  • Democrats Should Read Kipling (http://www.nytimes.com/2008/02/18/opinion/18kristol.html?ref=opinion) By WILLIAM KRISTOL | NYT, Feb 18

Browsing through a used-book store Friday in the Milwaukee airport, of all places I came across a 1981 paperback collection of George Orwells essays. Thats how I happened to reread his 1942 essay on Rudyard Kipling. Given Orwells perpetual ability to elucidate, one shouldnt be surprised that its argument would shed light or so it seems to me on contemporary American politics.

Orwell offers a highly qualified appreciation of the then (and still) politically incorrect Kipling. He insists that one must admit that Kipling is morally insensitive and aesthetically disgusting. Still, he says, Kipling survives while the refined people who have sniggered at him seem to wear so badly. One reason for this is that Kipling identified himself with the ruling power and not with the opposition.

In a gifted writer, Orwell remarks, this seems to us strange and even disgusting, but it did have the advantage of giving Kipling a certain grip on reality. Kipling at least tried to imagine what action and responsibility are like. For, Orwell explains, The ruling power is always faced with the question, In such and such circumstances, what would you do?, whereas the opposition is not obliged to take responsibility or make any real decisions. Furthermore, where it is a permanent and pensioned opposition, as in England, the quality of its thought deteriorates accordingly.

If I may vulgarize the implications of Orwells argument a bit: substitute Republicans for Kipling and Democrats for the opposition, and you have a good synopsis of the current state of American politics.

Having controlled the executive branch for 28 of the last 40 years, Republicans tend to think of themselves as the governing party with some of the arrogance and narrowness that implies, but also with a sense of real-world responsibility. Many Democrats, on the other hand, no longer even try to imagine what action and responsibility are like. They do, however, enjoy the support of many refined people who snigger at the sometimes inept and ungraceful ways of the Republicans. (And, if I may say so, the quality of thought of the Democrats academic and media supporters a permanent and, as it were, pensioned opposition seems to me to have deteriorated as Orwell would have predicted.)

The Democrats won control of Congress in November 2006, thanks in large part to President Bushs failures in Iraq. Then they spent the next year seeking to ensure that he couldnt turn those failures around. Democrats were against the war and the surge. That was the sum and substance of their policy. They refused to acknowledge changing facts on the ground, or to debate the real consequences of withdrawal and defeat. It was, they apparently thought, the Bush administration, not America, that would lose. The 2007 Congressional Democrats showed what it means to be an opposition party that takes no responsibility for the consequences of the choices involved in governing.

So it continues in 2008. The director of the Central Intelligence Agency, Gen. Michael Hayden, the director of national intelligence, the retired Vice Admiral Mike McConnell, and the attorney general, the former federal judge Michael Mukasey, are highly respected and nonpolitical officials with little in the way of partisanship or ideology in their backgrounds. They have all testified, under oath, that in their judgments, certain legal arrangements regarding surveillance abilities are important to our national security.

Not all Democrats have refused to listen. In the Senate, Jay Rockefeller, chairman of the Intelligence Committee, took seriously the job of updating the Foreign Intelligence Surveillance Act in light of technological changes and court decisions. His committee produced an impressive report, and, by a vote of 13 to 2, sent legislation to the floor that would have preserved the governments ability to listen to foreign phone calls and read foreign e-mail that passed through switching points in the United States. The full Senate passed the legislation easily with a majority of Democrats voting against, and Senators Obama and Clinton indicating their opposition from the campaign trail.

But the Democratic House leadership balked particularly at the notion of protecting from lawsuits companies that had cooperated with the government in surveillance efforts after Sept. 11. Director McConnell repeatedly explained that such private-sector cooperation is critical to antiterror efforts, in surveillance and other areas, and that it requires the assurance of immunity. Your country is at risk if we cant get the private sector to help us, and that is atrophying all the time, he said. But for the House Democrats, sticking it to the phone companies and to the Bush administration seemed to outweigh erring on the side of safety in defending the country.

To govern is to choose, a Democrat of an earlier generation, John F. Kennedy, famously remarked. Is this generation of Democrats capable of governing?

