How many times in this thread I have mentioned that I am getting replaced by one of these L-1B resource, I am a poor Oracle/DB developer who fortunately cannot be replaced by L-1B visa resources (as my skills is a common technical one). So once these violations impact your day to day life you look around for ways to stop this fraud. Its true that if I was a Nuero Surgeon in Phily or a Astro Scientist in Houston I wouldn't be interested in this violation :-) .... tomorrow let this scenario happen to you ... you would be first one to raise the alert.
Regarding 'getting burnt', I don't think there is bigger burn than loosing our jobs (which already is happening) and hope you know that there is something called 'anonymity'... ya lets see whos going to get 'burnt' here. We'll definetly keep you updated regarding the outcome.

Yet you don't seem to have an issue that you have applied in EB2 - exceptional ability / advanced degree. At this time, you are likely holding a H1B status - a speciality occupation visa. Something does not add up now, does it?.
However, I'm with you on wanting to stop L1 visa abuse (and H1 visa abuse as well). There needs to be a more definitive way of knowing L1 visa is being misused to replace US citizens and green-card workers.

WASHINGTON (Reuters) - Disgruntled green card applicants from India sent hundreds of flowers to the U.S. immigration agency on Tuesday to protest a recent policy flip-flop that hurt their quest for permanent residency.

The campaign that directed around a thousand flower deliveries to U.S. Citizenship and Immigration Services (USCIS) Director Emilio Gonzalez was modeled on a popular Indian film promoting the peaceful protest methods of Mahatma Gandhi.
The protest was inspired by the abrupt reversal last week of an announcement issued in June offering expedited processing of green card petitions for thousands of skilled foreign professionals working under H1-B visas.
Thousands of holders of H1-B visas -- reserved for skilled workers in computing, engineering and other special professions -- scrambled and spent money on lawyers and medical exams to prepare green card applications for a July 1 deadline.
The abrupt closure of this path to a green card -- proof of lawful permanent resident status -- sent the applicants back to the queue for 2008, when they will have to spend more time and money, organizers of the protest said.
"The gist of the campaign was to peacefully convey disappointment and concern at how things have evolved in the last month," said Sivakanth Mundru, a Virginia-based computer systems analyst who was affected by the policy.

Gonzales said in a statement on the USCIS Web site that the agency would forward the flowers to Walter Reed Army Medical Center and Bethesda Naval Hospital in Washington, D.C., the main facilities treating U.S. soldiers wounded in Iraq and Afghanistan.
"We welcome the fact that the director at least acknowledged this campaign and we are happy that our flowers will be bringing some color to our soldiers in those two medical hospitals," said Vikas Bajaj, a software developer in Wisconsin who helped organize the flower protest.
Although Indians staged the flower protest, the green card application setback affected skilled workers from China, Poland and many other countries.

If DOL scrutinizes such petitioners more than others, then its good. That will weed out pretenders; but also on the other hand, that will put genuine candidates petiotions into a pre-adjudicated state.

congrats and thanks to those grassroot IV members who came up with this campaign. To be honest, I did not think that this would as successful as it turned out.
Even though I was not affected by the July bulletin fiasco (my labor is stuck in BEC for the past 5 years), I was pissed when the USCIS pulled the rug from underneath.
But, what a way to protest! Hats off to all those who participated!!! and a big salute to the The Mahatma:)

Good question. The bill is expected to be on the floor of the Senate and House for debate in Feb-06. Learning from S1932, it is my guess that the soonest bill could be law is 2-3 months. So we may be looking at something like April/May-06. But nothing is for sure at this time. It is possible that the debate may be dragged on till third quarter of 2006. We should start the activity to communicate with the law makers right now and continue to convey the right message if we want anything good to come out of the new bill.
The delay with S-1932 was due to other controvertial issues. As for the immigration provisions, i doubt if any law maker insisted on them being part of the bill. Most of the bickering was about oil drilling and patriot act. This time Patriot act will compete for senate time if it is not resolved by feb. Once the immigration bill is introduced, it should not take more than 2 weeks get it to vote and another week for conference committee.
My Q was even if some law is passed will the uscis wait till oct to implement any proposed changes.
I was curious as to how this works because it might be tough for me to stick with my current company for 1 1/2 years more to get portability.
Ofcourse we will try our best but somethings r not in our hands.

My appointment was on the 12-Dec. Visa was approved immediatly - was told I'll get it in 7 days - but haven't received the passport yet 56 days to date. I receive the same response when I call.. that its under PIMS verification. No ETA of when I can expect it to be done..

I got the CPO on Sep 7, 2010. But we did not get any email about dependent application. Yesterday, I just called the customer service and spoke with level 2 officer to confirm about our cases. According to him my application is still pending with the officer and no decision has been made. I am really concerned that still no approvals. Moreover, I can not even open a SR because my status shows CPO. Btw I had my FP done on Sep 3, 2010.

This is a real problem. I got a letter from a prospective employer, who wanted proof that I was legally eligible to work in the US (alongwith transcripts, previous employment letters etc.) prior to scheduling an interview.:cool:
I believe employers are seeing a lot of candidates on EAD, and for whatever reasons they dont think EAD is good enough and would like to weed those candidates out beforehand.
