Supporting the bill is a win win for everyone in EB wait.

It's a well documented point that face-to-face meetings have the best chance of influencing lawmaker decisions [based on survey of Congressmen offices]. Letters come next and E-mails with addresses come the last. E-mail by anonymous senders are ignored. Hence the insistence on more face-to-face meetings.
If you don't know it already (which I doubt), sending a large number of anonymous E-mails, and making a large number anonymous posts in any forum is considered SPAMMING. IV will never participate or encourage such SPAMMING activities which will harm it's reputation (and don't help the cause too!)
If you think President is too busy to read our letters, why do you assume Bernanke is having all the time in the world to read anonymous E-mails and letters? He should be super-busy monitoring the BAD economic situation.

However, keep in mind that the swing will reverse soon, and dates will move back once we reach the end of the year (oct). PDs will be swinging wildly back and forth , like a pendulum, from now on. But don't count on it helping you. It's like a lottery. You may get it, or miss it. Until visa numbers are increased ,a large number of us, unfortunately, will continue to be stuck in the backlog and will be motivated to participate (once we have missed it for 2-3 years, we definitely will be more appreciative and more active).
No need to make melodramatic statements like these "people who oppose an idea(and take extra effort to shoot it down) are much worse than those who do nothing ". Nobody here is stopping you or others from doing what you deem right. We are just "suggesting" that it's not a good idea. You are free to ignore our suggestions, and do whatever you like. first of all a big THANKS !! for doing the above. so basically we come to the earlier point - if there are not enough dedicated members (due to laziness, family priorities etc etc) then we can try the next thing i.e. send letters / emails to whoever cares to read them and pray that something happens.
as of now (and in my knowledge) IV is only sending letters to the President - who is obviously a busy man and maybe the letters dont even reach him.
and hence maybe IV should start campaigns to send emails / letters to other important people (Ben, Paulson, Realtors association etc etc ) and hope that the word reaches important people.
there is bit of urgency too ..as EB2 (I) and world start to advance ..you will get less volunteers (who take the effort to write and email)... let alone people who will take a day off to meet congressmen.
maybe people can just send emails or post messages related to legal immigration on websites which have articles on housing, economy etc ..what is needed is leadership at top to direct people (rather than concentrating on one campaign only)

Not appeal but rather re-filing as a fresh 140. The labor doesn't expire as long as you had filed an i-140 in the past when the labor was valid.

My wife got approval notice from 10/01/2006. Her employer is willing to give paystubs from March 2007. Will this put her back in status so that she can file I-485?
We are planning to resign after she file I-485 at July end and apply for COS with 2 paystubs. Will this cause a problem or is it legal?

I read from a different post that you can file for AOS if you are out of status for less than 180 days. there is a section 245(k) which allows you to do this. I don't know the accuracy of this info.

I know personally only those who doesnt charge. One of the consultants I know strives to differentiate himself from these. He provides benefits like in a large company.

Just because somebody is ready to do some work for less, legally, you should not be worried too much. Instead of worrying about billing, try to upgrade yourselves to become better in skills, capabilities etc...your market value will automatically be upheld if not become more. Being an L1B myself, I dont see any single day I felt like I was abused or I am cheated by my company.

- It does not matter if the person has other seemingly valid visa stamps on his/her passport.
- The only highly-skilled dual intent visas that allow one to work, are the H1 and the L1, as far as I am aware of. Dependent visas do not allow one to work, such as H4 or L2. The only way one can work while being a dependent is if one has an EAD based on a pending AOS(I-485).
- If one is on a H1/L1 and wants to switch to say a dependent visa (H4 or L2), one has to submit a change of status form (I-539?). The person is assumed to be in "authorized status" until the change of status (or even an extension) occurs. If the COS or extension gets denied, the person is retroactively "out of status" from the original date of expiration on the previous visa.
- Accruing over 180 days will entail a bar of 3 years for re-entry after the person leaves the US.
- Accruing over 365 days will entail a bar of 10 years for re-entry after the person leaves the US.

- If the home consulate approves the said individual's visa renewal or new visa stamping, that individual can enter the US, however, there is lack of clarity on whether such a person will be finally able to "adjust status" to become a lawful permanent resident.

I logged in this morning to get a regular update and came across this thread.
I am surprised to this discussion and the heated debate. Tides and Ebbs are a part of what we do. I think we must all be satisfied that we have IV to represent us. Think about it guys, we would have no voice if it were not for IV. I sincerely hope something comes out of all this efforts that all of us have put in. We have a good thing going here and lets not stop.
Even if nothing happens, I will be content that we have made efforts. Not just a tiny efforts but a big ones. Kudos to everyone who is contributing ideas and money. Keep the good work going and let us know what we have to do to help you all.

I have followed it up with AILF and 3 more attorneys just in case to see if a law suit is feasible. All of them said, it is not possible. Only option left is to write to Dept. of Justice to see if this law holds a constitutional test. I wrote once, but never got any reply on that.
But if we could take this as a group and mobilise on a mass scale to reach out to DOJ and have them review this INA law we might get attention.
Couple of points to Nay sayers.. that this is not racial descrimination
INA even though uses country of birth instead of color of skin It is still considered raical because, Under the same INA, if someone is born in a retro. country and their parents are not from that country, One could use parents country of birth.
So if a family from UK on a business to India gave birth to a child, this child is not subjected to India limits. Which means this applies only to natives from India.
I tried explaining this in my writing to DOJ. But one letter didn't do the job required.
