    1. I do not have my I-485 receipt notice(I do have the numbers though)
    2. I do not have EAD/AP(Employer did not let us apply)
    3. I'm already in my 7th year of H1. Current stamp expires in Sep'2008.

    Can I invoke Ac21 somehow?

    I would suggest that you apply for EAD/AP yourself without lawyer's help. I think you can just use receipt numbers.

  • well said and I agree 100%. it is not as simple as saying that by buying now you are saving 12 months rent. (for one, you get a place to live which has flexibility..though smaller). if you need it now as said above it makes sense (and I would say if u need space because grown up kids need space or you have other family member staying (like parents etc) ..)
    I agree Texas did not see the boom that was seen in other places and hence is relatively a better place to buy. that being said, I guess it depends on location too ..even in good places (all except the super bubble states of CA, FL etc) ...make sure that location looks good (good school, less crime) ..and at the same time ..easy commute (who knows ..gas maybe $6 and rising in future)...ino ther words even in TX, if the houses were built far away ..then they too will fall in prices

    I think gas price is a non-issue. Gas in India is more expensive than in the US and considering the income there, the effective cost is even more higher. And yet, people continue to buy more and more without regard for increasing gas prices.

    The same logic applies here. Back in 2001, once gas prices starting going up and in places where gas cost $1.30, it hit $1.50 which people found "shocking". And yet, there wasn't the slightest reduction in the number of cars bought. Even now, with all the dismay at soaring prices, nothing much has changed. Freeways are just as jammed as ever.

    The fact is, the American is well equipped to deal with $6 prices. The reaction we see is is just due to the unpleasant thought of having to pay more. It is not a showstopper by any stretch of anyone's imagination. At the worst, it just means they will have to cut back on annual vacations which is not a big deal for us, but obviously a catastrophe to the average American.

    I think this thread is very informative and relevant at this time a lot of people are getting green cards and that has to be on their mind.

    I did read about a case long back in 19XX there was a brink mason who came here on an EB GC and worked for his original employer for just 1 day and switched the employer sued or may be the INS charged him (Not to clear on it) but the gist is that he got his GC and courts ruled in his favor because he showed that the work promised was not the one he was asked to do the conditions were different and hence he was not bound to work in those conditions.

  • Are you out of your mind ? You are taking a huge risk by staying in the US and droping your Canadian PR because of some "probable" green card. What makes you think that by the time you finish school the situation will still be better in US. I hope you will not regret this but think about your family. In 3 years you and your family could be happily in BC with free health care, great weather, less stress, travel wherever and whenever you want, have your own law firm.

    OR you could be a stressed H1B (a.k.a educated slave) waiting for I-140, I-485, EAD or whatever to come through.

    Just because you asked, I have been in this same situation. But in my case, the decision was easy. I was on h1b making 69k. The same job in Toronto offer $55k CAD. Much less, but with my freedom to consult on the side and my wife's income we bring over $100k. We vacation in Florida for a month every year to visit friends. Life has never been better.

    Whoever tells you to stay and take the risk is putting your family's hapiness in jeopardy. But the choice is yours. Just don't come here crying when CIS finds a problem with your application.

    Thanks gomirage for your views as an actual Canadian resident! I have worked with several Canadians before, and while they all complained about the high taxes it seemed like they generally thought they had a better lifestyle in Canada than in the US.

    However, some stuff I've been seeing on sites like notcanada.com concerns me. Is Canada really a place where it's more profitable to sit around and collect welfare than to work, assuming you can even find a job? Are Canadians more racist than Americans? Is it really hard to get by career wise and socially if you're not a native or have the appropriate connections?

    I would really like to hear the views of someone having moved to Canada from the US about these issues!

    There is a big difference in EAD and GC. EAD is always temporary in nature. You will be always dependend on USCIS . Many companies do not entertain v.s GC EAD e.g. State Government(s), defence companies and etc..

    You cannot use EAD to return back to this country, you have to use AP.

    A biggest thing i.e. fear. The fear would be always in your mind, if something goes wrong for your I-485 and you will be out of status except MTR.

  • My colleague filed 140&485 in August. Her case was sent to TSC. So far her 131, 765, and 140 approved. Also, she has done her FP. What a different! I was wondering what's the purpose of "bi-specilization"??

    The name check takes 2 years anyway, making a mockery of fast processing times. Even VSC, which is the slowest, takes less than 2 yrs for 485.

    BTW, it is awfully quiet here nowadays.

    Immigration and education should be two seperate things. NO support to categorize further on immigration, We should take out the country cap. It should be First come first serve basis. with necessary background checks on education and skills.
