I read from a different post that you can file for AOS if you are out of status for less than 180 days. there is a section 245(k) which allows you to do this. I don't know the accuracy of this info.

I thought of leaving this company several times, but I am working in this company for 6 years and the only company I worked after coming to USA. I invested so much for this company, like working beyond work hours, working in the weekends, making up the project deadlines for the incompetitive colleagues etc. etc. and now just waiting for my Green Card. The positive thing is, my direct supervisor is very nice and I can voice my opinion and she understands me and completely supports me. I am just praying god that I should keep working for her till I get the GC.

My wife is has a bachelor's degree in Computer Science. She is on H4..She is at present pursuing her MS in Comp Sc..She would complete it next May..That degree is costing me a hand and a foot...

My analysis is that immigrants tend to be better educated than native born because we (immigrants) need to double our effort to succeed. We learn proper English and try to correct our spelling. Native Americans speak English from the day they were born and sometimes can't translate the spoken words to letter.
I don't believe that there are races who are brighter or better than others. It's more of a culture and upbringing that makes the difference. Imagine those Spelling bee winners, who are now accustomed to US way of living. When they grow up, got their own family, will they instill the same values as their parents did or will they be like American Dad/Mom, who let their children pursue whatever they want?

Maybe I am wrong, but isn't the regulation specific to state that required filing fees must be paid by the employer? There may still be attorney fees which may be borne by the employer or the employee.
As regards the 12 month contract, if the contract is written appropriately, it will probably be binding in a court of law. It all depends on how the document is drafted. My employer hires Indians and Americans with 1 to 3 year contracts. The employees who chose to leave before their contract expired did pay back a set fee to my employer. There is nothing illegal about that. But again, it all depends on how the document is drafted.

I got a FP notice for next month. It is certainly not related to AP or EAD renewal, since I don't have any pending AP or EAD renewal. I got my EAD renewed last March and AP in May. So hoping that I got the FP notice since they started looking at my 485 application and something positive will be end result.

I am working on EAD and current one is expiring on Sep 26. I got an RFE for photos and it was received on Aug 7th.
I called last week Aug 15th and requested to expedite the process. I got an email two days back saying that my request was accepted and will get the decision within 14 days.
I been trying to get the infopass appoinment since past 2 weeks but so far I havn't been able to get any appointments.
I am keeping my fingers crossed and waiting.
Can I go to a different city to get an infopass appoinment ?.

I was part of the San Jose rally .. where there were about 300 odd people.
My neighbors had been to the immigration rally in Washington(flew from San Jose) and they said that there were about 1000 people there.
I have been following the immigration issues for sometime .. and I'm not very convinced that such small numbers can make the difference.
I'm not being a pessimist .. appreciate all the efforts that IV core undertakes .. but am totally unconvinced of major immigration changes. Looking at something like CIR being struck down .. after being on television for long and being debated .. I think we should get real.

Now, the 300 number at San Jose is incorrect. There were around 400 to 450 people there.
When flower campaign started it was just a few people. They never waited for a large number of people before starting. Others were inspired by their leadership. This effort became huge, even skeptics joined in, smitten by the contagious enthusiasm of rest of the members. Same with San Jose rally. We just had five days to do it, 450 people showed up, that is amazing.
These two small successful events were instrumental in change of July visa bulletin fiasco. This clearly demonstrates that your argument about small numbers can't make a difference is incorrect. We have a past precedent of successful outcome based on a small grassroot effort.
As Andrew Jackson said, "One man with courage makes a majority"
Lets be leaders rather than followers.
On the other hand if you still want larger numbers than join us, we need your help. We have a Nor. Cal yahoo group where you will meet a lot of motivated people. Your neighbor was part of a 35 or so people who flew from California.

I disagree that the situation is very bad.
It is bad only for those that are laid off on H1B. All others have EAD and are happy. They will realize the bad situation only when they cannot take a promotion or salary raise or cannot change job due to same and similar. Or if I485 gets an RFE or denial.
If the situation was bad, more people would be serious about your idea including you. Even you are not willing to do anything yourself other than asking others to do it. I heard that the rules were different before but as of this year, at least one of the parent of Indian origin need to be an US citizen to apply for OCI. Otherwise, the only option is PIO card.
The problem here is not the immigration system it is sheer number of people who want to become permanent residents . The queues in Canada and Australia are far far far smaller so the point system works smoothly. The main disadvantage of the point based immigration system is that if the people in the line increase, the points will be immediately be increased so that fewer qualify .Then there will always be people like Lou Dobbs who will say that "potential immigrants will get points only if they make 240K a year and are 25 years of age". The UK is also restricting people by increasing the point based system. Now people who make 35,000 GBP a year do not get any points in the HSMP. The age also has been decreased in HSMP. So the point based system works where the queues are smaller unlike the US. The risks of point based system getting changed everyday are far larger than the US based system , which gives Green cards without any hard and fast numbers like salary , age and qualifications .
