    I raised SR on Aug 12th..No Response Yet...

    Infopass appointment said that my file got assigned to Examination officer on Aug 4th...Not sure if Examination Officer and IO are same or not...

    But the real kicker is i got second FP on July 26th, 2010 for Code 1...I didnt see any LUD after second FP...I am guessing this is where i am stuck with second time name check or back ground check verifications...

    Also is it good to go for DHS 7001 form right way...i mean ombudsman request...

    I will propose that you call USCIS customer service and talk to a 2nd level officer to find out the status of your case.. It doesn't hurt to pursue from this point.

    I am unaware of any concrete proof that contacting Congressman or Ombudsman has actually helped directly...Most of us are just speculating on this.

    I think you need to hear the fact that your case is assigned to an officer..Then it is just a matter of time.

    Non immigrant visa number is the number on your non immigrant visa used to enter the US. Someone posted it is the one in Red - mine appears on the right, towards the bottom. The only other numbr is the control number on my visa

  • Yes, I agree that not filing GC earlier is not an excuse for MBA. The point is he still would have been in the same situation (EB3, 2003 is not too different from EB2, 2005) in terms of how fast he will get his GC..

    It is really better. He can recapture his old eb3 PD after getting approval for eb2 based I-140 for the manager job.

    Law provides equal opportunity to everyone for PD recapture. This is my point.

    And, for those who are going to argue that no one is going to file GC for him in 2003, this is not a valid legal arguement. Granted, it may be a emotional one.

    On a related note, how many people REALLY agree that GC is for the future job? But they never dispute that in court of law because it does not hurt their case. Anything that hurts their GC cause makes them victim and root cause for gaming the system.

  • Seems like there might be an internal memo or understanding between USCIS and DOS not to approve many Eb2 India 485 even though there dates are current, this is the only explanation I can come up for the lack for eb2 india approvals in October. Even with the limited number of visas every quarter I was hoping there would be lot of approvals because of Visa spillover occuring every quarter instead of once every year, but looking at the USCIS performance in the first week of october it seems like there wont be any quarterly spillover at all.

    Even if quarterly spillover happens, it will happen in Dec - that's what I think - correct me if I am wrong.

    I anticipated monthly EB2-I to be finished in two business days - more or less it appears to be (200 odds is a small number for India). Now I am waiting for prioirty dates - whether they show +ve movement and next month for approvals.

  • You can put any clauses in the contract as long as they are legal and the renter accepts it. But as 'albertpinto' said, beware of the people with bad credit and bankruptcy or people going through divorces - you may not want to rent them your property as it is very difficult to remove somebody (yes, even from your own house); it can take anywhere between 3 to 6 months and in the meantime, you are still liable to pay the mortgage if your renter defaults.

    IMO, Only rent to people with good credit history.

    Cant we put all these conditions in the contract? No modification to the house..only one family allowed..unless you want to rent it to bachelors and then charge whatever amount from each person and limit their number in the house..
    Contracting agencies do not assure if they will put the house on rent. they say they will find someone.. and how long it takes, they are not sure..

    Employment-based immigrants contribute greatly to America, although you would not know it from the way current U.S. policy treats them. Due to low quotas, a typical skilled immigrant sponsored by an American company now waits 6 to 10 years for a green card (permanent residence). The House Judiciary Committee marks up legislation this week to change that, representing likely the only measure Congress may take in the remaining weeks to aid innovation, the economy and the competitiveness of U.S. companies.

    H.R. 5882, authored by Rep. Zoe Lofgren (D-CA) and Rep. Jim Sensenbrenner (R-WI), would reduce wait times for green cards and help retain talented people in the United States. It would do this by providing green cards that had been allotted in previous years but went unused, primarily due to bureaucratic obstacles.

    �A developed country�s competitiveness now comes primarily from its capacity to innovate � the ability to create the new products and services that people want,� according to Curtis Carlson of the Silicon Valley research firm SRI International. Skilled immigrants are a vital source of America�s capacity to innovate.

    The National Venture Capital Association reports that 1 in 4 publicly-trade companies that began with venture capital since 1990 had at least one immigrant founder. While the vast majority of employees at U.S. firms are Americans, when U.S. employers recruit on college campuses they find foreign nationals represent a high proportion of the graduates in key fields. In 2006, 73% of new electrical engineering Ph.D.s in the U.S. were granted to international students, according to the National Science Foundation, while in 2005, foreign nationals received 55 percent of electrical engineering master�s degrees and 42 percent of computer science master�s degrees.

    H-1B temporary visas, which have been exhausted each of the past 5 fiscal years, only allow individuals to stay on a temporary basis, so an employment-based green card is necessary to stay here permanently. The separate quota for green cards for skilled immigrants is set at 140,000 a year (including dependents of the skilled immigrant). That quota has also been insufficient to meet demand, creating waits of 6 to 10 years for a green card.

    The great uncertainty these waits create lead some to give up and leave the United States and others to not even begin the process. The current long waits �cause a reverse brain drain affecting American competitiveness and innovation,� according to Aman Kapoor, executive director of the group Immigration Voice. �At the same time, these green card backlogs create severe quality of life issues for the applicants and their families.�

    Those who understand markets realize that there is no such thing as a fixed number of jobs, as critics of high skill immigration maintain. A 2008 National Foundation for American Policy (NFAP) study found that for every skilled foreign national requested (for H-1B visas) with the Department of Labor, U.S. technology companies increase their employment by 5 workers. Many U.S. executives confirm this experience at their firms. Looking to America�s next generation of scientists and engineers, a 2004 NFAP study found more than half of the finalists for the Intel Science Talent Search, the leading contest for top U.S. high school science students, were the children of skilled immigrants.

