US does not discriminate on the basis of Race, Caste, Religion though their is no mention of country of birth. But discriminating Green Card quota on basis of somebody's birth may be unconstitutional..If we appeal in the supreme court, the supreme court can ask the congress to ammend the laws...google and see there have been several instances in the history when Supreme Court told the congress to change a illegal law.

What do you mean by working? Is this just your idea or you have some information on the effects of this campaign?
I am not saying that it is working on the USCIS. We dont know yet coz the flowers start reaching there tommorow. If it is working on USCIS, we would know by the end of the week. Not now.

What I am saying is we are getting a good amount of attention from a lot of newspapers - which is important to create more awareness on the plight of half a million law abiding immigrants and the backlogs they are facing.

You are talking about getting GC. My position is that I am just waiting it to be MARCH 2005 just to file for my 485. My job requires EB2 but attorney filed it in EB3 and now doesnt want to re-apply EB2. You all are better than my position. Been here for more than 8 years but still dont have EAD.

Agreed...it is personal decision...but for Indians...it is a difficult decision. The way India is growing....People who have lived here for more than 10years...are migrating back....i know a person who left...has warned me...just to earn and get out.....not good for kids future etc....

Agreed it's frustrating to go thru a roller-coaster ride as far as GC is concerned. I believe members of IV are leaving no stone unturned to tide over the GC hurdles by speaking in one voice and acting in unison.
Literally, we must have the 'staying power' to do this. If people wanna go back to their home country, it's their personal decision. Impatience and frustration should not be the driving factor for people to return to their home country.

How about if I send in Ac 21 paperwork and still be on leave of absence from my present company which sponsored my GC. It only gives me peace of mind because in case the new job does not work out I can still come back...
I suppose it depends on your employers LOA policy, but in most cases you are not allowed to work for another employer when you have taken a leave of absence. And if it's not illegal it would certainly be unethical.

Getting an H1B visa seems to be the be all and end all solution to come as a permananent resident of this country. While H1B visa is a non-immigrant visa, Greencard is the immigrant visa.
We want this article to solely focus on Greencards. The title can be like --"In Search of the Green Card". The article can be such that general public in India is educated and made aware of the struggles to achieve the coveted GC.

Please note that the Form I140 is no longer valid for porting purpose under section 106� of AC21 if the I140 was revoked due to the fact that you did not meet the minimum requirements for the labor certificate at the time of filing. I hope 180 days had passed after 140 approval. A little more detail on the case will be appreciated. Was it a case of substituted labor?

Get the help of your attorney ASAP. Figure out if there is a way to undo the damage.
I am not very sure of the details, a person I used to know was forced to join his previous company because they threatened him in similar lines.
& please do keep us informed along the way. We may be able to be of assistance to you in some way or the other. Local IV chapters have access to local Congressmen etc.
If nothing works go kick the ass of the person who is responsible for your predicament. Interpret kick ass to more severe alternatives. Some companies are anyway taking advantage of people stuck in GC queue. On top of that if they harm us they need to pay a heavy price.

But, more seriously thinking, isn't Mexico also one of the backlogged EB countries? I doubt they will mind having a provision for us while they do their campaign. Perhaps we really ought to join hands with them so our objects can get more widespread support .. just an idea