  • India-China Relations: It’s the economy, and no one’s stupid (http://idsa.in/system/files/IB_IndiaChinaRelations.pdf) By Joe Thomas Karackattu | Institute for Defence Studies and Analyses

The recent visit by Chinese Premier Wen Jiabao clearly had a productive focus - SinoIndian economic ties have been re-enforced, and there has been an effort to re-balance the trading relationship. This Brief uses irony to communicate five propositions (i.e. the intended meaning of these five statements is the opposite of what is stated), that can be found in several discourses on Sino-Indian ties. It evaluates these propositions in the light of the tangible and intangible gains from Premier Wen Jiabao’s second official visit to India.

    1. Obama’s visit had more substance for India

How do you weigh a visit by a foreign Head of State or Government – one that prods a relationship in an incremental way versus one that promises a turnaround from a low baseline? The political and strategic dimension of the India-US partnership received an immense boost with Obama’s visit, and so did the economy. However, with Wen Jiaobao’s visit, India and China have prepared the ground for what hopefully shapes up to be a balanced economic and a healthy political partnership. If Premier Wen has second-placed talk of India and China being rivals – surely the political gains are waiting to be realized. Incidentally, the MoUs signed during Premier Wen Jiabao’s visit are worth $16 billion (against $10 billion worth of agreements signed during the Obama visit).

Re-balancing of the Indian deficit (roughly USD 20 billion) from its trade with China has been promised through enhanced trade facilitation in the pharma and IT/Engineering sectors, a proposed CEO’s forum, more openness to Indian agro products, greater presence in Chinese trade fairs, and the desire for a strategic economic partnership. The present focus on infrastructure financing in India through Chinese banks is demonstrative of a ‘win-win’ situation for both sides. China’s consumer price index (CPI) 1 , a key measure of inflation, hit a two-year high of 5.1 per cent year-on-year in November 2010. Meanwhile, the People’s Bank of China (PBOC; the equivalent of the RBI in India) raised banks’ reserve requirement ratio (the deposits mandated to be withheld) for the sixth time in 2010 as a sterilization measure to prevent excess money supply from adding to inflation. Under such circumstances, Chinese banks have been foraying into lending operations elsewhere as well (Industrial and Commercial Bank of China’s (ICBC) commercial property loan in summer 2010 to a group led by private-equity firm, the Carlyle Group, in the United States is a case in point)

Policy Focus: The push for horizontal investments from China i.e. market seeking FDI through local production seems to have received less attention. This is an area which needs to be explored fully to address employment generation in India, and for Chinese firms to have a visible household presence in India (similar to Korean and Japanese consumer durables, for instance).

    2. China has not changed. It cannot be trusted. Politically, there seems to be no progress on resolving the border dispute, and in the economic sphere there seems to be an in-built incongruence in the growth trajectories of the two countries.

The 1962 war was the reflection of the variance in India and China’s diplomatic, ideological and political approach to bilateral ties and international affairs. Those were the years running up to the Sino-Soviet split, the US engagement in Korea, Taiwan, and the second Indochina war (all involving China), and the domestic misfortune of the Great Leap forward. China had real and perceived fears of India’s oscillation between the United States and the Soviet Union. However, today China is placed in different circumstances, both as a political power and as an economic power. It is now more deeply entrenched in the economic architecture of the world. China’s concern to develop its Western regions coupled with diminishing incentives to foreign investors on the East Coast implies a patient and consistent effort at domestic restructuring in China. The stimulus measures and other construction projects need to be absorbed, the idea of “soft infrastructure” over “hard infrastructure” i.e. transparency and corruption-control has to be pushed through, and inequity needs to be tackled both between cities and rural areas, and between provinces in China. That is a long-drawn process of reforming social security and healthcare in China, apart from administrative reforms relating to land and labour rights (hukou system).

Intuitively, the prospects of relying on Europe and the United States as consumer markets for China over the long term are dicey (imagine how long an economy growing at 8 to 10 per cent could rely on markets that grow at between 2 and 3 per cent?). The present incongruence in the growth trajectories of India and China is ascribed to the market-first approach in China versus the business-first approach in India’s liberalization of its economy. Almost as a visible consequence, China is a larger trading nation even as the private sector there is yet to benefit from lenient financial intermediation (the State plays a big role even today). India on the other hand has a promising private sector and vibrant secondary markets even as its integration into the international economy is hindered by relatively higher tariff barriers in the country. The absence of overlap in the key growthdrivers of both countries (Industry versus Services in China and India, respectively) actually presents the most important reason for India to work with China, and for China to work with India.

