    07/10/2007: Response of USCIS Director to Visa Bulletin Fiasco Related Flower Campaign

    * We reported yesterday that foreign professionals have been sending flowers to the heads of involved agencies with a message of protest for the ongoing visa bulletin fiasco. Dr. Emilio Gonzalez responded to such flower campaign in the USCIS site. The flower campaign appears to be a gesture from the community of foreign professionals to thaw out the tension created by the fiasco and at the same time calling the agency leaders' swift attention to the problem and sufferings of the foreign professionals and their family members. This camapaign has been initiated and pushed ahead by the immigrationinvoice.com group. Salute to the members of this group for the job well done.

    people we are coming close to the situation where it is "do or get fried :)".

    I disagree that the situation is very bad.

    It is bad only for those that are laid off on H1B. All others have EAD and are happy. They will realize the bad situation only when they cannot take a promotion or salary raise or cannot change job due to same and similar. Or if I485 gets an RFE or denial.

    If the situation was bad, more people would be serious about your idea including you. Even you are not willing to do anything yourself other than asking others to do it. So this is the fate of immigrant community. We all do not want to do anything ourselves unless we ourseves are in a bad situation.

    Thanks again for being ever so helpful. That being said, can you please share your thoughts on the following situation?

    140 approved, 485 pending for more than 180 days, EAD/AP approved, and in hand.

    Candidate leaves sponsoring employer and joins another employer (similar position/salary, etc.) New employer's attorneys send the AC21 letter and G-28 forms to the USCIS. The attorneys are very familiar with this, have handled lots of AC21 cases (Fragomen).

    Is there any way the candidate can call USCIS customer service and ask for the attorney/representative's name on file, just to make sure that the G28 did get processed and the attorney name on file got changed from the old law firm to the new one? Would customer service share that information with the candidate?

  • IT and BPO outsourcing is also leading to Americanization of Indian youth and Indian youth are spending their high salaries on American products. In no time you will see American fast food chains, groceries, and many American MNCs cashing on a Americanized Indian crowd and neutralize ( and will eventually exceed the investments they make).

    This is the beginning of Americanization. Most of you will not understand what I say because you are here in US for a long time and being first generation immigrants (on a limbo) keep up with your tradition. Americanization is like a slow bleed. IT and BPO is investment. Returns will come in form of MNCs and businesses and finally benefit American economy.

    Just go back to India and look into the ITand BPO companies and lifestyles of people there. it will be 5 times higher than what we follow here as the Americanization is already induced.

    Bottomline, do not underestimate America. They know what they do.

    I share your thoughts. There are a multitude of sectors/issues that are mimicking the American style. With the advent of ICICI, any body can pretty much walk in and get a loan with a 30 yr EMI. Imagine the number of people losing jobs in India, both at Multinational and local companies providing services if the economy tanks here. What are people gonna do with home loans they signed up for 30 yrs or what ever? Fore closures on a grand scale?? Indian economy has been going up.. up and up due to software services and BPO sector. With out any manufacturing, infrastructure building up it would be very difficult for Indian economy to sustain growth or level out gracefully when hit hard. IMHO, Just being the back office of the world will not get India on par with US.

  • I and many folks in this forum have seen very few approvals for this category. How come USCIS says that this category is over subscribing the visa quota. Why they are moving un used visas to EB2 (no offense) why not for EB3?

    We need IV help in this area.

    I fail to see what is unjust about this. They move unused numbers from EB1 to EB2 because it works this way.

    EB1 -> first level of preference
    EB2 -> second level of preference
    EB3 -> third level of preference

    Now are you saying they should skip level 2 and drop some unused numbers from 1 to 3 directly? Why? That would actually be unjust.

    To be fair, the US immigration system cannot be blamed because a lot of us desis have entered the queue.

    Everyone has the right to speak and if other Nationalities want to wish their fellow countrymen on their festivals they should be allowed to do so.   • EB migration was a added almost as an after thought to the family based immigration bill. Current or future considerations were not taken into account when they wrote the bill, the prime focus was (is and will be) the family based immigration as they get the most votes, they have the most 'heartbreaking' stories. I understand your point. I also dont want to argue about how USCIS distributes overflow. I have been dealt a hand i am dealing with it.

    I do want to say that nothing will happen unless you make efforts to make it happen. We need to talk to the lawmakers about our problems. Half of them still think we are talking about H1 and launch into a spin about outsourcing. The H1 lobby has major companies backing them, anti immigration groups are flush with cash and are very vocal. Hispanic caucus is a big group. What about us, do we just keep discussing issues or try to educate people on our problems...if we dont we will stay a minority with no voice, simply pawns used and abused by others.

    As I see, most of you are missing the point. Instead of trying to understand, you showing the maturity of mind. The whole purpose of EB immigration is to meet the Demand(Job opportunities) vs the supply(immediately available candidates).
    When there are a lot of opportunities exists for EB3 level(skilled profession) and less opportunities exists for EB1(Ph.D/Executive Director), USCIS should give more no. of Visas to EB3, then EB1.
    A country cannot be built with only the kings, and not even a home can be built with only Ph.Ds(Nobody do the dishes).

  • I am no expert here but know that most of my friends did not have priority date current but were getting EAD/AP all the time. So once filed and accepted (receipt#) I am sure you would get an EAD/AP (the first one would come quickly 2-3 months) then extentions of EAD/AP might have a different outcome.

  • Thanks SGP. Did I read this correctly ? you switched in 9th yr of h1 ? was ur I-485 pending or did u have EAD to change ? I just have I-140 approved. so if I change to a new job now, can the new employer use this old I-140 for extensions ? can new employer ask USCIS to port old priority date ?

    floridasun: Yes, you are reading it right. I switched in the 9th yr of H1. As you can see from my signature I am yet waiting to apply for I-485. I have an approved I140 based on which I switched from Company A to Company B. The only things I had to do was transfer H1 to Company B and start New Labor. Once new labor is approved then, will have to do New I-140. You can ask USCIS for old priority date at the stage when you apply for new I-140. The new labor and I-140 can take anywhere between 6 to 8 months. Your old employer cannot revoke your approved I-140. Make sure that you have the copy of the approved I-140 before you quit.
    Don't worry go for it. I know what it feels like.

    I have 3 yrs degree + 1 yr PG diploma. I have been working in industry for past 17 years, and don't think any degree or even doctorate would add much to my qualification for the job that I am doing.

    I am currently filed in EB3 category, and new company I am changing job to are ready to refile my GC. But they won't file my GC in EB2 category, as I don't meet the 4 yr BS requirement.

    My son will be in the highschool in 4 years, and I don't want to spend a lot of money on getting MS to myself. But for the GC I am looking for fastest and cheapest way to get MS program. I have no idea how it works, what qualifies me for a degree, what can I get credits for. Any inputs would be appreciated.
