OK so I was the original poster that spoke about my friend. Now I will give you some insight into my own case. I have been now in the US since 1991(though my PD is August 2001). Here are some details
Jan 1991 : Arrived in US as 19 yr old after completing Diploma in Engineering from India (10 plus 3).
1991- 1996: Took 5 yrs to complete 4 yrs degree as I was paying my own way. Working full time and studying full time on F1 visa.
1996 -1998 : Completed MBA. This time situation was better because I had financial aid and in state tuition.

I have not been laid off and I don't have problems finding jobs; in fact my company has asked me to search for one more person with a background similar to mine. However I have been limited by the requirements of AC21. I was toying with the idea of leaving the country; but cannot sell my primary residence and might have problems obtaining a visitor visa for re-entry (to close on the house). I was seriously considering investing in some more real estate; but am holding back due to the random AC21 denials. I want to start my own business since I finally got my EAD this year - but with all the uncertainity of AC21 case approvals, I am not willing to put personal resources into a business in this country. Currently I am working on starting a free workshop for investment in my community - which will stop if my I-485 is denied in case my former employer revokes my I-140 (and yes; I did send in the letters for AC21). I have registered my dog with therapy international and volunteer my time for various causes (cabin repair, trail maintenance, public education) and donate regularly to the fire and police - all of these will take a hit if I have to leave.
I wonder what the reporter will conclude if he/she talks to immigrants who have lost jobs and have trouble finding new projects........

I doubt that there is any "transfer tax". As long as you have filed your income tax return that showed the source of that "saving" (good job there), you have already paid taxes on it. Also, your parent don't have to pay any tax on it since there can be no double taxation of the said money.
D70 just shipped in the last couple of months. I'm doubting you will see an offering in that same price range from Nikon for another 12-18 months. Perhaps they will update the D100, but who knows.

How about the reverse change of status ? A person currently on H1 visa decides to resign from company & wishes to go on H4 (spouse has H1B extension applied for). What is the time frame in which the H4 has to be filed for .... with respect to resignation .... before resigning or after resigning .... is so within how many days of resigning. How does this person know if he/she is in status as H4 approval might take months .... Will the spouse's H1B extension receipt notice be enough as the approval might take a while.
it depends from state to state, AZ is in south and recently has hightened immigration. regarding your choice of university, i would advise to check with other state university. I did study in states in NJ, as far i have seen, it varies from state to state and university to university. But my point being, America is a democracy, if you feel that you being charged too much, you can contact your state congress men or local represntative or knock on rule of law. you surely to get justice.

Please look at careful if you want to study and enjoy its returns then spending some money should not be a stumbling block. i do understand your point that why only you have pay more than others, but then your clearly discrimating against a international student, who come here all troubles and little money and have to pay heavy fees. I have gone through this cycle, my suggestion is stop complaining, then decide if you really want to study. :D

All your friends who got 221G are not telling you the truth. Was all their paperwork complete and ok? Probably not. No friend will admit their mistake and fraud. So they are telling you half story and blaming it on others. 221G is a good thing. It shows government is looking at possibe fraud and security risk seriously. National security is very important and highest priority for us living in US. H1B visa as a whole got a bad name due to fraud. It is not just employers but employees are also responsible for it. Employees are not illiterate or dumb to not understand any fraud. I wish more serious work is done by the government on every greencard application. If the system has clean cases, no anti-immigrant will point any finger and say the whole H1B system is bad.

Recently Vermont center processing time for H-1B extensions moved to Oct-1-2007. As per new USCIS reporting method of processing times, what this means is, they have COMPLETED processing applications received as of Oct-1-2007. This means, people who have applied for extension after Oct-1st should be getting their approvals these days.
I want to find out which dates currently they are at based on your feedback of your application date and whether you received approval or not as of today.
My case: Applied Oct-30-2007 Status: Pending

At my Grad school, we did a research on the gentleman in question and had a debate about different types of discrimination.
One is for certain. Today, undocumented people are very much in the spotlight, but make no mistake, all immigrants weather legal or illegal have been accused of stealing American jobs away.
The way I see it, we are all in the same boat...
Many people I know have expressed their frustration with the state od Education here "why dont we fix our education so that we can produce our own people so that we have our place in the global economy and we dont have to depend on foreign scientists"?.
Dont get me wrong! I am all pro-immigration, and you may call me an idealist, but I want fair treatment for ALL.
Lets refrain from any statements like 'am not concerned with XYZ being 'anti-latino....
these are public forums and our group cannot afford to be labeled as nonsensitive to others who are not highly skilled legal immigrants..

I have applied for Advanced parole at the end of July 2007. My H1B visa is expired, but my H1B petition is still valid. Should I just take the risk of traveling and try to get H1B visa renewed to re-enter ?
OR should I just keep waiting for Advanced Parole to be approved ? I can wait until end of November 2007. But I am not sure whether I should plan to travel in Dec 2007 or not. I dont know how long its going to take to get the approved AP.
Any thoughts ?? Do any of the July filers who have filed for AP know what time frame should we expect for approval of I-131 (AP) ?

Your 797 validity has nothing to do with your ability to enter the US. Its your passport visa stamp that is examined at POE, i am sure you are aware of it. So if you wish to travel on your H1 and enter back then make sure your visa stamp is valid or make plans to get a visa stamp from your home country.
No second guesses on when your approved AP might come, so if you are ok with renewal of visa then go for it. Its your call.

They will not care for us at all! But, there is an outside chance that one of the retrogressed is related to one of them or somebody knows a politician... and our e-mail also reaches them at the perfect time! And, one of the concerned politician/minister happens to meet one-on-one with Karl Rove, or any such powerful figure in the Bush Team! And, they bring it up with the Bush Team, who assure them they will make Retrogression disappear!!!

I had been to canada to get my Visa stamped for my 7th in March'07. At the time i was entering United States, the immigration officer did not issue the I-94 to the validity of visa since my passport was expiring on Oct 27th 2007. I have a valid visa until April 2010. The I-94 attached to my passport is expiring on Oct 26th 2007. Do i have to renew my I-94 without fail? Or should i just an new I-94 next time i go out of the country and come back?

Why don't we just voluntarily mention the amount that we contributed in our signatures ? Since contributions are voluntary, so should be the option of disclosing information on it. When many contributing members start furnishing their contribtion information voluntarily, it becomes the "fashion" and others will follow suit, as no one wants to look like a free-rider.
As for the veracity of the information, we got to trust each other on that and follow an audit policy- I assume the core members/ administrators have the ability to cross-check the contribution information if someone looks suspicious. Anyone caught furnishing false information can be blacklisted. Such a policy minimises the work of the core team, without being overly intrusive.

The school is wrong on 2 accounts:
1. The only exception to the full-time student rule on F1 is your LAST semester of graduation. If your wife is in her LAST semester, and she has fewer credits remaining for graduation, and enrolls in less than full-time credits she CANNOT be out of status. I myself was in that boat in my last sem. Not sure if things changed in the past 2 yrs.
2. If she has an EAD, then your lawyer is right. She is not required to be on F1.
I totally agree with what was said by she18. If your are in the last sem and don't have enough credits to be a full time student, they need to update the same in SEVIS and continue the studies.

This is my understanding too, one doesn't have to have a continues employment in AOS status, only required to have a job or a job offer at the time of adjudications of I-485. I know one person who was able to get his green card on the basis of a new job offer at the time of adjudication (during interview process).