The economic imperatives for China to engage with the larger Asian region are borne out by the trends in consumption expenditures in this region. China presently is mired in the need to revive consumption expenditure internally, in order to offset the export-dependent economic engine of its growth. The Key Indicators for Asia and the Pacific 2010, the flagship annual statistical data book of the Asian Development Bank (ADB), indicates the role that Asia stands to play as an alternate consumer market in the long term. The resilience of the middle class in Asia during the 2008-09 recession is highlighted by an estimated USD 4.3 trillion in annual expenditures during the crisis (ADB 2010). This was nearly a third of the private consumption in OECD countries, and is projected to account for 43 per cent of the worldwide consumption in 2030.

Policy Focus: India and China have a real chance of promoting mutual economic growth and development if their economic ties are not ‘securitized’, and the issue of tariff (from India’s side) and non-tariff barriers (China’s side) and protectionism (both countries) is addressed. The CEO’s forum, for one, could initiate linkages with Chinese Universities to develop internship programmes drawing on China’s younger generation of graduates to visit Indian companies desirous of expanding operations in China.

As for border talks, Pandit Jawaharlal Nehru and Premier Zhou Enlai agreed in the past to have mid-level bureaucrats handle talks for mediating the border issues (Hoffmann 1990: 32). Prime Minister Manmohan Singh and Premier Wen Jiabao have reached an understanding to have foreign ministers of the two countries deal with the vexed problem. Certainly, the level of engagement has been upgraded specifically vis--vis the border issue.

Another important point to note is that, as per the Pew Research Centre’s Global Attitudes Project (October 2010), in 2009 46 per cent of Indians expressed a positive view of China, compared with just 34 per cent in 2010. The Chinese Ambassador to India may think that the fragility in India-China relations emerges from over-reaction to issues concerning China in India. However, the same report qualifies that only 3 per cent of Indians surveyed consider China as the greatest threat for India, whereas, despite a sanctioned media, more Chinese have negative opinion on India (only about one-third of Chinese respondents (32 per cent) have a favourable opinion).

So where does the fragility come from? Does it arise from the ‘looseness’ of a democratic apparatus to shape public opinion? But Chinese public opinion is negative despite the regimented approach to the dissemination of information. Clearly, even if it is not the final word, these perceptions reveal how both countries need to do more to genuinely take forward the elationship at the level of ordinary citizens. The leadership in both countries has to find ways to shape debates within their countries to soft-land negotiated outcomes, if there is a genuine and concerted effort to resolve the border issue, and other contentious issues that may arise.

Policy Focus: There is a need to cultivate individual perceptions of the other, at the level of citizens. This exercise could be executed at the level of greater tourist facilitation measures or exposure to popular culture through mass media. More Indian television programmes, dubbed in Chinese, should be promoted in China (currently only a few such programmes are broadcast in China). Surprisingly, Chinese programming (similar to NHK, DW-Asia or Russia Today) is not even on offer on most satellite networks in India. Events such as the ‘Festival of India in China’ or the ‘Festival of China in India’ should be promoted on a wider scale to involve citizen participation beyond the diplomatic corps.

  • Why do you need to hire other person if Joe is fit f
or the job though he is not as bright as other H1b person. For example you do not need IIT graduate for QA position. For example If you want a core system software programmer in TCP/IP level or semiconductor R&D you can go brightest in the World. Bill Gates is an exception. 95% of bright people will have degree or more in current world.

i can only answer from a personal perspective.
that logic works fine in some jobs and for those, that is exactly how it should be. for jobs that need some analysis/creative thinking etc it makes a huge difference. yell me why you would like to get a degree from the best school/ same degree right?
i am a physician, if i were recruiting tomorrow (and we are) a million things matter. education, experience, acquired skills, where the applicant worked, what the patient population was etc
by uscis rules anyone with board certification in our specialty is fine. if we advertise for more...we are breaking the law. if we take the better candidate with more skills...again if he /she has a visa, we breaking the law. pretty restrictive would you not say? understand that the group would gladly gladly hire an american if he fit in with the vision of what we need. but good candidates are scarce. and settling for the not so good bloke seems just not right.
any way which physician would you choose to go to? these days patients come to us after checking our detailed credentials on the website. They know when they walk in whther i trained at the mayo clinic or abcd community hospital. so yes it matters, to you and to my group.

