  • I recived my I485 approval on May 30th after 10 years coming into this country.
    I just want to mention my GC journey here, hopefully this will help atleast some of the members in making decisions in their process. Appiled for EB3 labor in jan 2004, even though i am qualified for EB2. Applied for I140 after the EB3 labor approval and received I140 approval. After realizing that the dates will never become current for EB3, my desi employer files for EB2 labor. Applied for I485 based on EB3 labor during the July Fiasco from the desi employer. After 180 days, took the permanent job with the client with base salary of almost 100% increase ( with bonus it might be around 150% ) and with manegerial duties. Mean while my EB2 labor from desi employer gets approved, so my desi employer files I140 for EB2 labor that gets approved with old priority date of Jan 2004 and I485 becomes current. Recevied RFE on my I485 for Employment Verification Letter. I took the EVL from both the current employer and the desi employer ( for future employment ) and written an affidavit saying that, i have the intent to join the desi employer once i recive my GC because he is such great employer, to keep the validity of I140 based on EB2 from desi employer. After one month of my RFE responce, i received my 485 Approval.

    So You can always take promotions with more responsibilities using AC21, as long as you are in the same occupation, % of increase in salary doesn't matter. I have clearly mentioned my salary number in the EVL that shows huge difference.

    My EVL clearly mentions that my current job duties includes more responsibilities and manegerial duties.

    I read one big court case document involving 485 process by Rajesh khanna that the main important thing that USCIS looks for during 485 approval is inadmissability means no status issues. So as long as you are in the same occupation, you should be fine.

    I had problems with my H1 and had to work around 150 days without H1B Approval after my I94 expiration, this was taken care of by 245K because of my travel to india with another H1.

  • You see, soundbites and rhetoric are very very tempting. Calling ourselves slaves, using words like "hi Tech slaves" makes us feel that we have finally taunted the system and shamed the lawmakers into acting.

    Well, that's not how it works. We are advocating congress. We are not running for an election here and using soundbites and rhetoric really helps when trashing your election opponents. We are trying to get something done here, we are not running an election campaign and we dont have any opponents to taunt and shame by using the words like "slavery" and by trying to make a mockery of the system.

    If taunts and rhetoric and soundbites would have done the job, we would have gotten bills passed long time ago.

    Those who have made suggestions about using words like "Slaves" and "Hitech Slaves", and "tax paying slaves" have probably never been to lawmaker's offices. These words not only are improper and not only do they provide ammunition to people who oppose us, they are downright flat wrong. They also bring disgust and awkward situation if you use them in lawmaker's office. Imagine this: You are sitting with the judiciary counsel and if they ask you..."Who do your represent" and you say "We are from a grassroots nonprofit organization called Hi tech slaves". What do you think is going to happen to the rest of the meeting??

    And by the way, those who are running out of patience with Greencard process are totally capable of packing their bags and going back to their home country. So you cannot call it slavery. Slavery is bonded labor. Where is the bond here? If you dont like your job, then change your job and get a new H1? If you cant port your PD and if you are sick of waiting, then you can go back because really, the bond is in your head, if at all. Its not like your employer is holding a gun to your head. That WAS THE CASE during actual slavery in this country. They were sold, traded and bonded. They were killed if they disobeyed? By comparing ourselves and our situation to that, you are not only being counterproductive, you are insulting the real victims of slavery that existing 150 years ago.

    Use common sense and always think that what would be the impact if my post is read by people who intend to testity against us in Congress. Read John Miano's testimony in July 2006 in Judiciary committee. And use some discretion.

    Those who want to suggest new names for organization or new domain names for the website, please send an email to info@immigrationvoice.org and your availability to work on changing the names everywhere, including all paperwork etc and how much time can you spend on doing it and how can we transfer all name recognition from old name to new name.   • As everyone pointed out there are lot of things in favor of the employers, Attoreys & USCIS when I 140 is revoked. The only thing that comes to our rescue is AC 21 when followed as per the guideline which is currently not being done.

    Guys, Please support the IV AC 21 Campaign and let us help ourselves..

