  • From numerous visits to USCIS facilities, the Ombudsman has observed that adjudicators prefer to work on the cases that are easiest to complete. Adjudicators pick the �low hanging fruit� first because supervisors base performance evaluations on the number of cases completed. Consequently, adjudicators put aside the most difficult and time-intensive cases. These cases remain pending, perhaps for years, while backlog reduction appears generally to be succeeding.

    The Ombudsman fully supports USCIS efforts to quickly and efficiently complete the cases. However, the current drive to complete large numbers of cases presents problems. For example, USCIS provides field offices resources based on what is needed to complete a typical case. It is the Ombudsman�s understanding that if field offices have a workload of 1,000 cases and USCIS determines each case usually takes one hour to complete, USCIS will provide financial support for 1,000 hours. Cases that take longer than an hour to complete are not provided additional resources in the office�s budget. Offices with more than the average numbers of difficult cases or offices that try to work the difficult cases thoroughly will not be adequately funded because the number of completions will be low. Meanwhile, offices that push to complete the easy cases will see their budgets grow.

    One field office visited by the Ombudsman has a large number of long-pending cases which require substantial adjudicator hours. However, officers at that office indicate that they cannot address the older, difficult cases without negatively affecting their productivity report to USCIS headquarters.

    Ombudsman's Recommendation

    The Ombudsman has observed that newer cases are processed more quickly while cases more than six months old are increasingly backlogged. The Ombudsman supports the USCIS drive to maximize case completions, but attention needs to be directed at clearing older cases. The Ombudsman recommends that USCIS provide a clearer picture of the current backlog by providing information on the number of pending cases by form type with receipts that are:

    < 90 days;
    < 180 days;
    < 1 year;
    < 2 years;
    < 3 years;
    < 4 years; and
    >= 4 years.

  • Folks I had an infopass this morning for EAD pending more than 90 days. The officer basically told me cannot issue EAD but will contact NSC to check status and gave a customer information receipt saying "Our records indicate that your I765 is pending. I will contact NSC for further review of your application"

    I was very disappointed by this. Is there anything else I can do to get interim EAD? I still don't see a LUD on my case.
    I took 3 infopass appointments but not one helped, but if they take your FP in the infopass appt, you may get your EAD approved after 4-5 weeks(as happened with me)

  • Since you ask - the answer is YES. Not sure if you have heard of the "Servant Leadeship" but that is a management philosophy that believes an organization makes the most progress when the "leaders" at the top take the attitude of being "Servants" to those below them. The idea is based on the simple premise that people are more engaged and motivated to work when their boss listens to them and takes the trouble to keep them updated on what is going on. Instead, "Leaders" can always take the "high and mighty" road where they look down upon those below them (for various reasons - lack of trust being just one of them) but that is never going to be as effective or efficient as the former model I just mentioned. Don't take it from me though - feel free to do your own research on this topic and you will find that an increasing number of companies are starting to adopt this philosophy in order to achieve superior results and you don't have to look far to see how this is being practised in the world of politics today (President Obama)..

    I have one question for you:
    Are you willing to copy paste what you have written above and send it to your VP and CEO of the company and ask them to behave like your servants because this is the best philosophy for a company to progress? :D:D

    Please also ask them to be transparent and keep all employees informed of all discussions because you contribute your sweat and blood for the company?

    Come on. Just because we have this open forum where we can hide our identity does not mean we can write anything. On this thread I see 2 anti-immigrant, anti-IV posters. They pose as regular members and whenever anyone posts such thread they do not lose any opportunity to attack.

    Let me share my experience with IV. Initially I did not know much about IV and when my friends said lot of good things about it, I always dismissed them and never came to the site. Then one day I decided to check myself and contacted IV and a core member was nice enough to explain everything. My senior member friends from my town were also helpful in explaining. So I will let them do the good work they are doing. I know I cannot spend so much time on social service that they do. I would rather spend my time on the beach playing beach ball.

    Well I jumped a little too early :) and opened a SR in July. The following is the response I received:

    I kind of agree with you. Hope USCIS starts moving faster on applications at-least after that 1 year time frame.

    I think they had given a waiver till August 21 or so for the July fiasco filers.

