My girlfriend (from Russia) and I have been for about 3 years and living together for the last year and I've recently decided I want to propose this summer. She is currently here as an I-9 form (she's in grad school), but her student visa is expired. She recently got a job on campus and while she was going through the paperwork yesterday realized that her passport is going to expire next April (2012). So she is now planning to go back to Russia at the end of the year to renew her passport and apply for a new student visa. As I think we'd both like a longer engagement, and with a fiance visa you need to marry within 90 days of entering the country, we probably wouldn't want to apply for one at that time. However, I'm now wondering if being engaged will cause any complications for her when applying for her student visa. Any information or advise you could give would be greatly appreciated. Thanks!

What a chaos? We were so close, turned out to be mirage. When do you expect your GC? My PD is Feb 2006. I do not expect anything positive in 3 years. I doubt anything changed in our career in 2 years. Where do we stand?
Frankly speaking, I always thought that this is going to harm the people with older priority dates but I never vented out. It turned out to be true. They chose almost randomly among the ones who filed during that time and quite many with old priority dates were left out. I think had that fiasco not been there and had priority dates moved slowly, the things would have been more streamlined.

Because, if I go to https://egov.uscis.gov/cris/jsps/Processtimes.jsp?SeviceCenter=NSC the processing time for "Skilled worker or professional" is April, 1 2008, does this date apply for all? I have a PD of September 2007 in the EB-2 category. I am currently on an H1B 3 year extension(after 6 years) on basis of an approved I-140.I am a physician and would like to pursue a fellowship given that it is unclear how many years I will have to wait to get a green card. Can I extend the H1B (change employer),given that I got the 3 year extension of the H1b on the basis of an approved I-140? What are the consequences for the H1B visa (employer change).I know I may have to start my green card process all over again.Thank you.

Talked to my lawyer today. I am in EB3ROW and my PD is current as of June bulletin. Unfortunately, NSC is not processing my receipt dates yet, so I have not heard anything.
Lawyer said that there is a chance EB3ROW will retrogress in July or become "Unavailable".

I have a quick question. Should I go ahead and apply for my wife's I131 – Advanced payroll too with her 485/EAD. The way I understand 485/EAD/AP is as soon as she gets her EAD, she would want to work and in that case it would be recommended to have a AP too. People suggest that AP should/can be applied later on but I do not see any benefit in saving 6 months/170$.
Also let me add that my wife will be in US from August 10th to August 26th and then November 10th. As you have to be in country till AP approval should i defer applying her AP now. She is currently on H4.
Please suggest.
