As you probably know, Employment Based immigration is currently showing years of retrogression; more than 350,000 labor applications are stuck in the backlog centers and there is no information on when we can see even a ray of hope. Applicants have to wait for their green cards for as many as 4-7 years, depending on the country where they were born. With retrogression, applicants are unable to complete their final phase of green card even if they have cleared all the previous hurdles. We, a group of volunteers at www.immigrationvoice.org (http://www.immigrationvoice.org) . We have set up a non profit organization to work towards resolution of these problems.
In the past we have seen that due to a lack of professional representation, employment based immigration issues have been ignored by the lawmakers. The latest example has been dropping of section 8001 & 8002 from the Budget Reconciliation Bill passed by the congress in December 2005. With comprehensive immigration reforms on the anvil in the early part of 2006, the time to act is now. However, with the current political scenario and the overpowering debate about illegal immigration, this is going to be an uphill battle. We have already initiated talks with professional strategists who have in the past been able to achieve goals similar to the ones we are working for. We feel that these are the following ways a professional strategist can help:
1. Identify feasible goals that can be achieved and are representative of the people in this forum. We should not have to piggy back on H1s or illegal immigration - we need an identity of our own
2. Identify the champions amongst the lawmakers, alliances, organizations who are willing to shoulder some or all of the responsibility in passing provisions to solve retrogression & address labor backlogs centers.
3. Identify opportunities to meet/interact with those mentioned in point no 2.
4. Help us in putting our points across cohesively and in a way relevant to the political situations
5. Keep a close monitor on the progress and the situation so as to identify the opportunities as they arrive.

If nothing comes up...Check if your original employer files New I140 to consider you in EB3 instead of EB2 using same labor.

I was mistaken reading the labor cert application. It did say "we accept BS + 5 years progressive experience".
I am 3 year Eng diploma + 1 year Eng post Diploma + 10 year exp in India + 5year Exp in US before filing Labor Cert .
I do have a copy of the Educational evaluation used by my old attorney which says US master equivalent.
As one member pointed out , there is a possibility that my original employer might have sent a letter saying Labor cert has mistakes but I have no way to confirm that . Or it could that the Officer is just trying to find any small thing to make the case deny.

The, few, motivated members like me who do take time off to visit Congressmen offices - do make all the points written down by you and some more. Our issue isn't that we are short of ideas or points. We have them in plenty. I assure you that I have raised these issues and made these points in every meeting that I have had so far.
Our issue is shortage of volunteers ready to visit Congressmen offices and making these points. It's highly critical that IV members keep visiting these lawmaker offices in small groups on a continuing basis (one group after another) to keep up the pressure and convince them of the genuineness and the breadth of our problem.
It would help our cause immensely if members did actually meet the lawmakers and made these points themselves, instead of expecting the few motivated members to act like a postman between them and the lawmakers. If lawmakers saw a larger number of members approaching them with the same points, it will make a better impact than a group of three which approaches them one in a while. It would help your cause as well as ours, if members did take initiative, set up meetings, and participated in these activities organized by state chapters in greater numbers
I think what is killing this movement is that core and senior members are not open to suggestions from other members. They seems to be saying, our words are gospel truth, any deviation is not allowed. And that is killing the motivation of ordinary members including me.

This would be the last visa bulletin for this year. The dates should move just like they did last year to consume all numbers.
Hopefully when the dates move, it moves with all pre-adjudicated applicants within the cut off date get their GC and not a lottery. That should hopefully bring some order to the system. Let us see.

I think Wah Wah is confused by the differences between 'retrogression' and 'backlog'. Of course, you are right that the PDs are not likely to go much further back (I think USCIS took a conservative approach after July - note they are still issuing visas to those with non-current PDs but are using the bulletin to limit incoming new filings). However, if 20 million applied in July the coming backlogs would be horrendous, even though priority dates would not necessarily need to go back further.
However, in a sense, if the backlog is perpetual, and let's say the PD never really moves forward by more than, for example, one month, in the next 10 years (I'm picking extremes to make my point) then the effective retrogression at that point would be greater than say todays.

My understanding was that once the 485 is filed, you go by RD. It doesn't matter what your PD is...

I am not sure, but I have heard that most cases go through just fine because AC21 protects you, but only when ex employer withdraws the support for 140, some officers may want to ascertain that the new job is satisfying AC21 criteria and may ask foer more information than that was provided - now all this is based on what people talk about in the forums and on my discussions with people, as such, if you are doing everything by law there should not be any issue

if your PD remains current for at least three months in a row and everything else is clear, there is good chance you are out of the pipeline.
My PD is current for almost a year and Name check is cleared in July 2008.