What is your PD ? EB2-India is Jun2006. It is just 2 years back. So I am guessing your PD is even less than 2 years and you are getting so restless that your are seeking to get more rulings done in place where 2000 thousand unnecessary laws & rulings exist for a 'could be an easy' process. I think instead of talking to lawyers you need to see a doctor...

Not all of us are in IT, not all of us work in body shops and NOT all of us deal with fraud in our lives. If a few do, then go chase the, and stop tarring us all with the same brush. This is really akin to my saying (and I'm not saying it) that all EB3 folks are just IT diploma holders working for body shops and the whole category is just a fruad. How does the tarring feel now?

I said most of the case. Not all. Ofcouse, most of the bodyshoppers does this abuse. Like labor subsitution, creating a duplicate job just to file EB2 etc.. I am not blaming good US employers and employees. There are tons on non-IT genuine EB2 cases are there..

  • Exactly, its about how many people care about the issue. If terrorists kill innocent civilians, first thing they'll say is "Islamic Terrorism". Don't tell me media around the world didn't use this term. Anything and everything blamed on religion and people following the religion.

There is a reason for that. The organizations which claim responsibility for such attacks have names like Jaish-e-Mohammad, Lashkar-e-Taiba, Deccan Mujahiddin... Now I don't have to explain the meanings of their names. Then they say they are doing Jihad!

Why would somebody not call them Islamic terrorists?

Now that does not mean all followers of Islam are Islamic-terrorists.

  • Situation definitely requires some action from Congress, H1B program was introduced to help

American Corporates so they can hire best resources from all over the world where Americans

are not available, American Corps started taking undue advantage by hiring even if Citizens

were available just because they are getting H1's for lesser price, and showed this

miserable path to desi companies who abused it further.

If the current situation (with out this bill by just adding more h1's) continues not only US

economy will suffer (The number of available right people for any job will be less as hey

would be working for some desi company making 20$ an hour) even H1 aspirants will start

suffering upon Arrival to US and also those who live here will suffer from immense

competition (Just because of the reason that every job posting will be flooded with 1000's

of resumes and only lucky ones get picked you may be best but your resume has to be picked

for an interview call), as the number of jobs are lesser than people coming.

Unlimited H1 may be a solution but it is not practical, If the numbers are available then

desi companies won't bother to file so many applications without actual job, it makes

situation better for new H1's coming to US they will have a job instead to joining a desi

company and sitting on bench for long time(after quitting their job in India)

Coming to this Bill, Even if it is so threatening they have some good points to bring curbs

on H1 Employers who bring them here without actual job, People who are destined to come to

us will come for a better life.

IF Durbin wants to help US he has to make bill which is practical and should address how up

clean up existing mess, This bill is not practical and will definitely face lot of

    opposition.

Unfortunately politicians in any country have to take decisions based on how it is going to

gain their party and in terms of votes and later how is it good for the Country, they will

have lot of pressure from various other factors which we don't understand and they don't

    understand us.

Their decisions are based on the data they have available with provided by few agencies whom

they trust and closely work with, If they are taking a wrong decision that means either they

don't have complete data or not properly educated. as we are getting affected It becomes our

responsibility to provide them complete data and educate them totally of the situation, so

they make a correct decision and address the issue, and to do that in US affectively we will

    need millions of $'s.

For bill to be more practical it should address 500,000 people who are living here for past

several years and who's kids are US Citizens and also own homes. And also American Companies

who are utilizing skills of these people.

If 500,000 contribute 20 $ each we will have 10 Million and we can make ammendments the way

    we want it to be.

If 10000 members contribute 100 $ each we will have 1 million which is not bad but this not

    practical either.

My final Cut even if this kind bill passes or another bill with more h1's passes we will be

in same situation, the best for us could be this kind of bill with more practicality.

So with our limited resources we will have to do what we can and give all our efforts (Call

your senators) and leave the rest to god.

I tried to mobilize couple of my friends, they are like "No, take it easy this will not

happen" if this is the attitude guys remember you have something in your hands today and if

the bill passes in its current form even if you want to contribute 5000$ to stay in this

country you will not be able to do that as all of us would be packing to go back.

Is this true? Are you just visiting forum just for this and not for your immigration at all? If so, its really bad.

