Why should the employer hold your salary? If you had any agreement for paying back cost of your GC processing for leaving within a certain period, that would not hold any more (since last June such agreements are illegal)
No employer will write a direct agreement, you will have to payback the GC cost - instead they execute an agreement, employee should payback all the benefits (legal fees, service fee, tuition fee and etc)extended to him, if s/he leaves before X number of months/years - which is legal. If you were subject to the cap for the last H-1B, you will not be subject again. The new employer would need to file a change of status for you, changing you from B-2 back to H-1B.
as long as its a recognized insitution by the Education department and by USCIS standards I dont see why not

I have returned from India on AP three days ago. Immigration officer just asked questions on my employment, but he did not ask for proof. If you have multiple APs you should submit all of them for stamping. Thats it!
I got AP..and H1B till 09..I am hoping to reenter using AP while comming back from india..Apart from AP do I require anything else. like employement letter to reenter the contry??..

This was in 2006.
H1b applied on Feb-2-2006 with old passport expiry date Oct-14-2006
H1b approved on May-9 dates May-9-2006 to Jan-31-2009
I applied for passport renewal sometime in March-2006
New passport sent by Washington DC with date Apr-25-2006 to Apr-24-2016.
So i had no issues getting h1b approval with passport expiring in few months.
i don't know if your attorney is right/wrong, but sharing my personal experience here.

NEW DELHI - With the demand for US visas surging by the day, the US embassy and its consulates in India have introduced a new online non-immigrant visa (NIV) application form to cut out needless delays.
The DS-160 form will be online on the website of the US embassy from Jan 19. For all NIV visa appointments starting Feb 1, applicants will need to fill out the DS-160 form, the US embassy said here Wednesday while announcing the introduction of the new form.
The new form, that leverages new technologies, is expected to cut processing delays as applications could be pre-processed and pre-screened before an applicants interview.
Applicants will continue to complete visa application forms online, as they did previously with the Electronic Visa Application Form, the embassy said.
The demand for American visas has been escalating in India over the years.
The four US consulates in the country had processed 725,000 visas in 2007 - a 58 percent increase from 2006.
India is among the top 10 countries sending visitors to the US.

Just a side note,you should send EAD/AP renewal applications only 120 days in advance not 180 days..according to the new rule set by USCIS.