    I recommend you talk to some lawyer or call USCIS.
    USCIS is helpful.
    My take on it is this : you have to PAY $340.
    A lawyer will always say "DO AS PER INSTRUCTIONS".
    But this case although unique, you still belonged to the pre-aug filers, even though there was a waiver (since u were applying based on PD which was for july month).
    I remember that during that time USCIS has instructed everyone to add some kind of bright color sheet / paper on top of your application to state clearly that you belong to that group of pre-aug filing people and that you are filing using the old fee structure. that way you are clearly telling them "dont reject me directly because of incorrect fees".
    Again although this seems very straightforward to me, that you HAVE TO pay $340, I still recommend you research more/talk to lawyer/USCIS.

    ‘(6) The school will allow the Secretary to make on-site inspections, and will comply with the Secretary’s requests for information, to determine the extent to which the school is complying with the requirements of this section.

    ‘(f) Reports to Congress- The Secretary shall evaluate the results of grants under this section and submit to Congress--

    ‘(1) not later than 18 months after the date of the enactment of this section, an interim report on such results; and

    ‘(2) not later than September 30, 2012, a final report on such results.

    ‘(g) Application- An eligible school of nursing seeking a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information and assurances as the Secretary may require.

    ‘(h) Authorization of Appropriations- In addition to the amounts in the Domestic Nursing Enhancement Account, established under section 833, there are authorized to be appropriated such sums as may be necessary to carry out this section.

    ‘SEC. 833. DOMESTIC NURSING ENHANCEMENT ACCOUNT.

    ‘(a) Establishment- There is established in the general fund of the Treasury a separate account which shall be known as the ‘Domestic Nursing Enhancement Account’. Notwithstanding any other provision of law, there shall be deposited as offsetting receipts into the account all fees collected under section 106(f) of the American Competitiveness in the Twenty-first Century Act of 2000 (Public Law 106-313; 8 U.S.C. 1153 note).     (c) Global Health Care Cooperation-

    (1) IN GENERAL- Title III of the Immigration and Nationality Act (8 U.S.C. 1401 et seq.) is amended by inserting after section 317 the following:

    ‘SEC. 317A. TEMPORARY ABSENCE OF ALIENS PROVIDING HEALTH CARE IN DEVELOPING COUNTRIES.

    ‘(a) In General- Notwithstanding any other provision of this Act, the Secretary of Homeland Security shall allow an eligible alien and the spouse or child of such alien to reside in a candidate country during the period that the eligible alien is working as a physician or other health care worker in a candidate country. During such period the eligible alien and such spouse or child shall be considered--

    ‘(1) to be physically present and residing in the United States for purposes of naturalization under section 316(a); and

    ‘(2) to meet the continuous residency requirements under section 316(b).

    ‘(b) Definitions- In this section:

    ‘(1) CANDIDATE COUNTRY- The term ‘candidate country’ means a country that the Secretary of State determines to be--

    ‘(A) eligible for assistance from the International Development Association, in which the per capita income of the country is equal to or less than the historical ceiling of the International Development Association for the applicable fiscal year, as defined by the International Bank for Reconstruction and Development;

    ‘(B) classified as a lower middle income country in the then most recent edition of the World Development Report for Reconstruction and Development published by the International Bank for Reconstruction and Development and having an income greater than the historical ceiling for International Development Association eligibility for the applicable fiscal year; or

  • Outlook is very very grim without a bill from what I understand. EB3 India is going to be in a hole and EB3 PDs that are 2006 and later have a really long wait time ahead that they are not imagining. We are all hopeful by nature and look forward to visa bulletins with a positive attitude but such PD folks may be disappointed month after month for several years. For EB2 India it is important to know number of ported cases. EB3ROW folks also need to worry now. Their journey may not be that smooth due to spillover rules and high demand. We need to get data via FOIA to make a better guesstimate. Without such data we will hear various theories, predictions and interpretations from various websites and blogs that may not be always true.

    I appreciate your input, but IV members have been talking about numbers and numbers and numbers for last 2 years in a row.

    What will the numbers reveal? I had been a regular blogger at IV, but I stopped coming up here because.

    1. All talk and no Walk
    2. New members come aboard, are rude and offer no pragmatic approach.
    3. All these bloggers give ideas and critique each other.
    4. What happened to the March1 09st rally in DC?


    Why has IV not taken a pragmatic approach, don't take me wrong I respect what you have done and other approaches in the past. But IV is using same approach for a new problem, the end result-----Failure


    I joined this community after july fiasco, and have kept close watch on dates, everyday members keep suggesting something or the other. I don't mind being a donor to IV or contributing little what I have, But I need to see some big movement and results.

    what was the result? If IV wants core members and new members to donate and be a part of something bigger than a website, then please initiate something big like a rally.
