yes, but july 2007 VB and the subsequent USCIS change related to approving cases with pending namechecks added a significant number awaiting for approval. Then a couple of months back USCIS woke up from slumber or had a shot of 100 proof single malt, re read some law and decided that the overflow allocation should be changed. The result is that there will be next to nothing for EB3 (for that matter EB2 will also have less overflow available) as they clear the backlogs, i doubt anything besides a recapture in the short term and a significant rehaul in the long term will work...i hope i am wrong but EB3 I and C are in for a long wait.

For last 10 years EB3 took numbers equally from EB2 and EB1. Even when EB2 was retrogressed EB2 numbers where made available to EB3.

It is not popular to say so but I have this doubt too.
Currently at least there is no requirement to notify and you only need to prove you still have a similar job OFFER (not necessarily working) if and when there is an RFE.
Only good thing happened to us in last decade, as far as I can remember, is AC21 and concurrent filing.
All these immigration laws are designed to keep us indebted/bonded to the employer. They might see this as a liberating provision and try to chain us back. This may or may not happen, but just my paranoid reaction,.
Hope AC21 don't go away like labor substitution has. :(

Good discussion. I am not a fox fan, but i read NYT and Drudgereport, listen to Rachel Maddaw as well as Handel. In fact i read any political and economics related blog i can lay my hands on. I understand your points.
My point is that people say he will do so many things, the problem is that the congress is not changing. The congress has to approve something so that he can sign it. Secondly no matter what you say companies will do whatever is right for the bottomline and share price. if he starts taxing companies they relocate, he has proposed increasing the social security taxes across all categories. Says he will not increase taxes for middle class americans but gives little indication of how he will finance the trillion dollar spending program. If his universal health program passes then you will see more deducted out of your paycheck. How will he create tons of jobs, how will he subsidize education. The fact of the matter is that he will be under exterme pressure if he is elected to office with such high expectations. He will be screwed if he increases taxes and screwed if he doesnt fund the programs he is promising all over the place.
As for long term, the country has to increase interest rates to support the current account deficit. IF you increase interest rates the economy will further go in the tank. The country has to increase taxes to fund SS or Medicare. If not they need to overhaul the SS and MC system and any pandering politican will never be able to make that change.

Can USCIS stop accepting applications mid month without any notice. From the posts above, it would seem so. Everywhere else, I hear USCIS will accept applications till July 31 (with respect to July bulletin).

Hi All,
I received the CPO email yesterday.My case details are PD : Dec 2004, 485 RD : Aug 6th 2007(I140 Filed concurrently),EB2 India.140 was approved on Tuesday.
I140 was pending from 2007.When my attorney followed up in feb this year,USCIS gave the standard reply of waiting for 6months.After that they said,they will update in 10 days.They didn't update even after that and then i moved it to premium processing on Sept 28th.
Took 2 info passes in Septembter(regd i140 mainly).First one was not of much help though the officer told my 485 is assigned to IO on Sept 8th.Second time it was different officer and she was very helpful.Tried looking why my 140 is getting delayed but she said ,if she opens my file then 485 file will go back to review queue as it is currently being reviewed by Sept 18th.So she didn't recommend doing that.I didn't open any SR after my first experience of 6 months waiting(without an result!!!)
Before 485 approval day(i.e Tuesday) i called IO TSC Center but he doesn't know anything when i mentioned that my PD is Dec 2004 & that my case is current from last month.,he told my PD is the RD of 485.I thought no point in arguing with him and hung up.After that i was preparing to send mails to Senator but got the approval before that.

Today got the magic e-mail Card/ Document Production . Looks like the SR submitted 3 days back worked in my case. Prior to my SR the IO said that they don't have FP cleared, I called FBI and confirmed that they sent back my FP's and in my SR I request the IO to input the details that I got from FBI, Looks like that did the trick.

I don't think so EB2 will make any difference.Its the matter of when they lay their hands on your packet and open it.
Also I have a friend 2nd July Filer filed from NSC and got transferred to TSC , he received his receipts last week and good thing was after two days he had EAD cards sitting in his mailbox too.
The TSC maybe slow in opening the packages but they are fast in sending FPs and EADs.
So hang in there and hopefully you get everything soon.

My H1-B was extended in October 2007 for three more years. My wife went to India and is going through this PIMS BS now. Chennai Consulte applied on Feb 6th. Some cases listed on this forum are scary as hell. Called the VFS office, all they say is they have not received the pp. After four days got the number for the consulate from VFS. Calling them daily. Same story, with each passing day, I could sense the increasing irritation in the voice of the consulate personnel to my questions. I wish I could talk to them in person and vent out my anger. This afternoon I called the DOS. The number is 202-663-1225 incase anyone needs it. I explained my case and asked her if they are missing any information. The reply: No your VISA looks fine. Then the robotic answer, PIMS verification is under process.
I think VFS should specify it on their website and warn people about these delays. Warn people about the PIMS BS and suggest that they should not make any travel plans till they are sure this PIMS BS is resolved.

i know there are plenty of temples in the dc metro area so someone please let them know abt it. same holds for other big metros. some of them have web sites too so email them if you cant make it there -

Since the letters are only requesting fixing of the interpretation of the law, and not the law itself, there really is no fixed deadlines involved. Of course, sooner it is done, the better our chances are for moving forward.
