I am sure you will find it useful. Anything that get's you a RFE is bad..
I got it from CVS and they look good.

you 're right...so may what shivap80 is saying is correct also...
if your i-485 comes up for adjudication and you have file ac21 and your i-140 is pending as well, then the portability is only valid if i-140 is approved. of course after that to make sure that the portability is valid they will apply the "similar job" criteria.
You are interpreting as: It must be approved when in reality it means that It should have been already approved in order to make a decision on portability. They can not be forced to approve your I-140 just because you are changing jobs.

If 485 application is pending for longer time, say more than 2 years, I have seen that USCIS wants a reconfirmation from the employer that they continue to support the green card application for the position for which the application was originally applied. This is not just applicable to consulting companies alone. Any types of companies and applicants in any categories (Eb-1,2&3) could get RFE at the last stage of the process. So to have your application processed without a shred of a doubt, it is best to be in a position to reply that RFE anytime during the process.

came to us 8.2003 on f1, completed studies in 02.2006, opt from 02.2006 to 02.2007.
filed h1b petition 07.2006, h1b approved for company a,02.2007 changed to company b 06.2007 approved 01.2008.
company b filed for i140 i485, got EAD, AP and FP done in 2007-2008. i140 not yet approved
Gone to montreal in march 2008 for visa stamping, got 221g, waited for 60 days no positive reply from consulate.
Came back to US on AP, since i had job, could not lose. My questions
1) if i get my h1b visa get approved and stamped hopefully, can i go back to h1b status without losing my EAD, i140 applications. i have about 4.5 years left on h1b. other reason for me wanting h1b is getting married in india.
2) can i file another i140 for the same i485 for back up.
3) I have entered US on AP, do i have use EAD or just work on h1b.
do share your experiences and opinions, I am also working with attorney on these issues, your input and guidance will help to plan for all events.

Our applications (myself and my wife) reached USCIS NSC on July 2nd. Our 485, EAD and AP's have WAC numbers. we both received EAD cards and approved AP's in first week of Sep. and last week of Aug we received Notice from CSC that our 485 case is being transferred to NSC as our cases fall under NSC's jurisdiction. It looks like EAD and AP cases are processed in CSC. My I-140 was approved by NSC in Oct 2006. We are waiting for FP notices. Hope this helps.

Now in America there is a lot of work which needs experienced and highly skilled worker and we have EB2 for that, apart from that we still have a lot of work which requires hitech skilled worker and for that we have Eb3. So by the definition system has already identified the need and have representation for those.
And secondly you have problem with those who came legally and are highly skilled and have followed all the rules since day 1, counts less that 1 million, you are not willing to give them GC on other hand there are 12M (actually 20 M) who can't even write their names in English and everybody is ready to give them GC even the president of US is ready.
Doesn't that give signal that US is pro illegal and anti-legal immigration.... think about it
