I think you can put a date atleast starting from when you are expected to receive the receipt notice. Once you have the notice, you could go to local USCIS office, show the receite and prove your emergent situation and request for immediate AP.

  • hi,

i say great post! i actually was very happy in aug/sep this year and counted chicken much earlier than the eggs hatched... my eggs have not hatched... anyway, i set up an s-corp and got going... i did on my own name and with just me in it... the purpose of my s-corp was to do some non-IT work i.e. not consulting... though my day job is IT. my immigration lawyer warned me against being self employed for the GC sponsoring job... basically, if the USCIS ever becomes interested in your small business, they can ask any questions... including whether there is enough work to justify a full time employment and the burden of proof will be upon you... so if you plan to use AC21 to switch to your own company, i'd say think about it a little hard...

as for legal formalities with the state... that was a breeze... i incorporated with the state of illinois... filled out the form (2 pages). put it in the envelope with the check and sent it out... there are some other formalities too... i read the book "inc yourself" which had a bunch of easy instructions and things to watch out for... that was one amongst many books i read... did not consult any lawyer other than my immi lawyer... i use quickbooks for record keeping and have a free business checking account with national city... (i am in the midwest)... dont have cpa or lawyer yet... primarily, i want to learn the law and accounting myself before i outsource to lawyers/cpas...

all the best, let me know if i can help.. i would enjoy it...

I started an LLC earlier this year. Much easier and less risk with an LLC. It is still early to say whether the company will make it to higher grounds or not. But I sure am trying. I have me and my wife as manager members. No employees at the moment.

Best of luck to you all. GC or no GC, we can still make the entrepreneur dream happen.

  • We had around 17 highly charged up and dedicated IV members who definiitely want to do "something".

There was a diverse crowd this time. We had F1 students, who are now beginning to understand the gravity of this issue. One student is a student in Journalism and is currently doing project in legal immigration.

One physician came all the way from Connecticut and his wife another physician doing residency came all the way from Long Island and our dedicated leader mpadapa came all the way from Poughkeepsie.

Me and another family came from Queens. Some were from Manhattan.

Almost everyone else resided in New Jersey.

'laborchic' was the man behind this meet and greet and his enthu never went down, he always stood up and adressed the gathering. He stressed on the importance of Unity, which the community lacks.

mapdapa discussed about local law maker meetings. He has been managing and scheduling local lawmaker meetings. Almost everyone instantly offered to meet their lawmakers - but definitely with training and some direction and efficient management.

Me, mpadapa, singhsa3, siravi and laborchic were explaining to folks the importance of IV, our goals, plans etc...

One of them was a "Birthday Boy". He accompanied his sister and brother in law whose IV handle "sweet23guyin"

We had ndbhatt, healing_wong, dressking, supermann, frankiesaysrelax, devillion696 who also actively participated.

In addition, logiclife's email newsletter got us a few more people and I do not have their IV handles, they are Badri, Tejesh, Alpesh, Sailesh.

One guy (Alpesh) was a part of San Jose rally and was an active member in the CA chapter and recently moved to NYC.

Maya is a beautiful place for a evening drink and a snack and discuss things - only drawback was that they played music that was loud, and we had to ask them to reduce the volume. The snacks were very good.

Based on the feedback over past few days and also based on some feedback about local meetings in general
Everyone wants to have a Saturday afternoon meeting in New Jersey.
The meeting must be in a conference hall or a banquet hall and have parking facilities.
One or two core members must be present
Training for law maker meets must drive the entire session with other stuff also being discussed in between.
Educating people about IVs goals and the hard work IV does in the background is a must in every chapter meeting.

We all decided that we will be active from now on, if we were not active earlier. We will build a strong State chapter.

Those who were in the "meet and Greet" yesterday - please post your experience - we all took turns and spoke and shared ideas - do please post your experience and your views.

  • The price of GC is what you assign to it. The value of GC is not what other people tell you it is. If you get depressed, make your life hell - it's because you chose it. My PD is 2010 in EB2 and I came here in 2004. I know what I'm getting into and it's my decision so I won't fret about it or get depressed. GC is just a document, it should not define you or your life.

Enjoy time with your Family, wife, kids - it's priceless.....a new sports car will also help. Life is a great gift and will have ups and downs....don't let GC define who you are. I rejected filing in EB3 3 years back with a big 4 consulting firm and changed jobs. I also feel this "promotion" thing but I chose to be in that position. My friends in India are all PM's and Sr PM's.....they got what they chose.

Life is decided by the choices we make, not GC. GC is just a document. Enjoy and celebrate life.

