  • I am not sure when the CIR will pass...its not on Nancy Pelosi aganda in forseeable future... and several people already mentioned that if it didnt pass by MAY07 then you are looking at Jan 09 to get immigration stuff to happen...

I think we need to work on an interm EB relief bill ...which is absolutely non contraversial and try to pass it....not worring about piggy backing the CIR...

Issues such as h1 increase or adding more numbers need not be in it...we can include things like EAD after I-140...spouse/childer not considered for EB quota...etc...

Unless we act desissively now...its going to be a long way to 2009..

  • You should make sure that your employer is willing to support you. I dont know what kind of employer you have so cant speak about it. I moved to EAD and my employer fully supports me........be it 140 be it h1b or w/e. I have always helped him via sending people to join the company and now its his turn to give it back to me........so one has to evaluate his situation and then deicde.....

  • The IV is about issues/problems of employment based immigrants, and the goal is to get support as much as possible from every corner in this country to further the cause. Everyone who supports this cause fit in to some category (within legal limits - pro, anti, this group, that lobby, this ethincity, that nationality, etc.), and that does not mean we are promoting something or have preferences for a group. In my opinion any support (with in the legal framework) to the cause of IV from any corner in this country is welcome and should be appreciated.

  • After all these days it appears many people are still not clear about the difference between 485 processing times and priority date movement.

The two are completely different entities. When USCIS talks of backlogs they do not mean backlogs due to retrogression (PD unavailability). They are talking about the number of applications they received and the time it takes for them to process them.

When USCIS says it will clear the backlog by 2010, it means applications filed after that time will be processed in a timely manner (in less than 6 months). It does not mean that all the 485s before that time wil be approved. It only means these 485s will be processed and thrown into a cold sorage bin to be looked at again whenever the PD becomes available.

When retrogression started in 2005, EB2 India jumped forward by 6 months each visa bulletin. The reason was namecheck delays combined with the problem of Labors with Old PDd languishing in BECs. As both these problems have been eliminated now and also many EB3 filers from that time are switching over to EB2, it is highly unlikely that one will see wide movement in India EB2.

  • I for one will not be surprised. These undocumented immigrants march in thousands at their rallies [even though they face chances of deportation]. They are active in talking to media and getting publicity for their cause. They are also more actively contributing to help their cause. They have very strong backers - Agri-business, fast-food chains, restaurant owners, construction business , and immigration attorneys [ who will make lot of money if Z-visa gets passed], strong ethnocentric groups with considerable political clout, and many of them have US citizen relatives [who vote]

On the other hand, support of many immigration attoneys to EB immigration is half-hearted, high-tech employers care more about increasing H1B quota. Like it or not - IV is the only organization that is 100% devoted to EB immigration and working for our cause. Given this reality, IV should have got full support monetary and participation from 25,000 strong community here. As we know, only a minority of the community are doing all they can to help IV achieve its goal.

If we are not doing enough to help our cause, what right to we have to blame others for not helping us? In a way, we do deserve the step-motherly treatment for all the lethargy our community shows in standing up for its issues, and demanding a solution.

We will see and will be surprised to see that an illegal will be granted a status independent of an employer and will also have the travel permit and he/she can live here forever renewing his status.

  • Instead of asking for more bread, we are fighting ferociously for the scraps like dogs!

It was estimated by Compete America that if the last CIR had passed there would have been more than 500,000 visa numbers recaptured ( don't ask me for the math, I didn't come up with this number). Assuming that the Nurses took away a chunk of it, we still would have a big chunk to statify Eb3, Eb3, ROW, India, China etc. etc. And the nurses are going to walk away with a big chunk folks - whether we like it or not - because we are fighting each other like dogs for the scraps of the spillover, while they will come up well organized and walk away with the cake.

Our disunity, lack of long-term vision, lack of action is our biggest weakness. We will not win unless we fight this together.

I agree with you my friend, lets see if this guy really shows up for the rally in Dc.
All those who wants to divide EB2 and EB3, can wait for their part of bread crumbs. I want the whole slice of bread, for which I believe a recapture visa bill is necessary.

I am coming to DC rally and for the Lobby. Are you? Are you going to sit home, watch TV news or will you be the part of making that news?

Administrator please close this thread, we are IV a united team and not EB2 or EB3.

All the junior members who are joining remember, July fiasco happened because IV stood united as a community and not as a division.
It is a team play, haven't we all worked in US to understand the importance of team work?

Stand together or stand alone and wait to be blown away like a single leaf, CHOICE IS YOUR'S

We are not fighting for the one side cause but for EB community as a WHOLE

Walking dude soon we should start contacting the media groups about a big rally to held in March for legal immigrants.

