    often times i have noticed that the blissfully ignorant GC applicants come better off than rest of us- who act like chicken with the head cut off after every bad news!!! may be they dont worry too much and look at it from a whole another perspective...who knows...i wish i could be one of those, but i am too far in the game...damage is already done...:D

  • This is the latest on the Visa capture bill.

    This thread is to track the progress of S.1085 legislation.

    This recapture bill was introduced in the US senate and it has been referred to the Senate Judiciary Committee. It has ten members with 6 democrats who usually favor immigrants , including the chairman Sen. Charles Schumer, one of the sponsors of the bill. It will clear the committee, no doubt, but how fast?

    IV should focus on this legislation getting passed. It has provisions for the unused visas in any category for the oversubscribed quota. This will definitely help reduce the backlog.

    Lets focus on getting this bill passed. It is for the people who play by the rules and obey the laws of the country. Who pay taxes and contribute to the economy. Lets try to get this bill passed and capture all the VISAs lost due to the inefficiency of DoL and USCIS.

  • I agreee with the spirit of things - that multiple ways of expressing anguish, disgust, frustration is required.

    While we have to keep generating funds and doing the lobbying, the frustration of the members must be "used".

    Here is my suggestion (and this was mentioned by someone earlier also) - let's send the criss-crossed and blackened photocopies of our degrees, patents, publications etc. to the congress and other authorities as a symbol of how useless these are becoming as we wait for GCs. We can coordinate the event such that everyone's reaches at around the same time.

    Again, all I am saying is that we can do multiple things to gain attention and make our point, and these can happen simultaneously with the other activities ongoing at the State chapter level.

    My personal advice - you should consult with an experienced attorney with the specifics of your case. This is not a very typical case, and what you hear on this forum may not be very useful for you.

    Need your valuable advice on this serious issue. Involved in shoplifting case, got arrested and plead guilty. Served the community service, and paid fine. Got the �Court Disposition Document� which states that I am all clear. My status is I-485 pending and have EAD, AP documents.
    1. Is it safe to travel to India and come back on AP?
    2. What are the possible chances that visa officer may not let me into the USA?
    3. Do I need to carry any letters from my criminal attorney explaining the situation?
    4. Any one in similar situation, please update me on this?
    5. Please list of documents I need to carry during my travel

    Please reply and post your valuable opinions/suggestions/advices.

  • All NVC documents take 3-4 weeks before you get them. NVC sent Biographic forms data to my lawyer's office on July 2nd and they reached my lawyer's office last Friday. So it was approx. 3 weeks.

  • I went through the Federal Firearm Law and here is what I found:

    (d) It shall be unlawful for any person to sell or otherwise dispose of any firearm or ammunition to any person knowing or having reasonable cause to believe that such person�

    (5) who, being an alien�

    (B) except as provided in subsection (y)(2), has been admitted to the United States under a nonimmigrant visa (as that term is defined in section 101(a)(26) of the Immigration and Nationality Act (8 U.S.C. 1101 (a)(26)));


    (y) Provisions Relating to Aliens Admitted Under Nonimmigrant Visas.�
    (1) Definitions.� In this subsection�
    (A) the term �alien� has the same meaning as in section 101(a)(3) of the Immigration and Nationality Act (8 U.S.C. 1101 (a)(3)); and
    (B) the term �nonimmigrant visa� has the same meaning as in section 101(a)(26) of the Immigration and Nationality Act (8 U.S.C. 1101 (a)(26)).

    (2) EXCEPTIONS: Subsections (d)(5)(B), (g)(5)(B), and(s)(3)(B)(v)(II) do not apply to any alien who has been lawfully admitted to the United States under a nonimmigrant visa, if that alien is:
    (A) admitted to the United States for lawful hunting or sporting purposes or is in possession of a hunting license or permit lawfully issued in the United States;
    (B) an official representative of a foreign government who is:
    (i) accredited to the United States Government or the Government's mission to an international organization having its headquarters in the United States;or
    (ii) en route to or from another country to which that alien is accredited;

    101(a)(3) The term "alien" means any person not a citizen or national of the United States.
    101(a)(26) The term "nonimmigrant visa" means a visa properly issued to an alien as an eligible nonimmigrant by a competent officer as provided in this Act.

