I just wanted to get this discussion back on track of ppl wanting to be able rise up a little, let their wives work and feel the freedom to make a decision to go back.
Let me restart the discussion. I know we are all frustrated to the extent that we want to pack up and leave but we have invested too much time to do that. But let's assume things start moving and we get our GC's in a year or so. Having spent so many years waiting to "settle" would you be willing to unsettle your life again and start over in a country that you left more than a decade ago.
Note that I am not doubting anyone's intention or disrespecting any entry. Just wondering if its the frustation talking or there are ppl who would actually leave?

I think, there is a strong message in this case, something I have personally faced in the past and do still face at at a smaller level. Though it is not an attempt to help raise money for her. Sorry to hear about such cases. We all have to realize one thing here. The employers need us equally bad as we need them (more often than not, not talking about Indian consultancies here). If ever one encounters such racial discrimination and open abuse at the work place, the best recourse is to file a complaint with the higher ups in the HR, start searching for another employer and ditch the current racist employer at the right moment with an appropriate email sent to everyone detailing why the person is leaving at such an important phase of the product development. Yeah, this might sound un-ethical, but sometimes situations do demand such drastic measures to send the right message. That's when all these racist employers would realize the importance of the person that just left the company. Then they can try to fill in the position with their preferred race qualified person and see how difficult that gets!!
Better still, please talk to your friends and family in other parts of the US and find the areas in the US that are cosmopolitan and try to move to those places. Yeah that is very difficult in the short-term, but in the long-run, you would have peace of mind and a good quality of life after making such a move. Fortunately, i am in the Bay area and i have rarely encountered such racial prejudices out here. Just my two cents.

I invested so much for this company, like working beyond work hours, working in the weekends, making up the project deadlines for the incompetitive colleagues etc. etc. and now just waiting for my Green Card. There were so many times I thought if I get my Green Card I am going to leave this moment. Years passing by and with this retrogression thing, there is very little hope of getting it soon...
The positive thing is, my direct supervisor is very nice and I can voice my opinion and she understands me and completely supports me. I am just praying god that I should keep working for her till I get the GC.

Here is what i think ........USCIS works and approves according to RD till 140/485 approval. After this they hand over the case to DOS for visa issuance who work according to PD when allocating visa numbers. Correct me if i am wrong.
This process is a mockery of the PD cutoff dates, but that's how it works. If you sent your case on June 28, 07, with July 2, 07 as the printed Receive Data on your receipt, but the case where it finally rested, was entered in their database on Oct. 28, '07 (with a Notice Date soon thereafter), you case will not be looked at, no matter what the PD cutoff date is, unless all cases received before Oct. 28, '07 have been reviewed.

I am not so sure if the CIR bill will help us. Allowing 12+ million illegals into the same system that we are in will totally screw up our chances of getting green cards. Does the bill mention anything about increasing budget and manpower for the USCIS department to handle 12+ million potential applications? Considering that large numbers of the illegals are from a country which also has a specific country quota in the GC lines, will the bill increase drastically the number of Visa Numbers available??
This bill favors the illegals so much that even reading it makes me wonder how fair the system is to those of us who follow laws and file documents on time. What's the point? All of us should just forget about the rules and go do whatever job we want to do.

It increases the H1B numbers, it increases the amount of GCs availbale per year, it excludes dependents from the quota, it excludes STEM advanced degrees (currently employed as well as future students) from the quota, it does require the illegals to wait at least 6 years before they can file papers for their GCs and then thay get to be at the back of the line, additionally, if the SKIL bill provisions are also included as amendments, it will also provide a premium processing facility for I485. The SKIL bill also mandates the DOL to clear all backlog within 6 months. The thinking is that by the time the undocumented aliens (somehow, I do not like the word illegal) enter the pipeline, the current backlog will be cleared and all dates will be current.
Given, the uncertainity in the process right now, I still feel that CIR is the way to go. Also, if it were not for the issue of the undocumented aliens, there would have been no incentive or push to do anything about the system and we would be stuck with this system. As far as the USCIS efficiency is concerned, I would not underestimate them either, the USCIS is known to be very efficient when it needs to (prime example the spectacularly efficient and successful H1 B premium processing system) so keep the faith and help yourselves achieve your dreams :)

Have you talked to lawyers with arguments you have mentioned here? Do you think there is a strong legal ground for success? For all five "questions" you have asked, there is legal backing. Law sees legal grounds, not sentiments, which seem to be the prime content of what you have stated.

Let us strive to achieve 10,000.00 contributions this month too. I request every one to please understand that either we get our GC's this year or forget for another two years due to mid term elections next year.
If we can pool really good amount, we may at least be able to lobby USCIS for some relief though with these small contributions, we may NEVER be able to lobby the congress.
We do not need to tell IV core what we want, they are all aware of our goals. But small contributions like 50-100 may not be enough to lobby to convince Congress our great contributions.
I am EB3 Oct 2002. Just received letter from SSN that, I have 40 credits now. We still can not even estimate when we will get GC's. In few months or few years?
If we think of 200 or 300 dollars, we may have to continue to suffer like this.
Can we determine to pool in at least 200,000.00 (each to contribute at least 300 dollars) so that we can at least hope for GC in few months and not years.

I visited the PA DMV yesterday to renew my driving licence based on my pending I-485. With all the valid documents like EAD, I-485, SSN card, I-94 etc. They refused to renew it saying that they have a new pilot program implemented called SAVE and need to get clearence from that, it will take upto 30 days. Anybody else gone throgh this proces?? Day by day more hurdles to pass...what a life, why dont they keep their systems uptodate or provide some temp permit as long as their check is pending. I am frustated with all this GC process, name check, DL SAVE system check etc..Why dont they implement just one check and give approval to everything.. atleast make it less time consuming.

Yes, 4 of my frineds in Colorado went through the same process called the "SAVED". I was the one who started this thread to find out if other states have already started using SAVE and it seems other states are reluctant to use it.
Ironically, the DMV in Colorado got sued last week regarding this new process because US citizens were badly affected by this. Please read the article below.
