  • The bulletin is 2 years old (if that is considered old, given the GC standards). However, no new bulletins have followed to void it. Unless I have been advising with the wrong lawyer and wrong GC applicants (many), there is no such thing as I-485 Approval before the name check is completed. Any third party would like to comment?

    Of course, they will not "approve" your 485 before your name check is cleared. You misunderstood me or I was not clear. What I meant is this: if your name check is not cleared but all other work on 485 is finished (which I think I equated to clearing the 485 in my previous post; sorry), they will tell you on phone (if you inquire) that your 485-related stuff is complete, but we are waiting for the name check. (Also, they will wait for your PD to become current).

    My main point in the original post was that if it takes them 2 yrs to check your name --- the name-checking process runs concurrently with the 485 process --- then the 485 is bound to be complete by the time your name check is cleared. The processing times of 485 can be gauged from the VSC (or relevant center's) bulletins. Those proc. times do NOT indicate the processing times for the name check. If the name check happens before the 485 process is cleared, great! If not, you wait for the name check; lots (and believe me tens of thousands) of people belong to the second group. Since this forum mostly has people stuck in the process at earlier stages, you are not going to find too many people with that kind of experience here.

    So your respected lawyer is technically correct, but what he/she is saying can be very badly misleading!! One gets the impression that clearing the name check happens automatically with completing work on the 485 by USCIS.

    Wait a minute; I thought the name check is part of the I485 approval (and for those who file I-140 and I-485 concurrently, part of the I-140 approval).

    And the name check is certainly not a part of the 140 approval even if the 140 and 485 are submitted concurrently. If any lawyer is telling you this, please change him/her.

    I hope what I said above makes sense :) Took me a long time to compose that ...:)

    I mean #2 here. Unscrupulous because they misuse the forum for ranting and bashing others, dishonest because they bash others they perceive as "bad" for their own GC while pretending to be in IV for everyone's good. Scoundrel, because because they operate on multiple ID's

    Some are plain old #1, but they harm too.

    So, this is my explanation why I used the words "utter rascals". Come on, now you can give me some greens, because it "helped" you to understand what I meant :p

  • With the new rule on FBI name checks, a potential 47K with current PDs could get their GS's soon. I wonder how much of a shift we will see in the PD's from now, after the 47K is not taken into account. I would predict a minimum of atleast a year jump, or am I being optimistic. :confused:

  • OK I double checked the new license. Even though the Expiry is 2014, it does have in red "Temporary Visitor Status Expires: 09/09"

    and got 7 year (or is it 8) renewed license

  • I agree with you. But you don't have to go far to find Google at fault. If you look in the Indian English Media, you will hardly find any news regarding Diwali. If they put some news on Diwali that news will be like "Dismal Diwali" etc. I am not kidding. This is the news regarding Diwali in CNN-IBN.

    But when Christmas arrives, our Indian English Media will go on and on with their positive spin of Christmas festival.

    Everything in India is controlled by western money. They are spreading their tentacles and have started psycho was against our culture.

    Is it too much to ask Google to put a Diwali logo like it does for Hanukkah or Christmas .. at least if not in google.com but in google.co.in?

    It is this mentality of deliberately ignoring the feeling of majority of the world population that is getting the western civilization more and more isolated and retracted.

    Well it doesn't really matter. And I am visiting India now and I can see that this country and China will definitely kick ass of Western civilization .. as it is already doing. The people here are hungry for more and in spite of seemingly unsurmountable problems it will succeed and once again India will be the "Sone Ke Chiriya".

  • I have a 4 yrs BE (ECE) degree. so am not sure what could be the RFE. Do we also have to submit education evaluation for a 4 yr BE degree from Ind?
    also since its a govt organization, my LC juz said 4 years bachelors or equivalent. i do have a Masters from an US state university. so not sure what could be the RFE.. ability of pay is not an issue i guess, cos its govt. what other rfe's are there?

  • One should remember the history of immigration in US. US histroy is more than 200 years. Most of the immigrants came/occupied the US, entered illegally. Legal immigration is still very new to US, by considering lenghth of immigration in US. Furthermore, till 1965, asians were not allowed legally in US to get GC. They do not like law obeying asians. This is the history. This is what it is going to be in future too.

    Nobody can predict when July filer will get AP too.

    There is a good chance I am taking this risk. But if there is any hope I will wait. Contrary to that if there is no hope I don't want to keep waiting until July next year for AP.

    Do we need to send end client 'project verification letter' or something like that ?.

    that is a good guess - I hope it is correct.

    However, whether the fees are being used for overtime or for more people working on a case, that means USCIS is understaffed and needs to hire more people. In that case, isn't it logical that they would increase fees across the board for all applications, not just PP? i.e. fee hikes would be for new applications to pay for the extra resources, and existing applications should be processed under a flat fee for all cases.
    If they are claiming that those who pay extra fees are entitled to faster processing, ahead of the line, then that, my friend, is a bribe, whatever official term is used. Because otherwise if they were understaffed, which it appears they are, they would simply raise fees for all applications.

    I can understand a corporation doing this, like getting your tax refunds processed faster through a company if you pay more, but imagine if IRS suggested they would process faster for an extra fee.

    They cannot raise fees without providing extra service. USCIS does raise fees once in while though. But the PP fees bring in a very large amount of revenue in comparison to small increases in regular fees.

    Also, for better service, people often pay more. I invariably pay more in an airplane to be in the first class. Not sure why USCIS cannot use that logic to make some more money. I don't think it is comparable to a bribe. But, I guess we will agree to disagree here.

    I think it's fairly common. So don't worry about it too much.
