WASHINGTON - Senate leaders reached a deal Thursday on reviving a broad immigration bill that could provide millions of illegal immigrants a chance to become American citizens and said they'll try to pass it before Memorial Day.

Reid acknowledged on the Senate floor Thursday morning that he "didn't get everything that I wanted" in the agreement, but said Frist didn't either. Reaching the agreement is "not easy with the political atmosphere," Reid said.

Reid had been taking some criticism for refusing to move forward on the bill after complaining that Republicans were trying to undermine it with amendments and insisting that Democrats be allowed to have a say in who serves on the conference committee.

it depends on who is in which category ..I feel the above (1 -2 -3) is unjust ..not that I/we can influence how it flows. my view is that the category which is at the end should get more visas ...and I would support this even if things change tomorrow (EB3 current and EB2 severly retrogressed or EB-wwide - retrogressed ..not that it will ever happen !!)

EB1 is more qualified than other categories and is seen as someone who is in a better position to contribute to the national welfare of the country. EB3 is the least qualified of the three and is also the most likely candidate to displace an American.

And you think America should throttle the flow on qualified EB1 and be more generous with EB3?

EB2 is different however. Most EB2 are people who were EB3 earlier (like myself). For such people, there is a provision to upgrade to EB2 through interfiling - as option that is being heavily used even as we speak. So where is the problem?

I already sent a AC21 letter to USCIS through my Attorney - I am not sure if my file got updated.
My desi employer wants to withdraw the 140 petition now. He says, he cannot keep 140 petitions of employees who leave the organization and not on w2 and he will have "ability to pay issue"
I have heard horror stories of USCIS issuing denials and NOID because AC21 letter never reached the file even though it was sent in time and I guess this is exactly what my desi employer thinks - teach lesson by withdrawing 140.
I spoke to my Attorney and she says "your file may not be updated but we will keep a record that we sent" useful in case we want to respond to NOID or RFE.
Folks - please post your AC21 success/horror stories when previous employer withdrew the 140 petition.
What are my options to avoid a NOID or denial

You will not have any problems since you already submitted AC21 documents (keep certified mail receipt with you).....so whatever your attorney said, it is correct....you don't need to worry.....even your employer withdraws your I-140 it won't be having any problem.....it happened in my case....I have sent AC21 docs....after that employer withdraws I-140.....but nothing happened to I-140

"Ability to pay issue" is right in employer's view.....he can able show the ability for one more application if he withdraws your application.....

How did you find your file was not updated AC21 docs..... better way is go to local USCIS and asked your attorney name whether it is the changed one or previous one if you have changed them.....call I800 and asked them few details like attorney name and company name etc..... see some times they won't reveal any info....you have to find out the way to get right answer (like tell them old attorney's name and say didn't get any updated information about your case etc)....

I concur with the opinion of getting into IIT's is not a bench mark for success. It depends on what a person considers success. As far as "Best among best" is concerned, I used it only to compare the number of seats available for equally intelligent students in India and US. A student in India with similar aptitude, IQ and what ever comparable metrics has lesser chances of accomplishing what a student accomplishes in the US. let it be getting into IIT's or Ivy leagues.

I have already put in the expedite request with Texas, but haven't heard since then, whether its approved or not. Please suggest what should I do?

If you were not told the correct bill rate, you can recover that money. Simply ask them in writing to show you the contract since you are on 70/30 basis. The written contracts, oral contracts, emails all stand in the court but how will you prove an oral contract? If you have found an offer that meets your expectations just quit. We all make the same mistakes. We spend our time on working out things where they are not working. Just "quietly" without your employer getting a hint, find a job and quit.

Bill rate? 70/30 basis?? Contract??? I would like the OP to report his employer to DoL. DoL and USCIS will kick both the OP and the employer. It is easy to get carried away saying that the employer is blood sucker etc. But very clearly, you should know that there can't be these kinds of contracts on H1. The employer knows that people who go to them are on thin ice, and so does the employee (employer is there to do business -- he is not running charity).

Maybe you guys want OP to go to DoL so that both the employer and OP get kicked out of this country (that is good for all of us) due to obvious immigration fraud.


To top it, OP goes on an offensive when people point of the bitter truth to him. If people do not value IV then IV is not the place for them. IV allowed everyone to file I485 in July and get EADs . You are able to get your EAD freedom because of IV and that is priceless.

If you think the atterney fee worth $10, you wouln't hire an atterney asking for $6k. Samething with the restraunt check. Samething with IV contribution. If you think $100 is too high, you don't pay it. But if you think it worth $10 you simply ask for it, like everybody will do. Imagine a car saleman responds to his potential buyer's request to a lower price of a car with insulting remarks, he'll loose this customer and many more.

I have applied for FOIA during Oct 2007. No response yet. Just checked the status. Thank you very much for the link. I did not know it existed earlier. Do you happen to know how I can change the address because I have moved ? I called the number they listed for FOIA on reciept notice. The asked me to call the regular USCIS number to update the address. The person who answered the regular USCIS customer service had no Idea about reciept notices starting with NRC. You can request a copy of I-140 approval from USCIS using G-639 form (download from www.uscis.gov).

In G-639 form, Fill out the following information

I) Type of request
-> Freedom of information Act (FOIA)

2) Requester Information
--> Your Communication address

3) Consent to release information
--> Please choose "A portion of my records" box

4) Information needed to search for record
--> Please specify only "ETA 9089" for PERM CASEs or ETA 750 PART A & B. ( I have asked for ETA 9089,)
--> You can also ask for I-140 approval copy(Since i have approval letter i didn't ask.)
*Note: If you specify portion of record in application, then it will be processed in Track one otherwise it is going to be in complex track(Track Two).

5) Data needed on subject of record,
--> Please give A#, Receipt number, DOB, I-94 Admission # and your name etc.,
6) Verification of subject identity
--> Notarized affidavity of identity

I have applied it, it is in the process, i believe it is going to take minimum 3 to 5 months since my case is assigned to Track One. Every month they are processing atleast 1000 Applications. It may take morethan 6 months if the case is assigned in complex track. If you ask for full package then difinitely they will put into complex track(ie Track Two).

applications from 2000-2009 until they finish the backlog. That may be one of the
reasons why they may have retrogressed to 2000. Just my 2 cents.
