  • I assume you might have gone to Rt 23 DMV, try Rt 46 in Wayne. They are more considerate. I had my DL expiring in April 07 but my H1 was Valid till Sep 07 (the DMV officer had a made a mistake in 04 by putting the wrong experation date when I went to update my DL with Motorcycle endorsement. When I pointed this out he said I still have almost 3 years so come back then:mad:) . I went to Rt 46 Wayne and the lady renewd mine till Dec 07. 90 days more than the valid dates on H1. She said she has already included the grace period which is avaliable in situations of visa renewal so I can renew my visa and get back to them in time. This shows that there is a provision for 90 day grace period.

    Try Trenton if Rt 46 in Wayne fails. Best of luck.

    My current H1 is expiring soon. My 3 year H1 extension is pending. I had receipt notice but NJ DMV at Wayne refused to accept that. My current License is valid only till the middle of the next month.
    Any body in the same boat? What shall I do?

  • I hope that this holds good for existing GC applicants too. When perm was introduced the existing applications was pushed to the BEC black hole. Many of us had to wait for a couple of years while watching the newer perm applications getting approved.

    Well I jumped a little too early :) and opened a SR in July. The following is the response I received:

    It is less than 60 days old status now and hence cant open a SR for 1.5 months :)

    BTW, it has been over 2.5 months now and my AP hasnt been approved yet :mad:

  • If LOA can stop the old employer from revoking I-140, I would say, go for it. But just make sure you don't land into any other trouble (like non-competent etc. just an example, may not be relevant in your case, but you get the idea...).
    Also, discuss with the new employer and make sure they are ok with supporting you in case of an RFE. From your response, looks like they might know what it is. What I can think of is, consult an attorney and discuss what kinda RFEs you can get that needs employer help (mostly EVL, ability to pay), prepare a sample response letter for both and check with the new employer they are ok with providing them if necessary.

    the new company has no clue about visa/h1/gc issues. they have never hired a "brown" guy and they do not even know that i am on ead..even if i told them they wouldn't know wht to make of it..so the only letters i can get will be generic letters stating my occupation and salary with a very brief description of duties. i know someone said loa is not a good idea but i think it just gives me a back up.

  • I don't think any analysis is done. That is only going to divide the community.
    Some would say preference be given to EB category benefiting EB2(I&C).
    Some would say PD should be given preference predominantly benefiting EB3(I).

    If they follow the current spill-over rules, as you are aware, EB category would be given preference.

    Thanks for the reply. I am not sure how that will divide the community. As per USCIS laws currently, the spillover is horizontal. Based on this assumption, will EB3-I get any visas if the recapture is successful?

    Look, the H1 quota was not sufficient even when it was set at 115,000 pre-2000. It was only when it was set to 195,000 in 2001 that the quota exceeded demand. Now thanks to the report by USCIS last year, we know that about 20% of the H applications had fraud or technical violations. Even if you assume that the USCIS does a perfect job and catches this 20%, the quota that will be freed up won't be enough for the rest of the applicants.

    The issues we face have less to do with fraud and more to do with the anti-immigration forces who dislike the 1965 immigration law. Claiming fraud, cheap labor, harm to the environment from increased population are just convenient means to couch opposition to permanent immigration in.

  • I am thinking of buying a home without waiting for GC approval. I am EB3 I with PD 2006. No hopes of GC in near future. Just want to see the trend....

    Please vote yes if your GC is pending and you own a house.
    Please vote no if your GC is pending and you are renting.

    It is a personal choice plus the level of risk you take, I bought my house before my GC was approved and here I am now. Setting aside GC concern, the only problem you might face is securing a loan with good rate, all lowest rate that you notice in internet banner or Bank flyer is not applicable to you, simple reason H1b Visa is considered as temporary Visa, once your loan application is taken by a banker, one of the question in loan app. pertain to Citizenship, if you're US citizen or GC holder then chances of getting loan with lower rate is higher(though many factors contribute to lower rate and loan approval), but if a person on H1B visa approach for a home loan, then Under writers perceive you as high risk borrower, some bank may deny loan if you claim as H1B visa holder, but some banks will approve loan but on higher rate.

    In my case I was on EAD when my loan was approved, it was a hell lot of problem in convincing UW to approve loan, I approached my lawyer to get a letter stating that a person on EAD is one step closer to GC to get final approval, still I ended up taking 0.25 % more rate.

  • I thought they stopped processing premium 140s which is why a lot a people who are still eligible are not porting to EB2.

    Just curious, why are you not porting your PD?. Nowadays Perm takes less than 2 months and with premium, 140 takes a few months.

  • well there will always be certain exceptions everywhere....Michael Aytes did mention it publicly when he testified before congress in his document below

    he does mention that all these applications will be pre-adjudicated just short of visa number. So officially in my opinion they will not go back to these applications unless there is an exceptional condition which makes them do it. I can safely say that broadly it's not gonna happen.

    I really dont care what my company policy says because as I look at it, it should be my decision whether to work on EAD or continue on H1-B. If they switch my work authorization without my knowledge, then it will be a classic case for lawsuit. Moreoever the policy is not documented anywhere.

    As long as you dont use your EAD, you can continue working on H1B.

    In fact, if it is the same employer as your GC sponsor, you dont have to do anything.

    The thing to remember is to extend your H1B if you do a H1B transfer so you dont have any issues at the time of transfer.

    All this is assuming that your company policy can handle exceptions to the policy :)

    Thanks anyway for that answer. My situation is different beacuse with the I-140 PP going away for now...and my H1B expiring Feb 2008...I am left with approved I-140,Labor and retrogressed dates to be eligible for 3yr extension.

    Now that if 140 is pending ...then I am left with EAD as the only option to continue manitaing my status.

    Correct my intrepretation of law if wrong..

    While I am happy for you and your success along with your spouse, I personally consider it as being at the right time in right places making decisions that were in your reach. I do agree that you did lot of planning. Most of the people here run on one income and spouses on H4/F1. So they dont have the edge you had/have. I might sound harsh in saying this but the matter of fact is that the 2 incomes lead to savings which lead to buying a home(s). 1 income, you wouldnt have done all these by yourself. I know several people with 2 incomes and most of them have done this :) Those who havent were the kind of folks who are happy having their 100K in bank rather raking up 200K in equity. I am sure there are a lot of things you can do with a US Citizenship.

    IMHO, you are succesful in your own way depending on the situation you were in and how conducive the circumstances were. I feel that this forum is totally going in a direction where people are seeking some sort of solace in discussing stuff that doesnt directly relate here. Now that all of us had discussed about what we can do with a GC can we streamline our effort to what we can do to get a GC.

    It is very important to maintain my status. I am sure I can find the Job before the maternity leave ends. Is there any options that I can stay in status and delay the termination for 2 or 3 months while I am on maternity leave?





    And always send via USPS express mail. (1 day costed me $18) but I came to know instantly the next day that they received it.
    You could also use some cheaper USPS option. as long as it has some delivery confirmation.
    The reason I like express mail one day, is because u can request a copy of the receiver's signature via email (comes in a PDF). This is proof that USCIS really got it and u can then sleep nicely for the next 3 months.
