Medical exam is considered part of "intial evidence" for the I485. If your friend files without the medical report, his application will be rejected without an RFE.
Hmmm...we realized that after reading immigration-law.com. Earlier USCIS was lenient and they used to issue RFE but it seems that since so many application will be filed in coming months, they are going to be strict and will deny the application without issuing RFE.

You can file as many I-140's in any category (EB2/EB3/NIW) as long as you have a certified labor for a bona fide position with a matching education and company has ability to pay for those positions. These I-140's can come from one company or different ones it doesn't matter.
In your current situation:
1. Don't even think about doing anything with pending I-140 and AOS. There is a definite delay in I-140 approvals at both NSC/TSC so waiting is the best thing to do. As long as your qualification matches the LC description you will get your I-140 approved. If your I-140 is pending 30 days past the processing time and you haven't received an RFE, it might have been stuck in security check. Your lawyer needs to open a service request to find out what is going on.
2. For the labor that is expiring in Jan, go ahead and file an I-140 petition right now, there is nothing to worry about two I-140. If nothing else this petition can be used for 3 year H1B extension in case the first one gets stuck.
3. The second I-140 that you are filing can't be used for your pending AOS if your priority date is not current. Check the Pearson Interfiling memo ( from link below). If your priority dates are current and will remain current (EB2 ROW) file for an new AOS application when your second I-140 gets approved. If by this time your first I-140 is approved you can simply toss the second I-140 in the office shredder.

Your dependents are "in status" as their I485 pending. donot worry about it. You will receive your card within 3-4 days.
Right now my parents in India are trying to seek help from local authority so as to say the ADM office - to get the certificate. I dont know how much this will work.........I will keep everyone posted.

myself , chandu , siddhi, poonam and tikka had lunch with him at the Union Station and he did tell us his experiences .
Ppl on their own have to realize the importance of a movement like this .No amount of convincing by friends/relatives would make any difference.

I mailed my I485 to NSC on June 29 , 2007. Reached to NSC 07/02/07.
NSC sent to CSC. CSC approved my EAD .Again CSC transfered my I 485 to NSC on 08/26/06.
Fingerprints were taken on 01/12/08.
After that no LUD.
What woul be caluclated as my RD?
Can I expect Interview ? OrI am going to get GC soon?
Please clarify my doubt.

I too know of a friend on H1 who lost her father and could not go due to lack of Visa stamping. It just churned our gut seeing her suffering at the time, yet we were all totally helpless to do ANYTHING. :mad:

Okay I liked code, contagious, and serif. Serif has my favorite palette of colors. Love the detail in the contagious one. Background is a little bland though. I voted for code though. Has the same colors I like.

Basically to retain the PD you should have the copy of the I-140 approved and you could retain the PD. Having said that, different lawyers have different interpretations when you switch jobs and retain the PD. Basicallly some lawyers say you could retain the PD even if your old employer uses it for another person after revoking yours, while others say you can't retain PD if your old employer revokes your I-140. However if your old employer willn't revoke your I-140 then you could definetely port your PD with your new employer. If you employer is hesitant to give, you could try asking him other ways if possible for H1B stamping etc.

Best wishes to all of you who are seeking advice or are in a visa process of any sort.
My question here if any one could kindly help me: I came to work in 2002 with a J1 visa, stayed for the 3 stipulated years under the J1 visa. I wanted to changed my visa for a H1B so I got a waiver, and then I went through the process the year that they had the lottery for H1B, I made the lottery, but sadly after paying all my fees, sending all the documents that my lawyer asked my employer for that time, I did not obtain an H1B.
I do not understand this. The waiver H1 is specofically exempt from the H1B quota, why did you need the lottery? If you made the lottery though, why did you not get the H1B?
Last year I could come back with another J1, I stayed in my country for 3 years, so my new employer applied for a J1 without using my waiver, as there was not need for it.
Why did you not get an H1B this time?? Why come back on a J1 after all that history?
Now my question, I do want to change my status from my present J1 to an H1B, and I would like to know if I can use the previous waiver that I obtain with my first J1 in order to waive the 2 year residency restriction on my present J1 so that I could apply for the H1B with a new employer?
You cannot. The J1 is a "scarlet letter". Each time you take one, you need a waiver for it. You will have to get one again. By the way, did you have a physician J1? My answer about the H1B being exempt was based on that presumption.
Any advice is greatly appreciated.
