  • Ideally GC should be issued in order of priority dates but from past experiences with USCIS I am not 100% sure that will be the case it will be all hell lose since they have just 30 days to consume all unused visa#. Else they will have to face the heat at the hill. So it could be pick any approvable aplication from the pool and finish the task.

    This is just a wild guess. I do not dictate how CIS will or should work so dont red me if you dont like the guess.

    - fill the complete i765 form, dont forget to sign
    - copy of 485 receipt
    - front and back of current EAD card
    - 2 photos (make sure to write A# and name at the back using a pencil)
    - check payable to US department of homeland security
    - file it correctly to the right service center (dont worry if the address is different than what u filed last time)
    - nothing else (since its a adjustment of status case, there is even NO need of i94)
    - Just make sure A numbers are written properly everywhere.

    I am with you on this and am willing to put in efforts for bringing some relief to all those patiently waiting to file their I-485. Unfortunately, whenever I bring up this topic I get no support from anyone. I don't think people waiting to file I-485 realize that possible wait times could range from 5,6 years to even a 20 ! Everyone has their hopes set on a mirage called CIR.

    Is the following (or can it be) a part of the Admin Fix Initiative? :-

    Allow I-485 filing and/or obtaining EAD,AP benefits when I-140 is approved irrespective of priority date being current. This will help many of us who missed the July 07 boat.

    There has been established a way to deal with backlogs at Dallas and Philly, and these officials at PBEC and DBEC have been given a deadline of Sept 2007 to clear everything. So someting is and will be done in this regard. Not much more can be done here with PBEC or DBEC, and the real test is to get solutions for the retrogression.
    Once the laws are passed on the immigration reforms, its a done deal my friend, and then it does not matter how much we try after this to address retrogression. This is our only chance.
    BUT realize that there have been delays in PBEC and DBEC only because of lack of resources, which can be added or taken off...and this will speed up or slow down DBEC or PBEC. This can be controlled outside legislation.
    BUT THAT IS NOT THE CASE WITH RETROGRESSION. NO VISA NUMBERS = NO PROGRESS TOWARDS FINAL GREEN CARD. DONE DEAL.

    SO PLEASE FIGHT FOR RETROGRESSION AND DO NOT LOSE FOCUS BY FOCUSSING ON PBEC AND DBEC. PBEC AND DBEC IS JUST A RESOURCE ISSUE AND NOT A NUMBERS AVAILABILITY ISSUE. LETS NOT LOSE THE WAR TRYING TO WIN A SMALL BATTLE.

    For immigration purposes, his conviction stands.
    Everytime when he visits consulate for a visa or enters USA at POE, he needs to indicate this on documents and provide explanation (if asked ) with relevant documents.

    Yes, I do agree with you but he asked a specific question related to travelling, and his expungement will help. He need not to declare at the POE about his case but as you said he will have the side effects of this case in various other stages till he is admitted as PR.

What CAN be the "perceived benefit" from a rally like this that would make you think that it would be worth attending? Is it something like a guarantee for a GC in 2 months or a bill that passes next month that does everything we legals want? What is it?"


    i already have my GC but i share the pain and frustration of folks who do not..if a 7 month wait process for me was frustrating - i can understand what a 7 year process would be to others like me...
    With all due respect, I do not think you have a clue as to what a 7 year wait can be like. Having received your GC in 7 months, now I understand where all this critiquing is coming from (without offering any solution of course).

    You have such an active and analytical mind. Why not use it for something constructive like suggesting actual concrete steps that IV can take.

    My first reaction. You're kidding, right! Ever worked in marketing/sales?? When you go to sell your product or service, you try to sell it from the point of view of the customer. In this case, what the benefit can be from the point of view of the US govt and US economy. Yes, our primary aim is to get our GC's in a reasonable time frame. The slogans and messages are in support of these ( By the way both happen to be true).

    Incidentally, even the spark in Gandhi was ignited when he personally was insulted and thrown from a train. My point being that it is only when we personally are affected by an issue that we react to it. The reaction ofcourse differs based on our own individual character, personality and other traits.

For example - we cannot even strike (non cooperation/ civil disobedience movement)....because we get paid by our respective private sector employers.....and our grudge is against the Govt - who do we strike against......?? and if we do strike or court arrest or adopt other forms of civil protest and by chance run up a police record in the process.......who would employ us in the future...in Gandhi's days - they did not have electronic background checks......!!


    Another take - if US can have an endless source of temporary workers coming in, paying into income tax and social security taxes and medicare taxes for a few years......and going back without claiming a single dime of social benefits......its the best possible situation for US....a forever young, qualified, minimum wages (i.e prevailing wages) earning tax paying transient population supporting/ subsidizing an archaic and otherwise struggling social security and healthcare system.

    just to take the "popular" Gandhian analogy a step further......There was Home Rule League and Congress in existence in India for a long time.....their objective was to petition the British Govt for small changes........and their ultimate goal was to get dominion status for india......only when Gandhi came on board plus supporters of other proactive forms of protest.....like Subhash Bose.....Tilak etc and the armed freedom struggle started (Bhagat Singh, Azad et al)......did Congress wake up and ask for "purna swaraj" (complete independence).......so from 1885 (founding of congress) to 1930 (Lahore Session of Congress when purna swaraj declaration was made) - nothing happened......british empire went from strength to strength.......then in 17 years - India got independence.......

    pl think about what i wrote objectively......and dont jump on me just because i am playing devil's advocate

    b) if your H1-B has a valid visa stamp and you didn't use your AP

    ie, basically if you have other valid documents to enter the country back, is the application deemed abandoned?

    2. Which "application" is deemed abandoned? Application for obtaining the AP or the I-485?

    I have read Gandhi's autobiography. He clearly explains that he first tried and succeeded using his manthra of passive resistance in South Africa against appalling treatment of Indian workers. They were on 'H1B' in South Africa and were treated worse than stray dogs. Gandhi fought against that and had some success.

    So the idea of passive resistance DOES work in a foreign land. We are fighting against injustice. Even H1B folks have some fundamental human rights, whether we are in a foreign country or not.
