Hmm. That looks like the solution to my problem. So If my GC is approved in a month, I go to India myself, get my wife's consular processing done through follow to join route and bring her back together. (Assuming follow to join process takes just a couple of months). If my GC is still pending, then I go to India and bring my wife on a visitor visa, and then apply her I-485 in US.

So the basic message you seem to be giving is that just because my GC is approved, it does not close doors for my wife. She still has 6 months to get going. Right?

Final Q, how long it took from day1 of EB2 filing to filing I140 this week ?

My PERM was filed on 30th March, approved on Aug 11th, received approval copy on 18th Aug, and I-140 to be filed this week.

There was a lot of prep work involved before filing PERM in March. My employer agreed to start the process in Oct'09 and the lawyers started the ads in early Jan.

I just called USCIS customer service to get it clarified for my case - applied 485 in July 07 and used AC21 in Aug 08. My 485 got approved Aug 6th 2010.

The first level officer said I am free switch. When I told that I have heard I have to stick to my current employer for 6 months or so, she put me on hold to check with supervisor. Then transferred me to 2nd level IO.

After almost 1hr wait, the second level IO confirmed I am free to switch. She got my receipt no and checked the status and mentioned I should get my card in week or two and I am free to switch.

Again, as mentioned I already invoked AC21. It will be good to hear from ppl who have not and if it makes any difference.

I am just confused that how they assigned 70K EB2 visas in 2008. Because EB2 share is
40k + 4k(EB1 left over)+? how many FB = 70k . So from above it looks like all FB leftover went to EB2.

Please clearify.

I understand you don’t care about the United States and its people and you’re only interested in what you can gain from them but if you weren’t so blinded by greed you’d see this is something else they can give to you. Now I know why I took the route I did, I would have accomplished far less in my personal life with the likes of you. In fact, I may doing to much sharing my expertise with you. I refuse to have my name tarnished any further. Besides, you’re only a beginner. What was I thinking? IV really ought to make it clear to everyone that this is an amateur site. Maybe by changing its name to Beginning Immigration. IV definitely is not the voice of Immigration – my voice is different from IVs and I’m dealing with immigration. I may have to contact the internet higher-ups about this farse.

Thanks for sharing your expertise. But unfortunately we are not in the drug trafficking business. IV is only for legal employment based immigrants. This is clearly stated in the IV policy.

Believe me, you wont get any help here. You like it or not, its the fact. So dont waste our time as well as your's.

Do this - Hire a homeless person, give him a VOIP phone with unlimited calling minutes, and ask him to call USCIS every second of his life asking for your recipt. Some day you will get the good news. If you hire 10 homeless and give all of them this job then you might qualify for "investor green card"!!

I see there is a lot of discussion about how one day GOI will have an agreement with US Govt and we will all get benefits of all social security taxes paid. I don't see that happening because India doesn't have a social security system! US does have social security agreements with a lot of countries but those countries have social security programs. US transfers credits and the other govt has to take care of the details. Also, these agreements are always bilateral. India would have to offer some sort of social security or something in return to US nationals working there. I wouldn't get my hopes high about getting social security money if you leave the US before getting 40 credits. In fact even if you do gather the credits ... by the time you become eligible in 30 years things could be drastically different and you may not get a single penny out of it.

I am not sure what your health insurance situation with your employer is. Here is some thing I know. Please research and see whether this helps.

Under HIPPA regulations, insurance companies cannot decline pregnancy as pre existing condition if you and your spouse are covered by group coverage. Generally, group coverage is the coverage you get from your employer. If you currently do not have health insurance through your employer, try to sneak into the plan now as most employers will have open enrollment period during Jan/Feb of each year. If you try to buy individual coverage from a HMO/PPO, those insurance companies can mercilessly decline maternity coverage.

If you get into group coverage, no matter what trimester your wife is in, insurance companies WILL have to cover the maternity as per the plan choose.

Please investigate and let us know what you find.

My employer does not have group insurance. I tried compelling him to take but .....

Then I bought a individual insurance for my self, wife and kid (in Texas)

And insurance companies in Texas are not providing maternity insurance for individual insurances (not violating HIPPA rules) and very recently came to know that my insurance covers the compilications of maternity(not really sure, need for confirm with some one or would try to call my insurance company for more details) and for new born child as per Texas law. But not the regular maternity. Which is the reason I am trying to buy a plan from Hospital for Maternity.

And about your last point, I am trying to find out if I can get into any group. currently used AC21 with H1 and my employer does not have group insurance.

My client (big one) is ready to give me full time but not the title that I want and they are not ready to do H1 (with AC21) but agreed with EAD

Even prime vendor is ready to give full time with EAD with the title that I want and client is ok with that.

The only problem is if I leave my current employer and go to prime vendor, then it would be a problem, else find a different employer do a different H1 and ask the vendor to transfer (but not sure if this would create complications unless my current employer is OK with it).

Need your input on these!

But let me know if you know any one who bought Materinity plan from Hospital in Texas (Dallas)