After getting my GC, i visited this forum many times, helped a couple of forum members on how to contact congressman, sent them the draft letter etc on how to approach Ombudsman, congressman etc. I took help from this forum and i will try to return my favor to this forum.

I highly regarded this forum, its core team and its members until "Mumbai attacked" thread was open. I knew that it will be a nasty thread and it will foment hatred towards one particular religion and its followers. And it did cause a lot of damage to members of one particular group including myself.

Core team didn't stop this. They didn't even reminded the rules and regulations of this forum. That led to IV turning into HIV. This is not the right forum to discuss about politics especially war/terrorism etc. I don't know if IV will make it as a policy.

I created this thread just to remind people that there are so many ruthless people/group/organization around the world that kill innocents mercilessly. I didn't create this thread to rally support for any particular group or speak against any particular faith or any particular country.

I could have started this thread when the killing began two weeks back but i didn't. I started this when innocent school kids were massacred using missles and later it was justified. There are still so many heartless/mindless members sitting and supporting/justifying this brutal killing.

Anyway, i'll sign off and i won't post any more message in this thread again.

  • How wonderful that congress is finally introducing constructive bills to prevent 'consultants' mainly (but not only) from India from clogging up the H-1B visa system for honest skilled workers. The H-1B program is clearly intended for people WHO HAVE A SOLID FULL-TIME JOB OFFER AT THE TIME OF FILING THE APPLICATION. The whole body-shopping/visa abuse phenomenon is just disgusting. I wouldn't cry if any and all kinds of 'consultancy' activity were banned from the H-1B program. Someone stated that then they 'might as well lower the cap to 10.000/year'. Obviously not true. This bill clears out the infested issues of people illegally taking up visas on false premises. Good work!

Part of the title of this thread reads 'even H-1 renewal will be impossible'. That is just priceless. No, H-1B renewal will be impossible IF YOU ARE NOT HERE BASED ON HONEST CIRCUMSTANCES. Anyone with trouble renewing H-1Bs after this bill should get a real job or leave if they are not up to that task.

    These are all base-less statements.

H1B program in not just designed for lazy full-time in-house foreign nationals. If an employer who can pay minimum wage (or more) given by DOL, they can recruit H1 and sponsor the visa.

Do you know that 70-80% of H1Bs are on working on Consulting basis to complete the short-term/long-term assignments. They are the bread and butter of US IT business, not the full-time H1bs working in-house, who again takes a consultant to complete his job.

May be some are abusing the law, but you have no right to say all of them are like that. Good and Bad will be there in any field/society/law. So, for that do not blame everybody working in that.

I know several full-time H1Bs working in-house , but depends on outside consultants to do each and every work and they take the salary every month for doing nothing. So, with that i cannot say all full-time H1Bs are lazy and don't update their skills. There are exceptions to everything.

Consultants are not like that, they work hard every hour and get paid just for the time they worked.

Do not start the argument of dividing H1Bs. If you want, goto anti-immigrant sites and join with them. They will ditch you too someday.

    Support IV.

  • Raju, the unemployment is at 4.7%. That is good, but how about earning power and wage increases ? I hear all the time my friends report that they can no longer afford goods and services as they did five or four years ago. There are plenty of evidence that in many sectors wages have dropped or have stagnated. Is that indication of surplus pr shortage of workers ?

Regarding his idea of sending 15 millions of illegals out, that is not absurd. He never told he wanted to do it overnight. A gradual, slow deportation program yes, it would be probably the best way to handle this.

I am sorry if I look negative to you guys, but my goal is to be sincere and honest about facts here.

I think that wages have gone up drastically during the dotcom bubble and you should expect them to flatten for a few years. Also, the economy is coming out from a bust and that accounts to a little stagnation. It is simple man, the world also has to catch up. If you get the same job done for much less in coutries like China, India, Russia and romania, why do you think the wages will go up, unless there is a new technology, that absolutely needs cutting edge skills. This is the way it has been in ht past, this is the way it is in present and will be this way in future. The services and goods you are talking about will become more expensive if you want to send the undocumented workers out. And the wages may not go up that much because companies can get stuff done in other parts of the world. A reporter should talk about two sides of the issue and I have never seen Lou do that. I do not have the time/interest to find the transcripts but he had been offensive about H1s and I heard him say that H1's do not pay taxes, which is a blunder.

  • Folks, it is indeed sad that perfect is turning out to be the enemy of good here, metaphorically speaking.