    1. Lets spread the word about the rally
    2. The selfish ones on EAD who reply " I have EAD , I don't care" Ask them with the current economic situation, how long will they be able to retain their jobs? Secondly with the current bulletin status, are they ready to wait for next long years?

If it is a wise person, they will come to their senses.

Coolpal, I hope you are with us in this fight for recapture.

    Thanks
Can you tell me how long it is taking right now?
It is still different from case to case but you can count from 1.5 yrs to 5 yrs.

Also, do you know if you have to work for the employer if you are a provincial nominee?
I am not sure what employer, your question is about. Can you explain little bit more?

  • sometime's if they need to do some background-investigation to get more info on your visa status / educational background / name check or what-ever for no-reason etc , they just place you in this status. the tricky thing is do never know how long the wait is. ive heard / read some people have to wait in months for no reason. you should be happy that you received it in 2 weeks.

  • He's not my lawyer. I just hear of him out here in the various posts.

As for the things you ask below - why should he do any of the things you ask for - its none of his business. Or actually, its none of our business to tell him how to conduct his business.

Don't want to get into a mudslinging fest here - just wanted to point out that sometimes posts like the original one are useful.

You can do hero worship of your lawyer whoever it is. I will not.
Ask him/her if he will do advocacy effort for you or sue USCIS since all his clients are struggling in the long wait and spending a lot of money on immigration consultations, fees etc.

Ask him if he contribute to IV instead?

Ask him to give you priority instead of your employer who gives him business every year.

  • well - for the antis - the ONLY post they liked seems to be "pack your bags and go home". Lets not try to force ourselves to satisfy them.

Now, when it comes to out of status issues - lot of people do genuinely fall out of status. There is nothing called exploiting the loophole unless someone breaks the laws.

It is obvious that one must not be on bench, or after layoff without a job. There is no room for loopholes.

We have always seen that USCIS does treat every petition for renewal on a case to case basis. Grace period (considerable) has been considered for genuine cases.

Infighting is common - it happens everywhere. People seldom change.

See - IV is not something like a freedom movement or asking for rights for poor or downtrodden - IV is basically a group of immigrants who are skilled and well educated who want to lobby for a change in system and sort issues. Everyone here has their own selfish motive and that's why this infighting among eb2 vs eb3 , MS vs BS, India vs ROW et al......

So lets not worry too much because antis paint all of us together because of actions of some people. If people realize and change - well it is good for all - otherwise - "we cannot make the horse drink water .." you know what I mean

  • Since I am older and wiser now, I can easily take them.

Yes, I must correct myself. It is not 525 (even though that is what the ever hurrying radio talk show hosts said).

That's even better. Percentage wise it is now 300/435. How about that?

I was away this morning for a big community project that I am involved in. I wanted to round that off with a morning brunch with the Congressman I quoted, but couldn't pull it off. I had met Mr. Mark Udall a couple of times in Friendship and Business Chamber get together in Denver, CO. He is a fine gentleman.

I prey his words come true at the earliest. Got to go. Have to mow the lawn, as per home minister/ interior secretary.
    Bye. Ciao.

I have a quick question about Udall. He is the Boulder and Longmont representative and a Democrat. This gentleman though voted against S1932 (hope I got the December bill right) when it went to the house. Do correct me if I am wrong. That was an appropriations bill so his view on immigration may not directly be represented by his vote. Would you by any chance know where Udall himself stands on the whole issue.

  • HOUSTON: A federal jury has found five people guilty of conspiring to obtain fraudulent work visas for nearly 90 Indian nationals in exchange for at
least $20,000 per visa, the US Attorney's Office said.

Mahendrakumar "Mack" Patel, 55, Rakesh Patel, 36, Alberto Pena, 38, Bernardo Pena, 38, and Marte Othon Villar Sr, 48, encouraged and induced the illegal immigration of Indian nationals in exchange for tens of thousands of dollars per visa, a statement from the US Attorney's Office said yesterday.

The jury found that Alberto and Bernardo Pena, twin brothers from Brownsville, along with co-defendants had encouraged and induced 87 individuals from Gujarat to unlawfully enter US on temporary H-2B visas, knowing that the Indian nationals did not intend to work for the company that was used to get visas for them.

The brothers also knew that the visa-seekers did not intend to return to India when their 10-month visas expired, a statement said.

Pena twins also travelled to India to assist the Indian nationals with the application process and visited and corresponded with the US Consulate in Mumbai.

Two other co-defendants -- Mack Patel of Ft Worth and Rakesh Patel, a Houston pharmacist -- pleaded guilty for recruiting Indian citizens who were willing to pay $20,000 to $60,000 in exchange for visas to enter the United States

Great, Gave you a green. I too avoid these countries.

Also can anyone create a flyer specific to michigan region so that we can put them in temples and indian shops. This will be a good start to mobilize guys around this region.
