  • Basically to retain the PD you should have the copy of the I-140 approved and you could retain the PD. Having said that, different lawyers have different interpretations when you switch jobs and retain the PD. Basicallly some lawyers say you could retain the PD even if your old employer uses it for another person after revoking yours, while others say you can't retain PD if your old employer revokes your I-140. However if your old employer willn't revoke your I-140 then you could definetely port your PD with your new employer. If you employer is hesitant to give, you could try asking him other ways if possible for H1B stamping etc.

  • Thanks,
I think so. I have one of my friend. His case got transfer to Texas. He filed 2 months earlier than me. He got approved already in late August.

    Thanks,

    Wata,

If I were you, I would rather wait atleast till Nov 2006 before converting I-140case to premium processing because as you said NSC is currently processing I-485 cases for Dec 2005 and it would take 5/6 months more from now to come to June/July 2006 to process I-485 at current pace. But Again this is my personal thought....

Moreover, in order to take advantage of AC21 portability you I-140/I-485 case has to be 6 months old. So getting I-140 approved through premium processing does no good as you would have to wait till Dec 2006 anyway for your I-140/I-485 case to become 6 months old.

    Thanks,
    Law Loving Alien

  • I am in the same boat. I have asked my paralegal about it a few times and he seems reluctant. He said they don't normally do it. By law, are they not required to let us have the receipt? Like you, I do have the receipt numbers, but not the physical copy of the receipt. Like you, I currently have no intentions of quitting, but I would like to have a copy... just in case.

Well..I am sure there might be lot of people like us..is there anything we can do to control these pigs..??

I am sure there may be many people who now say,
who asked you to come to this country
who asked you join them..blah blah...

just because we get hired doesnt mean we allow them to abuse us

I think we should take some initiative to control them or alteast save people like us

    Friends,

Are we required to carry GC with us all the time ?

My attorney says we must. What if I lose it or damage it ? Can we carry a photocopy ?

  • Even though the context of your question and intention is suspicious at best....it's actually a really good question.

Let me restate it for the benefit of others

BB: Mind pointing out what exactly is suspicious about me or my question?
And Grrrrr why only for the benefit of "others"? And I thot we were "friends"..

  • My 485 was apporved in July 2010 and have not recieved the card yet. I have contacted with couple of Service Request for non-delivery of permanent cards. First reply from USCIS was that my case was waiting for finger printing information from my local USICS was backlogged for appointments. So, I have told to wait for 60 days for either FP notice or physical green card. After 60 days, I have called them and another service request was created and the reply was completely irrelavant as they says my address was updated for my query about non-delivery of GC.

Is there any other escalation request that I can made for deliveriy the GC or the FP notice? whenever I called the USICS are creating the SR and have to wait for answers like above.

I have recieved the 485 approval notices (for both of us) on July itself but waiting for cards now. Are anyone with the same boat ? Or Is the unusual case?

    Thanks
    Rama

Contact your Congressman and Senator. Mine was also approved in July but the card came in November. Went for a couple of Info-pass, opened SR, called & e-mailed USCIS but nothing happened. USCIS is backed up on card production too.

  • Dont think negative !!! THINK always that it will be true.

The LAWSUIT has immense WINNING POTENTIAL.... Instead of losing in court of law and make that a NEWS in major mainstream media GOVT agencies wrap up mistakes in this way. This method works everywhere , so that the noise level remains low.

As the lawsuit progress they may offer Financial compensation ... anything can happen if you can Prove that you have been beaten financially for a wrong announcement... I mean if you can show receipts between June 13th and June 30th and that document is a requisite in 485 application anyone can claim compensation ...

That's how american JUSTICE system works for citizens ........

Bad roumors become true - not good ones

  • LostInGCProcess,

The only reason I want to still enter on H4 is that my H4 is stamped until 2010, hence why not use it and save money and hassle on AP entry. As you have said that working on EAD immediately invalidates the H4 status. This is OK for me, but at least I have avoided the AP procedure stuff. Plus the primary applicant is on H1 and hence we both can enter on H1 and H4 respectively rather than one entering on H1 and the other on AP. Let me know if this clears your doubt and if so, can you think this would work out. Also, if you can, please respond to my other questions

    Thanks,

  • Neither of these are SLR's unless I'm mistaken. To hit the price range you are after -- you are looking at the Nikon D70 or the Canon 300D. It appears that you are looking at the P&S that are 8mp, keep in mind that the 6mp crop of dSLRs here mentioned above will get a higher resolution and better ISO range, which can help you always indoors. Definately enough for your 11x17 print desires. Those 8mp sensors are using much smaller sensors which by statistic sounds like more, it's not really.

If you are moving from a P&S and your not familiar with SLR's, this might be a learning experience for you. Is it worth it? Definately.

I'm Canon biased, but I've heard great things about the D70. I'd check out both and decide which is right for you and the possible future lens purchases.

  • you need to be old enough to carry on a convo like adults with full words, not slang, etc.

most states allow people to get work permits at certain ages, to work after school and such.

If it is your parent's company, then no age limits apply.