Surely if the powers-that-maybe turn out to be antagonistic to highly skilled legal foreign workers in this country, it is a given that they are likely to turn this country into a place where none of us ever wanted to be.

America has always been about opportunity for the smart and hard workers regardless of their background. It has attracted people because they saw their future brighter here. Take that away and not much else gets left behind.

I have been in this country for 6 years now and still do not have more than a toehold here despite having put in my tax dollars which in some small fraction have helped pay for what some (who knows) people born here required help with getting. Moreover, if allowed to remain here, my project will yield for this country and the world a device that will help people save their eyesight.

"The highly skilled legal working community is an asset, Mr Obama and Mr Durbin. We carry tremendous calorific value for this country. You will make a smart move by promoting and encouraging what has already been legal in this country of yours: immigration of skilled foreigners.

As you might have noticed, a huge chunk of your support base is made up of young and energetic students and professionals. They are with you only because they trust you to remain sincere to the welfare of this country. Thanks for the data. There is one more twist to the story though. The "median home" of 1940 is NOT the same as the median home of 2000. The home sizes have more than doubled in this period (dont have an official source right now - but look at Google Answers: Historic home sizes (http://answers.google.com/answers/threadview?id=110928) . A little digging should give us an official source if you want.).... So, if the median home prices have doubled post adjustment for inflaton - that really means that the prices have stayed flat adjusted for inflation.

    Statistics is a bitch :-D

Edit: Errrr - the median prices actually quadrupled - and not merely doubled, while the home sizes increased by about 2.3 - 2.4 times. This means roughly 1.6 times actual appreciation - i.e. less than 1% of compounded interest (1% over 60 years = 1.82 times). Compare that to the safest vehicle out there - TIPS and tell me who would have been better off - the guy who bought his home in 1940 or the one who bought TIPS (assuming his net cash flow was zero - i.e. he earned the same as he spent for the house).

Dem majority triggers mixed results for K St. (http://thehill.com/leading-the-news/dem-majority-triggers-mixed-results-for-k-st.-2007-08-15.html) By Jim Snyder and Jeffrey Young | The Hill, August 15, 2007

Patton Boggs appears likely to continue as the reigning king of K Street with a revenue growth of nearly 9 percent, according to mid-year lobbying reports filed to Congress Tuesday.

The law firm earned nearly $19.4 million from lobbying as defined by the Lobbying Disclosure Act, or LDA, for the first half of 2007, versus the $17.8 million it took in during the first six months of 2006. The firm finished first in the revenue race in 2004, 2005 and 2006.

Elsewhere along Washington’s lobbying corridor, though, results were decidedly more mixed. While several firms reported revenue growth, a number have yet to shake off the doldrums of the last half of 2006, when legislative activity dropped off as members left town to campaign for the midterm election.

For example, Cassidy & Associates reported a slight dip in revenues in 2007. It reported $12.3 million for mid-year 2007 versus the $12.6 million the firm reported a year ago.

Van Scoyoc Associates, another big earner, reported flat revenues. Hogan & Hartson, a top 10 earner, reported a slight dip (see chart, P 9).

The LDA numbers were due Tuesday, and several big names did not have their revenue totals ready by press time. These firms include Dutko Worldwide, which generated more than $20 million in lobbying revenues last year.

(The figures will be added to the chart online at thehill.com as they become available.)

The firms that did well attribute their success in part to the new Democratic majorities.

Perhaps the biggest success story so far is Ogilvy Government Relations. The newly bipartisan firm, which was formerly all-Republican and known as the Federalist Group, reported mid-year totals of $12.4 million, versus the $6.8 million it reported for the first six months of 2006.

“We have added talented Democrats that have contributed significant value to our clients and the firm,” said Drew Maloney, a managing director at Ogilvy and a former aide to then-House Majority Whip Tom DeLay (R-Texas).

Although the switch to bipartisan seems to have been a good one, the firm’s success can largely be attributed to one client. Blackstone Group, which is lobbying against a proposed tax hike on private equity firms, has paid Ogilvy $3.74 million so far this year. Blackstone paid Ogilvy just $240,000 for all of 2006.

Akin Gump Strauss Hauer & Feld, a perennial top five earner, also grew. The firm reported mid-year totals of $15.2 million, compared to $13.3 million during the first half of 2006.