    My dear Mr. smuggymba -
for your kind information, sorry for starting rats comparison here but I came to US about half a dozen years before you. my priority date is 2006 and EB3. also I recognize that there are ppl out there who came earlier than me too. Its very easy to preach 'Life is decided by choices we make', 'your luck/fate, success is decided by your own effort, talent', 'if you have it, ppl will notice it and you will succeed' etc. when you spend the most energetic, productive part of your life in a country, you would expect that country reward you with atleast opportunities to prove your mettle. not to say its immensely painful when ppl who came years and years after you get GC and grow leaps and bounds right in front of your eyes.
P.S. I am not questioning your qualifications or anything.

  • None of the Amitabh Bachans did any thing for slums,Danny Boyle Made a very good movie.I think the fact is Rehman is a prodigy no doubt about that, he makes very good music we all know that.As compared to Hollywood directors Bollywood directors are subpar with the exception of very few good ones. Movie business is controlled in India by few families, what ever the movies they make rest of the people will watch it.I dont want to open the bollywood can of worms.Movie directors in India are usually sons of Bollywood actors or some one related to Bollywood.

I am sure none of the Bollywood directors would ever be able to make good movies, they dont have a global outlook, neither the needed juice. usually Bollywood directors are some low key high school drop outs who have connections with mafia.

If some one who is reallly talented is not going to make it in Bollywood,Southern Film industry is even worse.

  • You don't need to worry.

Your PD will be current in Oct or Nov for sure. With the current way of USCIS handling visas, there will be no big retrogress or big advance. Oct bulletin will stay the same or move forward.

Very Disappointment for me.....as i missed it with couple of days.

Visa Bulletin for September 2010 (http://travel.state.gov/visa/bulletin/bulletin_5113.html)

I'm not sure if they are going to move dates in Oct or not...

  • although this doesn't fit 100% to your case. You may want to look at the attached administrative appeals office decision.

Essentially, a person was denied in eb2 because they had a 3 yr bsc and 2 year masters. they had education evaluationstating that masters indian degree was equal to us masters degree.

nebraska service center stated that 3+2 is not equal to masters degree. Admininstrative appeals office decision approved it saying that it didn't matter how long the combined study was. As long as foreign masters equals us masters then that is all which needs to be proven.

My experience has been that texas service center sends an rfe for this 3+2 education. I know of 8 cases where thie decision was shown in the rfe and they all 8 got approved. I know of one case in nebraska where this case was shown and they still denied it stating that it wasn't a precedent decision (person already had another 140 denied and there was some history in his case which i believe caused nebraska to deny it). Odd part was that the appeals office decision was from nebraska service center

The above mentioned case was later denied. AAO withdrew the approval. See this link -

  • Hi Guys,

I am a July - 2007 filer and we got the FP request in July for me and my Spouse, I have not applied for any EAD or AP extensions recentlly, for a side note i have to travel out side US in July and my attorney requested for FP reschedule (which was actually scheduled in last week July) for atleast 6 to 8 weeks, but USCIS sent me the request with in a week with an FP date just 3 weeks apart from the original one..so i had to rush my things and had to come back to US to get the FP done..

I just called TSC and got a helpful IO. He explained me that the FPs for my case are expired as those were done in Nov 2007. He issued a request to send another FP notice, not sure what help it will do at this time. He did tell me that my case is preadjudicated but also mentioned that preadjudication means nothing more than that a legal clerk or junior IO has reviewed the file and everything is order, in other words according to him preadjudication does not mean approval without any review.

  • My I-140 was lost in mail just this year. My employer contacted USCIS, and they told him to file form I-824 (yeah, with fee). We did, and I got a duplicate approval notice back in about a month. So, if that's your case, here is the answer.

I did FOIA on my previous LC attempt (not I-140); it took over 6 months to get all documents back (you can request a CD instead of a stack of photocopies -- they'll scan all papers and burn the files on a CD for you). I've heard it's getting worse, in terms of response time.

Most of the Democratic lawmakers give a damn to these idiots.

I rarely call anyone a racist - but here it is, the evidence is all there on Youtube, and the internet.

Sorry for the language IV - but these freaks deserve it.

No need to apologize. All these desperate actions show that NumbskullsUSA is scared and trying hard to scuttle this by any means - fair or foul. More power to us and wishing failure for their evil racist agenda. NumbskullsUSA should be designated as a hate group like the KKK.

  • Are you kidding us? I do not know what level of education you have achieved so far in your life but it looks like you are not enough educated to differentiate between the definitions of permanent residency, citizenship and perhaps working on work visa as far as legal stay in USA by outsider is concerned.

