This process is a mockery of the PD cutoff dates, but that's how it works. If you sent your case on June 28, 07, with July 2, 07 as the printed Receive Data on your receipt, but the case where it finally rested, was entered in their database on Oct. 28, '07 (with a Notice Date soon thereafter), you case will not be looked at, no matter what the PD cutoff date is, unless all cases received before Oct. 28, '07 have been reviewed.

This is THE time to stop answering negative mails,and convincing chronic doubters. It definitely distracts. Maybe until the bills gets to voting on the Senate floor, we should all unilaterally stop spilling out our doubts and apprehensions on to the forum. Now, coming to more useful part: Many of the universities and research institutions employ chinese and Indian postdocs and researchers on H1. Many of them sponsor GCs via EB2 and rarely EB1. Although many members here in the forum are under EB3 (isn't it?), the retrogression affects both EB2 AND EB3. The catch is, these institutions come under (many of them if not most) a category called non-profit, no cap etc. Looks like they cannot, as institutions, lobby against retrogression. I personally tried to do this in my institution but I was turned away; also my institution is very small unlike for example: University of California schools, or University of Texas schools. In all these institutions, the affected researchers work for individual Nobel laureates, accomplished professors (both chinese and Indian origin AND native born Americans) who can support the efforts. That requires a nodal point for information exchange. One side, IV can do this and on the other end, there are somethings called: postdoctoral fellow associations in many universities.

It will make more sense for an organization like IV trying to convince NPA to raise this issue than individuals like me. I have been in science for 14 years and I say from my experience.

I tend to disagrees with your comments, firstly please dont call this a stupid event, as a lot of young students strive to win this competition. In order to lead you have to follow, I have come across some smart ass Indians who love to talk and give directions, but they miss whole chunk of substance in their directions. (I don't mean to target you or disrespect any one else up here).
Your commments on parents motivating their childeren to strive for success in their lives, their is nothing wrong in that, would you rather have them go smoke dope and jerk around to waste their time? I am indian and proud to be, , above all proud that my parents pushed me to excel and do better with the opportunities granted to me.
However it is some desi companies who brought in the trend of lying and faking to get thie ways. But believe me , they dont get much further in their lives. I am glad strict restrictions are imposed on these companies, and the type of consultants they bring on board.
Is it fair that the person doing Masters from this country be put in the same boat as a fresh of boat from India?

I did online MS degree and it took 3 years, although I could have completed it in 2.5 years. First year I completed only 1 course per sem, then I started doing 2 per sem. I took non-thesis option and the total cost was aprx 15K from ISU. Thye charge flat rate fee per subject ( aprx 3 credits) irrespective of residency requirements (you can actually do this course from anywhere in the world and it would cost the same) . This degree requires 30 total credits (one of them must be a project, so technically only 9 subjects/courses to take).
I know, it's going to be a long journey, but a start would definitely help.

I assume you might have gone to Rt 23 DMV, try Rt 46 in Wayne. They are more considerate. I had my DL expiring in April 07 but my H1 was Valid till Sep 07 (the DMV officer had a made a mistake in 04 by putting the wrong experation date when I went to update my DL with Motorcycle endorsement. When I pointed this out he said I still have almost 3 years so come back then:mad:) . I went to Rt 46 Wayne and the lady renewd mine till Dec 07. 90 days more than the valid dates on H1. She said she has already included the grace period which is avaliable in situations of visa renewal so I can renew my visa and get back to them in time. This shows that there is a provision for 90 day grace period.
Try Trenton if Rt 46 in Wayne fails. Best of luck.

Sorry to hear about your experience. I personally have used AP three times within one year. Two trips to India were of 6 weeks and 4 weeks duration and one to Canada for 4 days. I have never faced any problem, having used three different entry points. During my latest entry just a couple of weeks back I wasn't even asked any question at all. In fact my GC was approved while I was out of the country. Just your bad luck to run into this officer, I guess.

The real problem has been the l1 visa..and ignorant americans do not know the difference and they think everything is h1b but it is the L1 which has caused wages to drop....