    In addition to the reduced waiting times for green cards from H.R. 5882, Congress can take other steps. It can fix the labor certification process for skilled immigrants under which the U.S. Department of Labor (DOL) requires companies to engage in expensive and time-consuming advertisements to show no qualified Americans are available for certain jobs. Neither the law nor the original DOL regulations required such advertisements. Yet DOL is using its questionable authority to, among other things, audit thousands of green card cases from the nation�s largest immigration law firm, Fragomen, Del Rey, Bernsen & Loewy. The Fragomen firm has filed a lawsuit in U.S. District Court alleging DOL has exceeded its authority. Congressional oversight is warranted.
    Congress can also eliminate the per country limit for skilled immigrants, which pushes back wait times for Indian and Chinese professionals, exempt from green card quotas those who earn a master�s degree or higher, and increase the quotas for H-1B temporary visas.

    While H.R. 5882 will not solve all our immigration problems, it represents an important effort to retain talented individuals in America so they can help create jobs and innovation in the United States.

    For those who don't know, the first three letters of the receipt number in you I-797 H-1b approval notice indicates the service center.

    Like SRC is Texas, EAC is Vermont, LIN is nebraska and CSC for california.

  • The point was about abusing the system to get ahead in the line. In that way labor sub shares similarity with PD porting. If a person who landed yesterday fits the job profile and the law allowed it , then what's wrong.

    On the other hand if those labor are sold for a price then it is serious problem. And thats why Lab Sub was eleminated. Now thats what is going to happen (and happening) in PD porting case.

    any action should be against the so called "paid PD porting" cases. But why harm a honest EB3 person switching companies to go up the ladder? If he is getting the benefit of the rule, what is wrong? As long he it is done by the law, I do not see any problem.

    Tomorrow, if you get a position that justifies EB1 category for you, would you not move to that category? Nothing wrong in that either.

    I endorse Pappu's comments. Wrong doers can be punished. But people benefiting by a certain rule should not be.

    I support your view. Let this punjabi guy go into foreclosure and screw up his credit history and suffer for the next 7 to 14 years. Its not just him, his entire family will suffer because of this.

    Those who oppose the foreclosure, i think you guys are indirectly helping this punjabi guy. He has good job, good salary and he is capable of paying his monthly mortgage and he and his family are sleeping without any issue right now. If he is not going into foreclosure then how do you think this guy will suffer for the next 7 to 14 years?

    I know foreclosure is not bad and its not against law. But who should seek foreclosure? Is it not for people who are really really in deep trouble?

    Even i own a house and i don't live there because of my job situation. I have rented out my house. I live 700 miles away from my own house. My house value has dropped and i owe more than the house value. But i have job and i am capable of making my payments. Do you think i am eligible to go for foreclosure? Not really.

    Note: I know a friend who lost his job back in 2001 and couldn't pay his car loan(he could've paid). It was about $5000 and it ultimately screwed up his credit history. He got into a good paying job after a year and he wanted to buy a house back in 2002-2003 period. He was not able to get any loan including credit cards. His friend had to co-sign for him to get into an apartment. He is still repenting his decision of not paying off that loan. Recently he got a car loan at the rate of 12%.

    Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
    Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??

    Please try to understand their problem.
    Also India is the great. Why don't you guys just think that India is your home country where you are born and brought up. Why you people can't just wait and watch?? If nothing happens to the so called GC, then why don't you think to pack up and go back to India???????

  • Also, take a point to note that after August 2007, the overall volume has decreased drastically. Economy was good from Sept. 2007 to Aug. 2008, but still countries who were current, did not file as amany EB1s and EB2s compared to previous years.

    Also, another point to note is that government came out with this data at this moment, because this will instill a ray of hope in every EB individual on their future prospects due to reduced filing from Sept. 2008 onwards.

    If, the government came out with the same data, one year back, we would be VERY depresssed, won't we?

    So, there is a ray of light at the end of the tunnel.

    I think one common mistake that is being made everywhere on this board since the USCIS data got out is to make assumptions on demand. We are only being shown data which shows pending applications from USCIS. If USCIS releases data of how much demand by priority date they were getting then its a different thing. When you say , Economy was good from Sept. 2007 to Aug. 2008, but still countries who were current, did not file as amany EB1s and EB2s compared to previous years. are you basing that on this data released by USCIS or on something else. Because if you are then you are probably wrong. This data only tells you pending data as of Aug 2009 by priority dates. It could well be the case that USCIS got a lot of volume from Sep 2007 to Aug 2008 and processed them all and hence pending is less now. Hope you understand. The only way you can do it with some degree of success with current public data is by looking at PERM Filing data.

    Can anyone share their expert views on this scenario.

    Say, I have approved I-140 (current PD) from employer A (never worked with). Work with employer B in a different. Now if employer A applies for I-485 and after it is pending for 6 months, Can I invoke AC21 to continue the GC process while still with employer B ?

    Also is it possible to have 2 separate I-485 filed from different employers.

    I have heard the above is possible. But, I am curious as to how AC21 is interpreted. Isn't AC21 essentially an instrument to change jobs without hampering the GC process. In this case since one is not 'really switching jobs' how will this be treated or possible ?

    If you look at the profile of the members who voted yes in this poll. They all have EB2 PD from June 2006 to 2007 except one or two. These guys will never understand the wait of a 2001 or 2002 filer. They dont know what it means to wait in limbo for years.