I am into Datawarehousing and BI. Worked in multiple technology such as Oracle BI, Cognos, Informatica. It is frustrating to see my mid-size American Consulting Company charging the client a $180 per hour while I get $85K per annum. I cannot even switch to my client since I have signed a non-compete agreement..... I think direct marketing is the best way to augment your rates....
Well, I like you because you are just a straight shooter. If you are such a straight shooter then let me do some straight talk, so just catch this.
Your American mid-size company or Desi small size or super size company will get $180/hr but you will not get even $50/hr from the same client even when you go direct. So no matter how "highly-skilled" you think you are, your non-compete argument is not good enough for you not to be able directly market yourself, because there are gazillion other companies using BI, Cognos, BO, Informatica, Datastage and every similar crap. You can impress a few people by naming some technologies that maybe hot but they don't mean a &hit if you market them yourself. Here is why. A lot of people blame the lack of GC as a reason to be exploited. That is part of the problem. The other part of the problem is that most hiring managers in large companies get commission from these small, mid-size or large American, Desi or European consulting companies. That's why in most cases they always hire through one of these companies. They will not hire directly because the manager thinks you to be a stingy desi, and if he hires you directly the hiring manager will not see a dime, so why will he hire you directly? This is a big cycle of corruption and everybody is part of it including lawmakers who get contributions from lobbyist/representatives of these small, mid and large size companies. You think lawmakers don't know what is going on? You think client doesn't know that you make 85K when the middle company get $180/hr? You think the big-bosses at the company/client doesn't know that the hiring managers are getting favors from middle companies? You think lawmakers doesn't know that immigrant worker waiting for long delayed GC is bonded to an employer that buys employee retention insurance policy for the employer? They all know it. Welcome back UN. One question. Does the USCIS have ability to check credit histroy.
Lots of things have changed since 9/11. Browse immigration.com for peoples postings over the last seven years and find some articles written by attornies and deportation cases.
Before your flight even takes off; the passenger manifest is sent to Department of Homeland Security. They run it against every database they have. Before, you land they already know whether you have a criminal record (expunged or not); you have a warrant or are on a terror watch list.
There were some high profile cases where department of homeland security received the information late and had the plane diverted to Canada and had passenger removed who was on such list. I even believe Cat Stevens was denied entry after his plane left England. I think the plane had to stop in Nova Scotia and they wouldn't let him back onto the plane.
I have known people who had shoplifting record in California that was expunged. When they went for visa stamping they answered that they hadn't been arrested (chennai consulate). Visa officer already had the information and confronted person with it. Person explained that since it was expunged; their criminal attorney told them they didn't need to declare such things. Person had to get the court/arrest records to show consulate (Person is on h-1b and has US citizen child (for what it's worth). Don't know if person was able to come back here.
In local office interviews; people have been asked if they have criminal record (I/O's basically ask every question again on 485 and g-325a; just to see if person is telling the truth (they already know the answer). Person replied no and USCIS officer stated that was not the information they had and confronted the person with the record.
Every time someone opens up a bank account, brokerage account, etc.; their name gets sent to Washington DC and checked against terrorist watch lists under the anti money laundering rules which I believe came into effect in 2002. Why is that relevant.
I know of two people. One lady who after she got EAD/AP was awaiting local office interview. She went to India and came back to USA. At the border; CBP asked her if she owned any company. Before, she could answer they named the company. In her passport, they made annotation of possible immigration fraud and sent her for deferred inspection to local CBP office. Lucky for her she had opened up the company after she got EAD and CBP allowed her in and eventually she got greencard (she opened up the company and had husband contracting through the company).
Another person I know; he had H-1b and was working for some motels (he specifically told me he did IT work and wasn't working as a clerk and the company was a holding company with many motels). His case was transferred to local office. Local office called him and stated they wanted him to come to office next day. Can i apply for 485..with 140 pending? and then switch to EAD after 6 months?
I will be completing my 9 yrs for H1 in Jan 2010...;)
Allowing people to file for 485, but not giving any GCs may be the plan.
Such a move do not bring much complaints from anti-immi groups. But this move will reduce the noise from people who have not yet filed for 485s. May be after getting EAD all those people will invest more in America.
This is maximum bang for the immigration buck from the USCIS/DOS point of view.

This is unprecedented - NSC was doing Eb3 140's slowly and now they stopped.
NSC EB2 140 is July 5th 2007 (my friend got approval yesterday by filing in Aug 2007)
Clear your cache and then reopen browser - you should be able to see MAY 15th update.

He got the nomination after 2 weeks in the office (Feb, 2009 last date for the entry). It is too early for him. We never know how he perform for next 3 years. Award must give after seeing the real work. Not by the speech by the politicians.

US consumes 8.9 million barrels of oil per day. Even if it climbs down, mark it as 8 m.b/day. That is roughly 2900 million barrels per year. If you have a hypothetical 'Bernake tax' of 50 cents per barrel ( distilling to a few pennies per gallon) for one year, one could generate 1500 million dollars. This is without the troublesome IV members getting GC, problems with anti-immigrants in many states, employing more temps at CIS to process the extra 10,000 GC in the queue etc. While I claim not to be smarter than the Fed chairman, even if I am just a local politician, I will bet on taxing gas per barrel than give GC in an election year.

Applied for EAD extension on July 18-2008 (expiring on Sep, 2008), less than 90 days. Today (Aug 15, 2008) received an email saying "Current Status: Card production ordered." for self and wife. No idea whether it is 1 year or 2 year extension. APs are still spending.