Joel Jankowsky, who runs Akin Gump’s policy practice, said Democrats have been good for his firm’s bottom line.

“The change in Congress has increased activity on a variety of issues and that has spawned more work,” Jankowsky said. Akin Gump now counts 186 clients versus the 165 clients it had at the end of last year.

Barbour Griffith & Rogers and K & L Gates’s policy group each also reported a slight growth over their revenue totals of a year ago.

Even firms that did less well were optimistic business was beginning to pick up, even though Democrats have sought to change the cozy relationships between lawmakers and lobbyists through new gift and travel limitations and other rules.

Gregg Hartley, vice chairman and chief operating officer for Cassidy, said the firm’s business was rebounding from a slow 2006.

“I see us on the way back up,” he said.

The Cassidy figure does not include revenues reported by its affiliate, the Rhoads Group, which reported an additional $2.2 million in revenue.

Van Scoyoc Associates, another top five firm, reported Tuesday that it made $12.5 million this year, roughly the same it reported during the comparable period a year ago.

“We held pretty even in a very difficult environment and I would consider that a pretty successful first half,” said Stu Van Scoyoc, president of the firm.

Scandals have made it a difficult political environment for lobbyists and clients have moved cautiously because of uncertainty about new congressional earmarking rules, Van Scoyoc said.

The LDA filings paint only part of the picture of these firms’ performances. Many of the large and mid-sized firms have lucrative lines of business in other areas.

Firms like Patton Boggs and Akin Gump that operate large legal practices are also benefiting from the more active oversight of the Democratic-led Congress, for example.

Democrats have held an estimated 600 oversight and investigation hearings so far, and many clients under the microscope have sought K Street’s counsel.

“The overall congressional activity is through the charts,” said Nick Allard, co-chairman of Patton Boggs’s public policy department.

“Lobbying reports are up, but they are just part of what we do, and underestimate what is probably a historic level of activity in Congress and as such a historic level of representation of clients before Congress,” Allard said.

The investigations also often lead to new legislation, which further drives business to K Street.

The LDA numbers also do not capture work done under the Foreign Agent Registration Act (FARA), which is reported separately. Most public relations and federal marketing work, both of which are growing revenue streams for many firms, are also not reported under LDA.

Cassidy, for example, made an additional $1.4 million from FARA, public relations and federal marketing, Hartley said. Van Scoyoc also will report at least $300,000 in FARA revenue.

Moreover, the LDA itself provides firms with wide latitude in how they define lobbying activities, and thus what revenue must be accounted for in their semiannual filings.

While some firms blamed stagnant revenues on the unfavorable (and, they add, unfair) scrutiny the lobbying industry has received from the Jack Abramoff scandal, most lobbyists don’t see the recently passed lobbying/ethics bill as a threat to their businesses.

Patton Boggs’s Allard, for instance, believes the new rules may benefit firms with legal practices and larger lobbying firms that may be better equipped to manage the intricacies of the new law.

“The need for public policy advocacy doesn’t go away,” he said. Firms that relied on relationships, however, may well be hurt. Potential clients are “are not going to go for the quick fix or silver bullet or glad-handing,” Allard said.

Lobbyists will have to report more frequently. The new law requires filing quarterly rather than semi-annually.

The continued focus on earmarks, though, may eventually hurt firms that have built their practice around appropriations work, said Hartley.

“There is a potential for a dramatic impact on that part of the lobbying industry,” said Hartley.

Cassidy was once just such a firm. Until recently, as much as 70 percent of Cassidy’s lobbying revenue came from appropriations, but a four-year restructuring effort has dropped that figure to 51 percent, Hartley said.

Now 67 percent of new business is tied to non-appropriations work, he added.

The Democratic takeover of Congress also spawned a growth in all-Democratic lobbying firms.

Elmendorf Strategies, founded by Steve Elmendorf, reported revenues of nearly $1.9 million, despite having just three lobbyists. Elmendorf is a former chief of staff to House Minority Leader Richard Gephardt (D-Mo.) and is a sought-after party strategist. His firm is six months old and has 19 clients.

The firm Parven Pomper Schuyler reported revenues of $750,000 in part by targeting business-friendly Blue Dog Democrats. Scott Parven said the firm has 13 clients. It recently signed on to lobby for the Pharmaceutical Research and Manufacturers of America. The contract was not included in its mid-year filing.
