  • Actually very true. I for one have held off on buying a gun (though my wife highly disapproves of guns) simply because I dont have a GC and dont want any hassles. Besides I live in Chicago which has a ban on guns. Ironic that the maximum killings and drive by shootings happen maybe 30-40 blocks from where I live but the city doesnt allow legal law-abiding residents to own guns.

    It isn't an outright ban. Chicago doesn't allow concealed carry, and requires guns to be registered, but you can own guns. Yes, the process for legally owning a gun in Chicago I understand is very tedious (sad, I know), but not impossible. Much like NYC.

    I think IV should work on filing a CLASS ACTION LAWSUIT for several reasons. Are we going to be coward legals waiting, for lazy folks at USCIS to undo the wrong they've done for so many years.

    1. Blatant errors in the processing which has, destroyed , causing huge stress, trauma and what not to ppl waiting in limbo.

    2. Inability to provide any insight on the basic timeline for any application. Look at the EB backlogs, they change there bulletin as if its a stock market, it can go forward or backward depending on the mood of the ppl working on any day.

    3. Immigration is a burden on the legal immigrants, we pay for those ppl jobs. How can they offer such a sub-standard service, considering the hefty fees they charge from us.

    4. The US constitution says " We the people", does not say "Legal Aliens" don't have any say or can't ask for justice.

    5. We are legals, did not cross any border like those illegals, which this administration is so concerned about. We pay for services, not screw ups!

    6. Lost EB visas for USCIS / DOS mis-handling.

    7. Even if we loose the lawsuit, still we made our point. USCIS sucks! period

    Ok now, i'm ready for all the red dots, who think that keeping quite will some how magically solve these problems. They need to be held accountable for what they've done.

  • Gave in and sent PP by Fedex yesterday for Schedule A, grp 2 case.My attorney did not advise me to PP nor did a legally brain I turn to for advice. He said its likely that I would get approved even during retrogression.
    But I decided its better to know sooner than later, preferably before spouse started using EAD, and if a miracle happens (who can prevent miracles?) the 485 could also get approved concurrently with the 140.... And because I have 13 days more before retrogression hits. And because I saw people reportiing really qiuck turn around after PP. My employer was willing to pay half as well...

    Well plus I did not want to be stuck in the general EB2 pool (India) which looks like its a black hole. I have an approved labor from 2004 there.(yet to file 140 for that one)..so didn't see a reason to be stuck there with a 2006 PD.

    I still wonder if my reasons were sane and if my hasty action mght prevent my spouse from working -- if the 140 gets denied...Well, we'll take it as it comes..it may mean goodbye to the US or something..

    BTW as far as I know, retrogression doesn't start till November 1st.

    I had all paper work ready for PP and were sent to my Lawyer for premium processing of my Sch. A case. But retrogession occured that night in Nov. visa bulletin. So my lawyer advised me that it is not advantageous to go for it unless your date is current. So we did not filed it.

    As I remeber you were not ready for premium process. Any reason or justification for rethinking your decision? let me know if you can outline some advatage of PP of Sch. A at this point, or have seen some cases which enjoyed some advantage due to PP very recently.

  • Thanks Kumar1 for letting us know the options. We both have valid EAD's in hand. I like to maintain the H1B status as I am the primary applicant for the GC.
    As you said some of friends also mentioned the same about talking to lawyer. Only thing I expected in this time is peace of mind. This is the worst timing.     I'm trying to post the IV Fliers at my Alumni School.But the issue is we need a 'sign off' from Facilities dept. at school.But again, the policy depends from School to School . Some dont need that at all.So i'm in the Final Process of completing the formalities and it is very simple.Just a simple courtesy phone call to the concerned to make this happen. All the international students are potential members to join IV and contribute to our cause. So i advise all the IV members/Core Members to think out of the Box like these as we have very little time left.but i really envy the Irish Lobby who are way ahead of us.Anyways, we need to bang it out hard or our life is gonna be dormant for lots of time.





    Should watch AILA's stand on this. One group who would benefit immensely with this system would be immi lawyers, at least for first 10 years after which it would be more established. A perfectly intelligent delaying technique moving the issue away from its solution at least by 2 full years. This idea appears to be so full of holes, it seems as though coming from WH itself.     on the contrary, the point based system completely eliminates the need of a lawyer, with the canadian and australian system u just need to do the work urself online and the balls starts rolling then, it'll be interesting how they react to this
