unfortunately, I think there is more demand than supply for EB2 India Mostly (maybe China too)...which will not let any relief be brought to any EB3 categories....If USCIS keeps allocating spillovers to EB2...they will never quell that demand.

However i totally forgot about my I-94.
So you think the only way to get the i-94 extended is to go out of country.

I was in a similar, but slightly different, situation. I got my 3 year extension while my previous extension was still valid (a couple of days left).
So at the POE, the officer gave me on the I-94 a date that was 3 years from the date of entry (that's the max their system was designed to handle) and said that since I have the visa on the passport, the next time I reenter I would get the later date on the I-94.

Dear Core IV members. It is clear how tirelessly you have worked, let alone the time and money you spent, sitting in tht comfort of our homes and using our credit cards to make a small contribution of 200 dollars twice or thrice is pales in comparison to what the core mebers have done. Democrats want to win Presidential election and increase their numbers in congress based on Iraq and Immigration. They are thinking that if CIR is passed they can project that it is Democratic congress which passed CIR. If they fail they will blame that Republicans voted against and they will make this as election issue. They are thinking in that way. But it will not work. People are against big immigration numbers but they will not oppose moderate immigration increase. But American people are divided when it comes to illegal immigration. If any other issue is burning then immigration will become non issue and democrats will not get any extra votes because of CIR. But liberal immigration is not good for Labor unions(we know democrats are pro-labor also) so that may work against Democrats. Right now it is not sure whether parties are really dedicated to pass CIR or Just for making immigration alive to get political mileage.

I took the pain of driving to NY all the way from Boston to get my passport renewed. I woke up at 3:00AM and stated off at 4:00AM so that I could reach the consulate by 8:00AM. I was told by my friends that I would get it in the evening itself. Unfortunately, I was faced with severe disappointment that they are no longer returning the passports on the same day. The worst part about the Indian consulate in NY is that they didn't update their Website. When I called them several times, non one answers the phone and speaks with courtesy.
After arriving at the consulate, we were made to wait in the cold for atleast an hour until 9:15AM (They open the doors at 9:30AM). They have no mercy for people. Also, the approach they took to call out people was terrible. It was like a fish market. I asked them if would get my passport back on the same day. I didn't get a straight answer until my number was called. I went there and atleast that lady talked to me with respect with a smiling on her face. Atlast I was told that they are not returning the passport on the same day. They asked me to pay 20 extra dollars so that they'd send the passport by Express mail (USPS). She also told me that I can track the passport.
I then drove back to Boston, the same afternoon. After exactly a week, I got the new passport booklet along with my old passport. I am fortunate enough to have all of the details printed accurately.
My strong advise to everyone is to send their passports by mail.

Just wanted to confirm - this discussion is pertinent only for cases where the new H1 (3 yr) is pending at the time the person travels overseas, right?
For example, if your current visa (and I-94) expires on Feb 28, but you already have a new visa valid for 3 years starting Mar 1, you can re-enter US within Feb 28. Then you can go to Canada/Mexico/Home country, get the new visa stamped on your passport, and on that basis get a new I-94, right?
I don't seem to see any confusion here....or am I missng something?

All right points above - we dont need to try too hard to prove our (IV's) original objectives and ideals. If they (antis or others with questionable motives here) are really interested they can go thru the website. Being anonymous web forums, site will attract different types of users and some noise may be almost unavoidable. Having said that we might need some more active moderation - as the IV's popularity increases the website is bound to attract more diverse groups of users with newer agendas. Moderation by only core group of people is obviously time consuming to them (going thru different threads and sometimes even following what is being discussed). I am not sure if IV already has this but can we have a basic user reporting type system - wherein we can have a high level sticky thread requesting users to report any abuses/violations of IV terms - users can post report any voilations they came across in the site - core group and maybe a group of more volunteers dedicated to just concentrate on forum content can go thru this sticky thread on a regular basis and decide. Currently we do have a reputation mechanism and PM to core but its cumbersome. There could be false/improper complaints in the user reporting system as well but atleast core/web-forum-volunteers only have to go thru fewer threads.
