  • Even my 140 was filed with CP. My PD was current last month. I filed my 485 (AOS) last week. As per my attorney if CP is specified in your 140, you have 2 options. You can file CP or AOS. You can just file for AOS. No need to convert. But AOS is speicifed in your 140 and want to convert to CP. Thank you need to file some form.

    Hopefully from October 2010 the date stay as it is. Did you checked the cut off data it does show 0 requirement prior to 2006.

    What is your take on all these bills.. I am sure you have much more info. Do you see any hope of EB relief in 2009?
    There is growing pessimism in EB community.




    I ran these through my program but it is returning NULL.
    I guess each object needs to have a voting property or Lobby class attached to it. Without that you will only get Null values in return.

    I need your advice here. Six month ago i joined one of the many blood suckers -Desi cosulting company in new jersey. As you all know, they ask me to sign their contract in which its mention that if i leave their company before 1 year then i need to pay them 15k. Thy also charge me 3k for my H1-B which i am still paying everymonth from my paycheck and we have 70/30. In just six months i am so much fed up with them. These people are so rude...always show their arrogance over phone. I have no libarity to find job by myself. They always looking for higher pay rate sp that their big money tummy get filled up.and i also feel that they didnt told me the right pay rate for the project i am working on right now.


    I really want to leave them, Even before 12 months. Is there any importance of that contract letter i signed with them?. Can they Sue me? What are my options? Please suggest me.....i am in stress.

  • :confused:I am in same situtation. I want to reenter on AP and continue on H1-B. Can I do that? My company says its their policy that once I use AP to enter I will have to switch from H1-B to EAD. I dont want to do that. Can I still continue on H1-B?

    I intend to travel to my home country I have H1 (not stamped but valid till 2010) working for the same sponsor if I use AP to enter US do I lose my H1 status.I have EAD but did not use it.

  • I am planning to file EAD/AP for my wife who is on H4 along with adjustment of status application. Will she continue on her H4 status till she gets EAD/AP?
    She will continue on H4 status until she uses EAD (by filing I-9 with an employer when she starts working). At that point, her H4 is automatically invalid and she is then on EAD. Until then she can be on H4. Same rule applies to H1.

  • Since you have negotiated 70:30 before joining, you must have agreed to paying H1b Fee. And yours is an H1 transfer and you new how this business works and signed the contract!

    If you say we are paing taxes so we should get greencard. That does not make sense. We are using roads, hospitals, infrastucture of this country and we pay taxes as long we live here.

    If you say we invent new things, start Google etc then these people qualify for EB1 and it is always current.

    If you say we have USA masters then we can apply in EB2. EB2 will get current next year or its wait time is going to decrease and will be 2 years max. So 2 years or less is a reasonable processing time within a 6 year H1B processing time.

    I am playing devils advocate here and trying to tell you to think beyond pleading. We did not come to this country to plead. Once you start thinking negative there are many negatives as I have written above and you will go in depression.

    Who is stopping you from Meeting lawmakers? Have you done that?
    Who is stopping you from contacting media? Have you done that?
    Who is stopping you from contacting your CEO of the company and ask for help? Have you done that.
    Who is stopping you from contacting organizations of Indian American citizens and ask for help?
    Who is stopping you to do rallies everymonth on weekend in every state. Why are we not doing it if we are so depressed with Greencard.
    Who is stopping you from contributing to IV?
    Who is stopping us from doing lobby days in DC once every month?

    Why can't we do. I have tried to do at least one item in this list. If we all at least pick one item, it will be enough.

    Thanks this is useful information. Also I am planning to continue in my H1 status as per company policy they allow EAD/AP only for spouse and not the employee. In future, will I be able to file EAD/AP for myself separately or does this need to be done with 485 filing? In future if I decide to file EAD/AP can I do this myself or would I need my employer for this?

    In fact the idea of the banner with 'Waiting for X years' is fantastic ..
    That would be an amazing sight where everyone holds placards that say since when they have been waiting.
    If it's even 400 people .. we have 400 people saying look we've been waiting since 5,7 or 9 years.

    It's also important to get in heavyweights like either local folks like Google HR head or any public face. Google has always supported the Immigration issues .. since they have problems because they couldn't hire folks when the h1 lottery happenned.

  • And always send via USPS express mail. (1 day costed me $18) but I came to know instantly the next day that they received it.
    You could also use some cheaper USPS option. as long as it has some delivery confirmation.
    The reason I like express mail one day, is because u can request a copy of the receiver's signature via email (comes in a PDF). This is proof that USCIS really got it and u can then sleep nicely for the next 3 months.

  • As if things weren't enough complex, today my friend told me one more thing about finger prints. His PD is 2004 Sep EB2, so he called USCIS to know the status of his application. Then they told him that his finger prints got expired (as per them they expire after every 15 months). So they will invoke the notice to get him an appointment for finger prints. They also mentioned if finger prints have expired then they can't process the application unless it gets renewed.

    Although this is first hand information, I was very surprised and not sure whether or not to believe the information given by USCIS call center.
