    Attorneys in our firm are frequently asked about the impact of a difference in salary when changing jobs under AC21. We are also asked what "same or similar" really means in order for one to be eligible under AC21 portability. USCIS policy memoranda, particularly the May 12, 2005 Memo referenced above, have been quite favorable on these matters. However, in that same memo, the USCIS stated that the forthcoming AC21 regulations "may take a more restrictive position than this memorandum." Therefore, while issues such as salary differences do not appear to be problematic at present, foreshadowing indicates that this could change when the regulations are released at some future date.

    From my research I have found so far that it will be hard for them to put a dollar or percentage figure on the amount the salary can vary. The best they can do is perhaps put it in some range based on prevailing wages. Other than that, salary itself is a very market driven thing. I hope they dont, and I dont think it buys them much. The DOT codes and job-duties description should be what they should look at (or actually they should broaden the allowed job changes considering how long the wait has become now-a-days).

    Lets see what happens. Main trouble is like what Murthy mentions in that article a little later: if changes happen, they are retroactive...

  • They will stamp for the latest i797A. The old one is obsolete. If you notice the I94 numbers are the same.

    You are right on the I94 numbers; they are the same. But how come the old one is obsolete. Its valid till June 2007. And the latest 797 is from July 07 till July 2010. They'll have to combine both I797's dates to stamp till 2010 or they'll go with the first 797. Am I right??

    I think there is a mix up here between two things:

    180 day clock does start on the first day after filing 485, but that is for the purpose of AC21. Once you use AC21, then the next employer assumes the role of "your future permanent employer" and you should have "intent to permanently work for that(new, not the sponsoring) employer" AT the time of GC approval.

    If you use change the employers 7 times using AC21 before your GC gets approved; you should have "intent to work permanently for the latest employer".

    You are not bonded slaves. The only issue is that the "burden of proof" of proving the intent to work for such and such employer is on the GC beneficiary and not on USCIS. So in future, if USCIS questions (or CBP questions), it is YOU who has to prove that intent.

    One scenario where you WILL NOT BE ABLE TO PROVE IT: if you never worked for the sponsoring employer.

    One scenario where you WILL NOT HAVE A PROBLEM PROVING IT: if you worked with sponsoring (or latest AC21) employer after GC approval for some duration (60 days?? 90 days?? 6 months?? 1 year??)...no law on this.

    This is the whole purpose of Labor Certification process and I140. And it applies to the categories of EB2 (except NIW) and EB3--any category that requires LC.

    BTW- if u have an approved I797 and an expired I94, u are not out of status....when u travel next time out of country...keep current docs with u and when u reenter...the POE officer will give u i94 based on ur latest I797..


    What I dont understand is when u entered US in may 06, with a I797 of 2010, why didnt the POE officer give u i94 until 2010?

    Is any company filing new PERM applications in this economy? I was told that my current company (a really big one at that) is holding off PERMs indefinitely because we had some layoffs- indefinitely!

    My H1 runs out in Oct 2010, and I heard that I have only till end of Nov 2009 (including what I found out is called recapture time) to file.

    Now, I found out that my company have do newspaper/online ads for positions to demonstate that they tested the labor market etc etc (all stuff that I heard from the attorney), and I got the impression that she has no idea when they are going to do this and start filing again, and I got something like a best of luck look from her. I am freaked out now.

    Any of you out there know if any companies are still filing PERMs? I am on a EB-2 in Software.

    Also, if I join a new company, can I file a PERM immediately? Or is it just best of luck to me?

    Looks like I have to look into a Canada visa / Australian or UK visa or better go back and spend sometime in India. Any thoughts from any of you more enterprising folks out there? I have little knowledge of the process (my fault!) but I am stressed and freaked now.

    You probably need to find another employer. Big companies will pull back the perm when they start layoffs. I had this experience during the dotcom crash. It took my company 3 years before they started doing the GC again.
    Relax and don't get stressed.