  • If you get H1 transfer with sponsorship for GC, you can port your old PD to the new I-140 petition. Better to apply for 3-year extension now itself, if you think there will be layoffs. This gives you sufficient time to apply for perm LC/I-140.

  • Guys, If we try something its not gonna hurt us. If we don't try we may have lost an opportunity. The least that this dude can do for us is listen and then we can follow up.

I insist, again, lets talk abt soc. sec treaty. With thousands of us having together millions in that account, the US gov. will have to do something. Remember-its our money- the US govt. cannot deny it if asked by The Indian govt. IF they wanna keep it, better give us our GCs!

    I agree !

  • Just curious - Have you heard of a case being rejected just because the salary was higher than the original LC ?? (Assuming job title/description are same or similar). I think it will be almost impossible for them to reject just because is higher!! Govt. cannot dictate the upper limit of salaries (in private sector).

nope, so far I have not come across a single case where this has been an issue (which was one reason I went ahead with the move). However there have been inklings about USCIS possibly taking a tougher position on this in the future.

    For instance see:
    http://www.murthy.com/news/n_porret.html
Salary Considerations for the New Job
    MurthyDotCom
Attorneys in our firm are frequently asked about the impact of a difference in salary when changing jobs under AC21. We are also asked what "same or similar" really means in order for one to be eligible under AC21 portability. USCIS policy memoranda, particularly the May 12, 2005 Memo referenced above, have been quite favorable on these matters. However, in that same memo, the USCIS stated that the forthcoming AC21 regulations "may take a more restrictive position than this memorandum." Therefore, while issues such as salary differences do not appear to be problematic at present, foreshadowing indicates that this could change when the regulations are released at some future date.

From my research I have found so far that it will be hard for them to put a dollar or percentage figure on the amount the salary can vary. The best they can do is perhaps put it in some range based on prevailing wages. Other than that, salary itself is a very market driven thing. I hope they dont, and I dont think it buys them much. The DOT codes and job-duties description should be what they should look at (or actually they should broaden the allowed job changes considering how long the wait has become now-a-days).

Lets see what happens. Main trouble is like what Murthy mentions in that article a little later: if changes happen, they are retroactive...

  • I agree that car depreciates as soon as you drive out the showroom but what I believe is that if you can afford to buy your dream car and plan to keep it for atleast 7-10 years go for it. Life is short, if you can enjoy luxury and at the same time know your limits don't restrict yourself and drive used cars all your life.
As far as your home mortage is concerned, talk to your banker and negotiate favorable terms. If you plan to live in that city depending on job market, don't worry about home prices. I hope you did not buy that home to make money overnite but to enjoy the luxury of living and owing a home. In any case, don't plan to put money on home, better to save or invest where it makes more sense like stocks, CD's or land/home in India.

I donot see any point in paying off the house, as you can deduct the interest to get some tax benefits. Why loose any benefit you can get.

On the other hand, use the money you were thinking of paying off the home for investments. Investments may it be CDs or stocks ( though right will come in future).

Although personally i have never bought a brand new car in US. Car depreciation is biggest loss one can take; we just bought a 5 th car...all cash paid and it is used.

Keep your cash, play with 20-30% based on your risk apt, donot pay off your home...cash is king.

On your comment of " being a novice in financial "...i have to say it Everyone is a novice in every matter, we all learn it here. Rather one who says he/she is a novice will make cautious decisions; i am wary of so called experts/gurus who mauled financial markets and still call themselves experts.

Start reading finance articles, blogs and you will be able to understand.

  • I've been thru many jobs here, and none of the offer letters mentioned that the job would be "permanent" (whatever that means). It's especially not possible to have that written on job offer letters for contract/project-based jobs. In any case, UDCIS does *not* require you to mention that on your EVL.

in my case, my rfe was clear that my evl needs to state that my job is "full time and permanent". it also asked for salary, "specific job duties", educational/training requirements, date of starting the job.

it also said that the ac21 letter my company lawyer had already provided when i changed my job was inadequate in details!!! howzzat?

  • It is so pathetic that there are so much people waiting in EB3-I category.

This Guy just applied in Dec 2004 and got GC. His question is whether i need to carry ?

    it is only karma.

I feel for you buddy. You can't be hating the player....you got to hate the game. This is exactly how I felt when 2006 PDs were getting approved last year. You are totally right....GC depends on your Karma.

  • This is absolutely no-sense at all.

Texas, take about 2-3 months to approve 140 and 485. While Nebraska take about 4-5 months to approve only 140. This is not included 485 that back up from December 2, 2005.

You compare about 2-3 month processing time from one Center and another 1 year from another service center.

People there don't know how to do the mathematic or what, why keep sending everything to Nebraska still. Why don't transfer from the last person in Nebraska to Texas and have Texas start processing 485 in Queued.

We don't want people get process by Luck! or by paying more money and left other people behind.

    What you think?!

How many copies of RFE do they send? i mean do they only send one RFE notice to Attorney or do they send one RFE notice to Attorney and a copy to employer?? Can somebody tell me..
    any body on this !!
