  • Thanks just4gc for giving me the coveted vdlrao post. I must say the ages spent analysing Visa bulletins statistics and congressional testimonials of Charles Oppenhiem have finally borne fruit ;).

    I guess Illusions beat me to the prediction. I must confess I havent spent a lot of time looking at Eb3 ROW. But even then I was surprised when it stayed at May 05 for as long as it did. The Backlog Reduction Centre stuck labor, the horizontal spillover, the Eb2 India backlog are few factors for why I was surprised.

    I would say dont lose hope on Eb3 ROW, but until Eb2 India backlog stays it will be slow movement except as illusions pointed out in july 09. Last VB mentioned 60% of the demand recieved is before jan 2004. Thats pointing to the older BRC cases which are now seeing the end of the tunnel. fingers crossed.

    I am joining with Tek systems and they don't give as permanent position in offer letter rather just said contractor.. but I am full time with my current employer.

    Do you think its going to be any problem from changing Full time to Contractor?

    AC21 letter - wording is very important - the offer MUST be Permanant fulltime and the prospects for future employment must also be good - this is exactly what they request in a RFE or a NOID.

    If your letter says it is temporary position, you will have issues.

    I just wrote an email to the editors with the email address provided by walking_dude. My email says this:

    Dear Editor

    You mention in an article dated today that "HIGH-TECH EMPLOYERS get lift from House Republican letter to Speaker Pelosi urging passage of immigration bill to help "attract and retain" high-skilled workers". And in the same breath you say that "In a poll 56% of Republicans earning more than $75,000 annually would "strongly" or "partially" agree with candidate who would bar illegal immigrants from path to citizenship." Do you know the difference between highly skilled legal immigrants and illegal immigrants?. Why do you have to imply that all highly skilled are illegal, infact 99.99% of highly skilled workers (Tech workers) came to the USA legally and continue to live legally. They are here at the behest of their employers.
    So please correct your article to reflect that.

    I don't think they mean to say that High tech workers are illegal. They say that their poll indicates Republican voters who earn more than $75000 would like a candidate who opposes illegal immigration. Atleast, that is the way I read it.

    They have to say they oppose illegal immigration because it is the WSJ. Republicans read it and they like bashing the illegals and it increases circulation.

  • I have traveled out of the country 4 times since my last and only FP on 10/4/07. I had LUD on 10/4/ 07 because of this and have not heard anything from USCIS. I hope they still have my file somewhere in their warehouse.

    The latest rumor is they opened a new warehouse in Guantanamo Bay :) after BO decided to close it for detainees.

    That's encouraging! I have lot more hurdles than the Bsc + MCA issue. My employer had filed my GC in EB3 and is now willing to refile under EB2, since I was promoted to a senior role. The company attorney though is hesitating to file under EB2, his reasons are as follows:

    1. 3 + 3 degree will not be approved under EB2. ( This is in response to my question about using my Bsc + MCA. My current role requires Master's degree or Bachelor's + exp. I do not want to use the experience (9 years) gained from my current employer. So I suggested we could use my master's degree + 4+ years of experience that I have before joining my current employer. )

    2. Attorney thinks Software Engineer role (EB3) and Principal Software Engineer role (EB2) are not 50% different. I agree that it is not 50% different. But my question to him was - "Does it (new role) have to be 50% different even if I don;t use the experience gained from the current employer". Haven't heard back from him yet.

    My wife's EAD was also pending for about 4 months. At infopass, officer said we have to wait. He asked to check back in 10 days.
    Within 2 days, status changed to "card production ordered". Before, we had sent expedite request also.

    - Labor was filed with a minimum requirement as Masters degree. No alternate degree requirement or equivalency was mentioned. --> just found out that it did say BS+ 5 exp is ok - USCIS mistakenly approved the I-140 (I am assuming OP does not have a US Masters and only has masters equivalent or BS + 5 yrs)
    - Sponsoring employer revoked approved I-140
    - USCIS checked the I-140 and realized it made a mistake in initial I-140 approval
    - USCIS denied the pending I-485 based on incorrect I-140 approval

    If all of the above is correct, then I doubt if anything can be done. I dont see any grounds to file MTR based on the fact that beneficiary does not have a US Masters degree which is the requirement as indicated in LC filing. I dont think you can do anything with respect to USCIS's mistake in approving I-140 earlier and now denying it. Got to wait and see what the attorney's view is in this regard.

    Since the application do say BS+5 years and I have copy of the Edu evaluation which says Master equivalent , I do see a good chance now to re-open the case .

    Mine is not a labor substitute. ( just to clarify)

    That one phrase in your LC requirement could turn out to be a life saver for you. Can you further clarify the educational/experience requirements mentioned in LC. Was it Masters or equivalent with zero experience OR Bachelors with 5 yrs of progressive experience? Your educational evaluation should meet atleast one of the requirements mentioned in the LC. Either Masters or Bachelors + 5 yrs exp. I think for your educational background (non 4 yr BS degree), I feel more comfortable with getting the evaluation done to satisfy the BS + 5 yrs requirement rather than going for Masters equivalent. NSC is known to be strict w.r.t 3 yr BS degree when it comes to EB-2 cases. However, since your initial evaluation showed you as holding a masters equivalent, I am not sure if its a good idea now to try to defend your case with BS + 5 yrs equivalence. A good attorney would be able to guide you through with this. I also suggest you to consult any reputed attorney regarding this and get feedback on your company attorney's plans and not just blindly follow what your company attorney says.
