I need urgent advice from you. As you know my wife is on F1 visa and completed most of her credit hours needed by school. She has get only 1 credit hr to complete the course. However, that�s below 9 hr full time student status. She has been asked to register for additional 8 hrs..and pay tuition fee accordingly ( > 8K). Which I think is unreasonable. They told her that if she doesn�t register by tomorrow they have to report it to INS. She told them that she has EAD..there answer doesn�t matter in order to remain in school and F1 visa she has to register.
My questions is:
1) Can she continue working on her Thesis on her EAD and AP ?
2) What will happen to her f1 if she use EAD

The total number of voting representatives is fixed by law at no more than 435.[1] (United States congressional apportionment - Wikipedia, the free encyclopedia (http://en.wikipedia.org/wiki/United_States_congressional_apportionment))

Hello All,
I have a valid H1 (I-797, I-94) till 2009, but my H1 Visa on my passport has expired in 2005. My wife has a valid H4 till 2009; similarly her H4 visa on her passport got expired, we haven�t traveled outside of US from then. Now she is planning to go to India next month because of some family urgency and she is planning to take an appointment for H4 visa stamping in Chennai consulate (India). My question is, is there going to be any problem for her stamping as my Visa on my passport has been expired even though I have a valid H1 I-797 till 2009?. Is there any rule which states primary applicant has to have valid visa on his/her passport for H4 stamping.
If any one of you had a similar situation please share your experiece, it will be very helpful.

Personally I do think giving this 55,000 annual quota green cards to employment-based Science & Medicine immigrants is better than giving DV-lottery to other lucky people just win the lottery but without any high educational qualification. Also, since international students have stayed in US for long years and they have documents such as social security no. and driver licenses' to run the comprehensive background check. Therefore, it minimizes a lot of the risk to invite the criminals to immigrate.
However, I am curious whether this bill will be beneficial to all US advanced graduates in Science & Medicine or not. I know some new H-1B workers in those advanced degrees may NOT be the EB-type and they need to wait for certain years and then the employers will sponsor them green cards as the EB-category. And if the employers don't sponsor them green cards due to companies' merging different departments or for other accidental reason, they will lose their green cards.
Also, some advanced graduates in Science & Medicine cannot get the H-1B working visa smoothly due to H-1B quota is full and need to leave US and some of them can't get the
H-1B extension and need to leave US. Or some of them got laid off during their employment period due to merge of 2 companies and if they can't find another employer, they need to leave US too.
Therefore, if they can't get into the EB category, this bill cannot help them out!! Personally I do think if to allow all those advanced graduates in Science & Medicine to enroll online by "first come, first served basis" and once the 55,000 quota is filled, then they need to wait for the next year to immigrate. It is hard to imagine two people aged 45 and 39 with three kids aged 19,12 and 7 can't survive in US - they mush have Citizenship or GC. This sad episode defenetly does not earn Indians a good name. They could have looked out and seen how so many illegal immigrants are surviving. I have heard several times that when God shuts one door, he opens another. Is it in films and story books only? I think, they have not filed for bankrupcy protection yet.

I am not sure if this can be a good defense for ability to pay issues. Employer's revenue/profits drive the number of employees that can be sponsored for GC. It is not everyone or no one scenario.

This is exactly what I said in my previous posts. EB2 India may become unavailable towards the end of September as most of the visas will be used in August itself and we will see a flood of approvals starting August 1st itself. I think most of the approvable cases are already processed by USCIS after it gave the data to DOS on July 8th. I think most of the straight forward and less complicated cases during 2004 - 2006 period will be approved soon.
I do not want to spoil the party fun but somewhere in my mind there is a lingering doubt. I read Ron Gotcher's post about August 2008 bulletin.

I don't know if CSC is still processing 485 EB applications but CSC EB processing cut off date on its website is April 04, 2006. The priority date for June 2007 bulletin was April 1st2004.

Once they get adjudicated there would be retrogression. Analysts analyze.
