My F1 visa was rejected for no good reason long back, before i even came on H1B. So its kind of scary every time I have to go for visa stamping. Its very random. Guess its just the fear inside me.
So I guess its all about the risk, if or not I want to get my H1B visa stamped or just wait for the freaking AP.
I was in the same boat as you and came here subsequently on H1. I do not think your F1 reject has any bearing on your H1 stamping both are different. If your stay in the US has been lawful, no gaps, out of status etc then you should be good be in good shape. You know the drill on the documents to carry etc if needed to get the stamping out of country.

I belive your second point is not entirely accurate. My understanding is with the hard quota, any EB-1 and EB-2 unused visas from ROW will flow down to EB-3 ROW which is also severely retrogressed. Only when EB-3 ROW becomes current will the unused visas go to unskilled workers. Therefore, the hard quota will benefit ROW mainly at the expense of India/China EB-1 and 2.

What the hard cap does is that say for example in the EB2 category the Indians and Chinese use up their quota. On the other hand the rest of the world uses only 50% of their quota (about 10K EB2 visas leftover, just a guesstimate).
1) With the soft quota, this leftover is given to the over subscribed countries in the SAME CATEGORY (Eb2). As a result, other EB2 candidates from India/China benefit
2) With the hard quota, this 10K now goes to UNSKILLED immigrants.
This amendment DOES NOT TAKE AWAY anything from the rest of the world at all! All it does is benefit SKILLED workers. Isn't IV about skilled workers? Please read the text of the article. It is clearly skewed. The way the whole matter is painted is that the bill would give "illegals an easy to citizenship", which is not an easy sell come election times. This is not reporting of a news item, rather a clear indication of where the paper stands on this issue. Everybody knows what to expect from W.times -a mouthpiece of ultra conservative, right wing Republicans who stalled CIR last summer. The language of this is no way different from that of last year when CIR was being staged up and during the rallies in DC.

The IV is about issues/problems of employment based immigrants, and the goal is to get support as much as possible from every corner in this country to further the cause. Everyone who supports this cause fit in to some category (within legal limits - pro, anti, this group, that lobby, this ethincity, that nationality, etc.), and that does not mean we are promoting something or have preferences for a group. In my opinion any support (with in the legal framework) to the cause of IV from any corner in this country is welcome and should be appreciated.

The IV is about issues/problems of employment based immigrants, and the goal is to get support as much as possible from every corner in this country to further the cause. Everyone who supports this cause fit in to some category (within legal limits - pro, anti, this group, that lobby, this ethincity, that nationality, etc.), and that does not mean we are promoting something or have preferences for a group. In my opinion any support (with in the legal framework) to the cause of IV from any corner in this country is welcome and should be appreciated.

Another important question is once this law (5882)is enacted, how long USCIS will take to implement it ?

Congratulations! :) I really hope that USCIS starts this proactive approach towards adjudicating applications, that way if and when our PD becomes current, the card production would be the only remaining step in this journey.

Thanks. I finally got the receipt notice yesterday. They gave me a receipt date of May 11th and a Notice Date of June 11

I met an Indian who got his green card in year2003. Still he attended to give moral support to IV. Hats off to all those guys who made it to the rally even after getting there GC's. Friends I think a great injustice is being done to NSC filers , their applications are taking months for ead and ap, while TSC filers are getting ead adn AP as soon as they get receipt, do you think this will improve for NSC in future, at this time looks like august NSC filers will haveto wait till the end of the year for EAD,ap, which is sad.
