    Filed for EAD for my husband along with the I 485's and have had all receipts, also had fingerprints done already, exactly one month after the receipt date. Sent both entire packets of forms with checks to Nebraska. We did not file advanced parole since I still have a valid H1B and plan to stay in my current job until I get my card. Husband will work on EAD and will not travel until gets his card, no family left in England.

    I am really sick and tired of my attorney. He is making money out of immigrants but he does not like immigrants based on our dicussion.
    I think we are very well educated and can easily take care of 485 filing.
    My attorney will charge me at least $3000 for it although I got his referral from AILA. On top of that he delays filing my PERM and 140 and having serious attitude problem.
    I can easily take care of 485 filing by myself.
    My only and great concern is- Is my attorney can screw up my GC processing if I fire him and file 485 on my own?

    I doubt that the lawyer would purposely hurt a former client. Its not just unethical, its really malpractice. And its not like lawyers done get fired and they cant handle getting fired.

    However, please do make sure that you have all documents that you need to do your own 485 filing. If there are some documents like 140 approval or other stuff that only he has, then you will have to get it out of him, which he just might delay (a little) in case if he is an absolute nut job.

    For me, I dont care what the lawyer thinks of immigrants as long as the job is done in a TIMELY manner without mistakes. If he hates immigrants and votes for Jeff Sessions, I dont care about it. All I want is TIMELINESS and ERROR FREE job. After that, he can hate anyone he wants and stick pins in voodoo dolls of immigrants.

    Yes, it is that simple. If you just walk away from your home, bank can only touch your home and credit history. They can not go after your automobile\gold\savings\other property....anything. You are not missing anything. That is why we are seeing so many people around us just walking away from their homes. Thank God I rent but if my property's value go down 200 k in 2 years, heck I would walk away with a smile on my face. No strings attached.

    Walking away would have been difficuly had you put 20% down, i.e. involving your hard earned money in the deal. In that case you would have waited to see the market and hoped that it would revive. If put 0% down and bank has given you 100% loan, then it is the bank who has taken all the risk. You have practially no risk in that deal. Just like cloth....return it to the bank. Hey....you don't have to even clean it up...like you do in the case of apartment move. ;-)

    0% down, ARM, interest only.....when all these goodies were floating around, it was hard to resist.


    Correct me if I am wrong. If a person has a good paying job and if he decides to foreclose, isn't he responsible for the loss incurred by the bank. It is a different case if you have no income, but just because you lost money because of a wrong decision, how could you walk away free with just a dent in your credit history. Maybe I am missing something here.

    BTW, I am not judging OP in any way, just curious with how foreclosures work as they make headlines everyday now.

  • What Pappu says is right. Ppl have been so impatient that they're bombarding USCIS with SRs, emails, letters from attorneys, Infopass etc..etc...etc...I understand the anxiety but isnt this a bit 2 much? I was no exception to this. I raised an SR on the very first day my date got current and on trying to followup on the SR the very next week, I stumbled upon a clearly tired second level IO who didn't like the way I was pushing for it. He clearly explained to me that there was no need to worry as the dates were current and everyone who was current and cleared of security would be approved as there were several visa numbers available and he also told me that there have been thousands of calls received everyday and its becoming really hard for them to handle the situation. I could see how tired and frustrated he was. I immediately understood their plight and just waited without any further action and within a span of 15 days after that call, I got my approval. My attorney also advised me to wait as he was sure the dates were gonna be current the next month as well and followups would only result in delays.

    Well I'm not saying its wrong to be anxious. Ofcourse, its an important milestone, one that secures our future in this country and yes, its only natural to be anxious. But being anxious doesn't mean that by calling or emailing or Ombudsman etc...ur case will be approved. Try and put yourselves in the IO's shoes as well. For a moment think what it wud be like to be an USCIS first lvl/second lvl IO receiving the same call every minute from a diff person and each one trying to reach the second lvl IO with lies such as my A# on file is diff than the one on 140 OR address change etc...etc...This is ridiculous. After years of wait we resort to such shameful behavior towards the end.

    Yes when others with later PDs are getting approved and u r still waiting, it does bring out frustration in u. But u should also put in thought as to why that could be. Maybe one of the security checks in ur case is awaited or maybe ur file is on some table waiting to be picked up etc...I was venting out my anger and frustration during my wait on this forum and ppl were only asking me to do that, do this blah blah blah. I just waited nevertheless as I knew the moment I spoke with the IO that there was really no point in following up as cases were getting approved and USCIS was definitely WORKING as hard as they could (even on weekends) to clear all current cases.

    There was one dumb idiot who called and spoke to the second level IO (per his own words "just to confirm") even after getting the CPO email. I mean how foolish and idiotic is that.     Guys, just trust USCIS now that they've been approving left and right before u login to ur email to followup or pick up ur phone to check ur status. EB2 has not moved ahead for the Oct bulletin but ppl who were current from July will still be current in Oct. What does that mean??? It simply means that USCIS is hell bent on clearing all the cases which have been current since July and my best guess is until the last of the "current" cases has been approved, the dates will be not be retrogressed.

  • I totally agree with you. H1b and employment based GC's are so intertwined that they are almost inseparable. For example, you can get H1b extension based on your pending/approved PERM labor or your approved I-140 application. So, any change to H1b will in some way impact the GC process. I'm all for closing the loop holes in H1b provided certain reforms are also made in the EB green card process- like removing per country quotas and may be give EAD upon I-140 approval.

    But do you believe they will do any good for us or they are really interest to protect us. Their aim is to divide and rule.

  • I don't think it will do much good sueing uscis on this issue. The point is, they have the legal authority to be the one interporating the law. So, if there is "gray area" in the law, the law says it is their understanding that matters, not ours or any one else's. So, unless the law very specifically says it must be done in another way, you can not argue uscis did the wrong thing.
    Now that we see the immigration law does not very specifically regulate how the flow should be like, so uscis have the authority to "understand the intention of the law" and act accordingly. You can't say you think the law means otherwise and thus sue uscis, because that argument makes no sense to the court. The court will only accept the argument when the government is apparently acting against the law.

    We can definitely question them on how their understanding changed on visa spill over distribution.

    I dont know about the Govt and bureaucrats and political aides - maybe they have big attention spans - but i know for a fact if someone in a corporate structure receives such a long letter as proposed originally- most would not have the patience to read it. Maybe, the handwritten and personalized part should be:

    1. I am XYZ - educated at ABC and work in DEF sector. Been in US legally for XX years - no able to buy a house, progress in career, start my company etc for not having visa certainity.
    2. While we wait anxiously for comprehensive reform - the following administrative fixes can speed up the processing backlog, specially for some countries like India, China etc

    Highly skilled immigrants have been a key stakeholder in keeping America competitive and your leadership in providing relief to this segment through these fixes would ensure that the best and brightest from around the world continue to be attracted to America.

    What benefits are they talking about here?? As far as I am concerned, H1B visa holders have to no benefits... we pay SS taxes, federal taxes, Medicaid, state etc. As soon as we loose our jobs we are told we have a couple of days to leave the country - even when we have been here for years. What an inhumane way to treat a tax payer.

  • Why do we need 325A?- i thought this was for people in illegal status. Our son entered the US on valid H4 visa. Also do we need to request in application to attach the file to mother or anything like that. I will give the USCIS a call and share that information here if I find anything more.

    I was unable to file for my son since he aged out over a year ago because of long delay in labor cert. However, I filed for my spouse and we both submitted G325A in accordance with instructions from my international services division at work.