    As per my understanding, if you are legally in the US, you can own a small firearm...walk into a store and tell them u need a gun and they will tell u what paper work you need or go to your local police station and ask the requirements.     - Labor was filed with a minimum requirement as Masters degree. No alternate degree requirement or equivalency was mentioned. --> just found out that it did say BS+ 5 exp is ok - USCIS mistakenly approved the I-140 (I am assuming OP does not have a US Masters and only has masters equivalent or BS + 5 yrs)
    - Sponsoring employer revoked approved I-140
    - USCIS checked the I-140 and realized it made a mistake in initial I-140 approval
    - USCIS denied the pending I-485 based on incorrect I-140 approval

    If all of the above is correct, then I doubt if anything can be done. I dont see any grounds to file MTR based on the fact that beneficiary does not have a US Masters degree which is the requirement as indicated in LC filing. I dont think you can do anything with respect to USCIS's mistake in approving I-140 earlier and now denying it. Got to wait and see what the attorney's view is in this regard.

    Since the application do say BS+5 years and I have copy of the Edu evaluation which says Master equivalent , I do see a good chance now to re-open the case .

    Mine is not a labor substitute. ( just to clarify)

  • One of my colleagues, got his GC last yr (EB2, PD 2006) in Aug. 2008 even though his receipt date (Aug. 2007 as per receipt by Texas center)
    was not honored.
    I believe that even receipt date is not honored if the case has cleared all formalities and PD is current.

    My last post in the matter. By our perspective, what I meant was, if you see an article talking about common topics such American Compititiveness or Illegal immigration you can always send an e-mail to the reporter and talk about plight legal immigrants. In most cases you will see a response from the reporter, whether they publish it or not is generally a matter of who you represent and audicences to the cause and other issues . That's why I said if IV as an organisation sends an e-mail (it could be me or you but representing IV itself) there is a possiblity that you will be taken seriously. But repeating the same issue to the same reporter 100 times will not make it any important it might even have a deleterious effect. I have seen this method working in the past. If you disagree with my approach, let's agree to dissagree on our approaches.

If I am not mistaken, You are suggesting that we come up with a list of issues and do a press release and that should be fine. Well, Its a good idea and I am sure we had PR releases when there were events.

    If you are saying that we should do a press release now instead of sending personalised emails, I guess its gotta be more with the $$ than being able to do it. Not all reporters, do leave an email and google might do the job. I have tried sending emails to such reporters and the response has been lukewarm over the past 2 months.     Everyone who changes jobs under the protection of AC21, must do so under the assumption that the sponsoring 140 will be revoked.

    It is not a matter of our convenience. If you quit the sponsoring employer and he has no intention of hiring you again after your GC, then what is the sense in him retaining your 140 for no reason? It only adds complexity to some employers as dangling 140s are counted to evaluate their ability to pay. So even if it is not law, it makes sense for employers to revoke 140s of employees who quit them.

    AC21 protects you from such a revoked 140. We have seen some cases where revoking the 140 - even after the 180 day mark - has resulted in 485 denial. This is a mistake from CIS and is easily fixed.

    Expecting the previous employer to hold on to your 140 is not very different from expecting him to keep your you previous job open for you - just in case.

    That is right. I am in same boat. My previous employer says - "if you want to come back to the company, we can start the GC process new and fresh for you, but if you are not on our payroll, we will have to withdraw the 140 because we do not want to get into ability to pay issue"

    My only concern is AC21 letters not getting into your file and USCIS issuing a NOID or a denial.
