    • I have filed for green card for my mother (all the required forms like I-130, I-485). My mom has an interview for the 29th of July. But unfortunately, due to her mom's demise and other family obligation like taking care of my dad she will not be able to come. Infact, she is not sure when she can come back. My question(s):
    1) Can I withdraw my application for her green card (I-485, particularly)? So that I can file at a later date when things are in order.
    2) If not, can I get postponement on the interview? and how far can we postpone it?

    The questions arise because if we don't show up for the green card interview it is considered abandonment of the process, and can make it difficult (or maybe impossible) to get a green card in the future. If it wasn't for the family situation she would have been happy to be here.

    If she stays put in US , Effective Oct1st, her status will be H1.
    If she goes out of the country and enters back using her H4 stamping, she will be on H4.
    If she intends to work, she will have to either apply for Change of Status from H4 to H1 or needs to go for H1 stamping and enter US using that stamp.

    Since I am filing as dependent. Should it be "b" " my spouse or parent applied for adjustment..."

    Does it hurt to choose "h"? Thanks!!

    If you are a dependent, you should probably choose (b). I chose (b) for my dependent wife, which is what my attorney recommended. Don't know about (h), but why complicate matters?

    • I am an American who has been a french man for the past 3 1/2 years. We met in college which he had a student visa to attend. Afterwards we moved together for him to get a job. At that time he still had a valid student visa and an OPT. We decided to move to France, but now after a year, I am ready to go home. We were PACSed (like a civil union) in France, but it is not valid in the states. I have read many things saying my boyfriend would need an H1B visa to work and stay. I have spent the past 2 days searching for companies that might sponsor him, which I have found none. He is a college graduate of East Tennessee State University, with a bachelor degree in business management. I have talked to people that all say to just get married but being 22 and 24 years old we want to wait and I don't want to say we got married for him to live in the states. My question is what are really his options? I would love to come back to the states ASAP but I want him there too. Are there lists of companies hiring and sponsoring H1B visas?     • First thing is you need to renew your passport.
    Old passport will be given back.
    Also if your passport is not having more than 6 months validity, US Consulate may not stamp your visa and also there could be problem with your travel. (This is my opinion)

    • yeah it does seem a bit un-alive. but i'm glad you like it man. Kirupa usually writes back and says - i've added it up when he likes a stamp. He will in time, no doubt but because of various contests that are taking place, perhaps he is very busy. In fact I am trying to think up a competition for him at the moment, but they all seem to have been done at some point in the past - t shirt etc. Perhaps the most obvious idea for a competition on a forum such as this would be a web page design? give people some guidlines and let them design a nice webpage in a sort of css style - but give them a title or ficticious company (perhaps something like - The new official site for Elvis and Graceland) - even if it is not an actual scripted site in html - only a jpg? but god knows who would give out prizes for such a contest. In the recent magazine cover competition (which i am a judge for) someone has offered considerable prizes. Maybe Kirupa could contact lisa marie and ask her ;)

    • Well I've run a test shooting one subject with my D70 on each available white balance setting and uploaded the results to the gallery (sorry for taking up space but curiosity was killing me). Turns out the gallery read my EXIF data correctly on 2 out of the 6 pics uploaded, "Incandescent" & "Cloudy". All others read cloudy, so I'm not sure if the discrepancy is with the camera or the gallery. When I read the data on my PC they all read "manual white balance" so that's no help. Anyway, the following links contain the results:

    • I sent her an email today to ask her to mail the originals and she refused.
    "We usually keep the original receipts. " was her answer.

    What to do? This is so frustrating. ARGHH!!!!
    I know I have the right to ask for them but I want to keep it civil and not antagonize her. Is there any reason I can give her, like travel, to make her send me the originals without getting into a fight?

    • Since H-1 B is an employers petition, It will be delivered to the employers place of business, unless you used an attorney in which case the attorney will have it.
    If the notice is lost in the email, you have to request a duplicate notice before you apply for visa at the consulate

    • Hey,

    I was in the same situation like you are now and I wrote a detailed letter with all paper work, 2 color photographs and also the FP notice and explained the situation. I was lucky to see a LUD the day they received the paper work and in 2 days mine was approved and its on its way now.

    Hope this helps. I understand this might not be the case for all but it worked for me.

    I need your advice / opinion on the below scenario...

    I and my wife are both employed at the same company, currently on H1.
    I am the primary for our GC processing; my wife is dependent on me with regards to GC.
    We both got our EAD and AP. 140 approved in May 2007, 485 Filed in Aug 2007.

    I have submitted I-9 to the company in order to be on EAD status.

    I am planning to have my Wife resign from the current employer and work for a diff company/vendor by using EAD.

    Questions: 1.Does the above scenario bring up any issues with regards to our work status or any other issues with the current employer or to the GC process?

    2. Can I work on a part time project?

    Please advice

    Can anyone share the experience of H1 Visa stamping in Hyderabad. As per their web site they need quite a lot of documentation. Not sure if such doecumentation is required for visa revalidation (same category - H1) as well.

    • tom friedman doesn't know about the details of this issue..... for him immigration means more h1b visa..... he doesn't have a clue @ gc mess...... there r others who have done research on this subject.... but those studies did not get as much attention.... maybe others need to come up with a shape... lets pick one.... lets say "earth is rhombus".... and then publish these reports... that might help catch some attention....

    Thing is inspite of these recommendations they reverted the July bulletin with no notice period to public. Not sure why they recommend and have the office Of Ombudsman if USCIS does not implement their recommendation?




    I don't know anyone in Chicago. But I think it does not matter. You can hire an attorney from other city/state as long as he/she is competent. We live close to chicago, but our immigration attorney is in Michigan.

    We had a great experience with this attorney. She is thorough, clear, always accessible and prompt. And she does not charge a fortune either like others. She does not even charge extra for phone calls, emails, etc.

    The office is Law Offices of Ingrid Brey P.C. in Grosse Point Park, MI. Just google it and call the office. Have them email their services/charges, etc.