  • Why don't we just voluntarily mention the amount that we contributed in our signatures ? Since contributions are voluntary, so should be the option of disclosing information on it. When many contributing members start furnishing their contribtion information voluntarily, it becomes the "fashion" and others will follow suit, as no one wants to look like a free-rider.

    As for the veracity of the information, we got to trust each other on that and follow an audit policy- I assume the core members/ administrators have the ability to cross-check the contribution information if someone looks suspicious. Anyone caught furnishing false information can be blacklisted. Such a policy minimises the work of the core team, without being overly intrusive.

  • Today I called. Automated phone system didn't provided me option 3 and 4 after "keep listening to updates on case" step. It's said invalid option. Second try again I think used 3,3,1 which takes me level 1 CC. Luckily level 1 guy asked few questions(last name, first name, receipt#, dob, A#, etc, etc.) and let me go to Level-2. Level-2 again asked me for same info (last name, first name, A#, etc, etc.) but told me "call after March 10th 2008". So not much success. What a wastage of time. :(

    as mostly EB 3 guys r ppl with Bachelors (and less than 5 yrs exp) or who are stuck with EB3 due to there company (like me)...

    EB 2 guys r mostly with ppl having masters degree from US...so i guess they will definetly get more preference than eb3...

    I guess US wants to raise there economy by giving GCs...so that ppl more ppl will buy houses....

    I hope something happens for EB3 also...but I guess in Oct bulletin PD for EB3 will b some month in 2001....

  • I do not want to spoil the party fun but somewhere in my mind there is a lingering doubt. I read Ron Gotcher's post about August 2008 bulletin.

    He says that Eb2 India will retrogress to 2003 or 2004.

    This is my opinion. TSC 485 processing time is July 17,2007. NSC 485 processing cut off date is July 28th, 2007. I don't know if CSC is still processing 485 EB applications but CSC EB processing cut off date on its website is April 04, 2006. The priority date for June 2007 bulletin was April 1st2004.


    Lot of big law firms filed 485's around August 1st because the date for filing 485's was extended to August 17th. So I think these 485's are still unadjudicated. Once they get adjudicated there would be retrogression. Analysts analyze. However the silver lining would be removal of concurrent processing of I-140 and I-485 which may give some additional EB 2 numbers next year.

    DISCLAIMER:

    1) Now b4 everyone jumps down my throat, i want to mention that i KNOW how hard IV core and supporting members have worked to get these articles into the media and I MORE MORE than appreciate that fact.

    2) I am not trying to play "seperatist" here (as in Indians v/s Non Indians).

    Now for the facts. I was going through the articles one by one and I compiled a list of articles matched up with a list of names. I have posted first names only.

    This list includes my name as well. If we observe carefully, almost all these articles have only Indians speaking out in the media. I know that these articles come up on the spot and the media team sometimes has only a few hours to report a candidate to the reporter. Also i know that a lot of these interviews were done by the core memebers themselves on the spot.

    All I am saying is that if more such articles are done in future, can we have the Non-Indian members also step up and contact the IV core/media team coz this would truly lend a "multi-cultural" look to IV. The lay-person american does not know what IV is comprised of. With them What u see is what u get. They see Indians in the media and on the news speaking out about the Immigration wait times and they think IV is an Indian organization.

    This is a request to both the core team and the non-indian active IV members to please step up and co-ordinate future (such) events so that multi-cultural faces can be seen in the media as well as when we go to meet the Congressmen.

    Once again, no disrespect meant to either the core/media team or to the non-indians on this forum. I hope people can see my point. (I am an Indian citizen myself). If efforts in this direction are already being taken, i apologise in advance.

    One point of mention. I read the article "Valley News, May 21 2006" & I saw people of a lot of nationalities speaking out about the Green Card process. That was really good to see.

    To all:
    I got my H1B stamping done for 8th year in Nov 2006. When I went to the officer, just before giving my application I told that I am a returning worker. He asked for the paystubs and I gave the original ones. He approved immediately.
    I took all the documents as listed in the website as well as the vfs site.