    Though there is no charge to revoke I-140 from CIS, corporate lawyers do charge money and that makes it in their interest to convince & pursue HR ppl to do so.:(

    This is just a humour but has a meaning underneath if you try to understand. I am comparing USCIS to a product selling company. If USCIS was a TV selling company what would happen to the customers the way it acts ?

    You could buy a TV but you will not know when you will get it. It could be shipped the next week, the next month, next year or never.
    The credit card will be charged once, may be charged twice or a valid CC may get rejected.
    Somebody who buys a TV from USCSIS a 2 years after you do, he may get it sooner than you do.
    USCIS has no way of knowing how many TVs have been ordered and how many of them are in stock.
    In case you do not receive your TV in two years, USCIS acknowledges that there is a long wait time for some and does not do anything about it. USCIS thinks acknowledgment of wait time is more than enough that it has done for the customers. Customers did not deserve this but USCIS did a favour to them being a good "Customer Service" company
    There would be an online survey after you buy it which would never get submitted 99% of the times.
    In case it did get submitted, somebody will read one out of 10,000.
    After reading it he will throw it in the trash can.
    If you get a defective TV (which is quite likely), you have a chance to file appeal by paying the same amount of money for the TV again so that your case can be re-opened.
    I wonder how many customers would USCIS have eventually ??? Any guesses ??? :-)

    I was going back through the statements that we received from the Insurance Company. The statements shows OASDI tax withheld, which is the SS tax. I believe, the employer is equally responsible to contribute 6.2% of the income to the SS and 1.45% to medicare. That means, this income should be added to the SS wages and medicare wages by the employer. I would be complaining about this employer tomorrow to IRS.

    My wife was on maternity leave last year. She was paid partially by the State and partially by a 3rd party insurance company. Her employer did not pay for these, so they did not include it on her W2.

    I am not sure if your case is similar, but this is what I know about maternity leave benefits. BTW I am in CA, so I am not sure how it works for other states.

    AFAIK, Short term disability payments are not taxed by Fed and State. We got a W-2 from the 3rd party ins company. This W2 only mentions the payments as "Third-party sick pay" and does not add to the gross W2 wages. My wife also took the CA paid family leave which is paid by the State. We got a 1099-G from the state for this. AFAIK, the paid family leave payments are taxable by Fed but not by CA state. BTW, fathers are also eligible for this paid family leave in CA within the 1st birthday of the baby.

  • same story for me, i just moved to different unit in the same apartment. everything remains the same. Same city, same zip code, same employer.. Somehow i believe address change triggered the RFE. Probably the change in the file pushed my file in FIFO and someone looked into it and gave a RFE. Will have to wait till i get the actual letter.

  • Not really, broadly speaking lack of information can never be a benefit to consumer. (Read: hidden clauses in agreements). It might be that they have been doing that and we don't know. You will ONLY know if you apply for another H1B transfer or any other application say I-140/I-485 with new employer and then USCIS MIGHT tell you that your I-140 is revoked on MM/DD/YYYY and you are no longer in valid H1B status since then. That would be too late and it is not retroactive. Remember that onus is on you to maintain valid H1B status all the time during the period of H1B. Once again I am not saying what I mention above is the correct interpretation of law, but in the absence of any clarify it can be one of the implication.


    well...The history is that USCIS did release the proposed regulation dealing with all these back in 2002 if I remember correctly..Then there was a comment period...They got so many comments...that after that they did not even bother to publish the regulations in the federal register...That was the last heard of it....Now the only time when the issue of these regulations can possibliy come up is when there is a leadership change in USCIS...Any our fate would depend on who is in control of USCIS at that particular instance...

    But this sword would fall some day..I donot know when..I donot know if it would fall on us....or we would just steer clear....The thing is that there is a lot of resistance to changes in status quo both inside USCIS and AILA...
    Well AILA would want the status quo to continue....Them lawyers are making money of us anyway.....

    I am in US last 7 years...The career is stagnant..No sign of GC anywhere....I am very despondent...But then what else is new ???