What would be the "legal" reply from US Supreme court,if you ask US supreme court that whether citizen of other country can call US president a "My president"? . And What would be the "legal" reply from Supreme court of country A,if you ask that whether citizen of country A can call US president a "his/her president"?

USA expects someone to abide by the land of the law while s/he come to US to work legally. And what is expected legally is one is not involved in "Anti USA" activity whatsoever it may be.USA legally never expects citizen of other country "to love" or "show fidelity" towards USA when s/he is still the citizen of other country.

PavanV is right in his argument, in a sense, that when some person is citizen of country A at this moment his/her fidelity naturally must be for his/her country A. This is the legally expected human behaviour in every society and country. It would have been perfectly o.k. and "legal" about rsharma's statement if he would have already been US citizen at the time when he stated what he stated.

Such ridiculous, unnatural, premature, unethical and spineless behaviour can only be shown by the people who are already morally sold.

First of all when somebody comes here in USA on work visa, s/he has come on invitation from USA base legal employer's willingness and is ethically, legally and morally obligated to provide professional class and quality of work for what s/he is hired. Nothing more or less is legally expected by USA and employment system within USA. USA and its whole society is well aware that these persons are citizen of other countries and so they never expects any kind of fidelity from them at least "legally" and at the same time they even do not grant the rights what US citizen nornmally have. Now out of that bunch many people prefer to go for permanent residency as permanent residency bring little bit stability in living and flexibility in employment and international travel. If one becomes a permanent resident of USA then also USA still only expects that person abide by the law of the land and do not involve in "anti USA" activity. It still does not expect "fidelity" towards USA in legal sense. There is no legal or social or political or any kind of pressure from USA or any governmental or non governmental institutes within USA on any particular person coming from other country to become its citizen. One can stay on permanent residency forever till death(At least based on current prevalent law) and legally work and s/he does not have to become a citizen for working legally. And I do not know about other countries but in India it is not considered "illegal" and/or "unpatriotic" to go in other country(Except Pakistan and Bangladesh) for legal work so coming to USA for legal work whether on work visa or becoming a permanent resident in USA while maintaining Indian citizenship simultaneously is not unpatriotic or illegal. Simultaneously USA's legal system allows an Indian to remain as citizen of India while residing in USA permanently for legal work.

Now if somebody decides to become a US citizen, there is nothing wrong in that. I do not see anything wrong when rsharma states that "I have decided to become US citizen in future". But if he is mature and human enough then his fidelity at this moment should be towards India (Assuming he is a citizen of India currently) as he is a citizen of India at this moment. Showing this kind of behaviour perhaps may not be a outright unpatriotic in terms of "Indianness" but it certanily signals probable but strong disloyality towards India.

And I do not think that USA citizens are that naive that they consider the people "not mingled" if citizen of other country do not call USA president a "My president" while holding the citizenship of other country.

If calling US president a "My President" by non citizens would be the barometer of "mixing" / "mingling" then USA would not be today's USA. So please do not kid USA and us .

Who's is kidding whom? I am educated enough to spot a hypocrite like you. It does not take education or the knowledge of law but some common sense to think about these things, which you don't have. Also, a hypocrital bully like you does not have any morality or ethics anyways. Look yourself in the mirror before you call names or judge somebody. I don't need a lecture from a person like you, especially on the law or the meaning of citizenship, which I am quite aware. So, just keep rambling about your useless crap.

    http://travel.state.gov/visa/frvi/bulletin/bulletin_3800.html

DOS allocates GC numbers to USCIS adjustment cases only as the point of approval is reached. DOS can set/move/retrogress PD based on info provided by USCIS about number of cases at point of approval.
USCIS is not able to provide a good estimate of this number because

it can not calculate this number based on USCISs workload, and
it does not know the number of cases DOL will send to them. DOL again can not calculate the number of cases (it will send to USCIS) based on DOLs worload.

The following are from page 35 and beginning of page 36

The key to addressing this management issue at USCIS is to understand the dynamic interplay of priority dates and shifting workloads of three departments, and to know with greater precision and accuracy the size and details of USCIS workloads.
The tri-agency meetings seek to expand inter-agency communication regarding expected new demands and surges, workflows, and priority dates. During the meetings, there is an examination of the case management systems and data collection processes used to assess workflows through each entity, particularly USCIS.
Although USCIS stated in its 2006 Annual Report Response (at p. 8) that it provides detailed data to DOS, the tri-agency group identified gaps in USCIS data.
