Why would any US citizen want to become an Indian citizen while the whole world is dying to become a US citizen? I think this has to do something with parents trying to save money by not paying Indian Visa fees.
In anycase the law is right - once the kid is 18 and able to make a decision...let him/her decide at that point if they want to renounce US citizenship for Indian citizenship. Parents should not be able to make that decision for them. :mad:

Think of it this way. Conservative estimations say that in the recent application rush, USCIS received 300K applications.
That is 2 year's worth of applications alone, not including those already at USCIS.
If you compound that with the asinine 7% country limit, and assume that there are MUCH more than 7% of that 300K from Indian nationality - I'd say you are looking at much longer than a 3 year wait on average. I'd guestimate 7 years.
The only way this will change is to support the DC rally. We are getting major traction and positive news on this and it's potential affects. Please do everything you can to come.

I dont think USCIS is thinking that way. They are just picking a stack of application ( mix of all EB1 2 3 for all nationalities) and validating the applications to see if anything is missing or if there are potential reasons to deny it. If they can deny it they will do it promptly and that is one less case to be shown as pending. If they need additional info they will issue RFE and get updates. If they feel satisfied they can pre-adjudicate application and claim that count in their yearly review as acheivement.
Preadjudication is done to maximize visa utilization and avoid rapid movement of dates. DOS moved dates in July 2007 to maximize visa utilization keeping CP applicants in mind, but did not have a count of AOS applicants.

But let's face reality for a moment - as several senior members routinely point out, inspite of our organization having several thousand "highly paid" members, the "donor" base is very limited. As Zen says in a truly Zen manner "we are where we are"...and we have to figure out where to go from here. Unquestionably, I am really thankful to our highly dedicated Core team for sacrificing their personal time and making all of the efforts that have led to substantial progress over the last few years for the immigration community. However,, that with a new government in place, we now have a truly unique window of opportunity to make some progress and the question before us is how do we maximize our potential to take advantage of this? The real beauty of my proposal is that we could leverage the enormous dedication of the core team and multiply it several fold, if we could build a strong donor base that provides us the funding required to engage effective lobbyists. Needless to say the more the funding, the stronger can be our lobbying.

The way IV has currently implemented this process, of course, is through the local chapters. However, their current process is subject to lack of consistency (depending very heavily on the availability of the local chapter coordinators) and more importantly, does not take advantage of the tool that really enables us to all come together i.e. the internet. It is a paradox that an organization founded on the net and is still subjecting itself to the constraints of "physical communication" via the local chapters. I thought they were taking a step in right direction with the creation of the "Donor Forum", however, for some reason, we still seem stuck in the previous mode of operation. We can find a middle ground here that would not compromise confidentiality or our goals - one alternative (certainly not the only one I am sure) is quite simply, email updates compiled by one person (for consistency and uniform direction) that go out a distribution group, where the "donors" on the distribution list, have been vetted by the local chapter coordinators. I know this takes work, but if the Core is looking for a person to pull together a Conference Call to compile this update and send it out, I would be glad to volunteer my services.

The only thing you might end up with is x number of YES and hope to translate the YES into more dollar value for IV and there will be some YES who are already contributing monetarily.

In reality though, everyone who has viewed this thread (1563 views when I last checked - even if you assume each person has checked this thread at least 10 times, that's about 156 individuals out of whom only about 35 have voted so far!) and not bothered to vote is essentially voting "No"! However, again as you point out, I am not really looking for the "No"s since these people have clearly decided they don't want to part with their money at this stage (not ascribing any reasons or motives here - just stating the facts). Instead, my focus is on coalescing a group around those who voted "Yes" since they, like me, agree that they would contribute more if they received more regular updates of what is going on. Our organization just needs a little more "organization" (pun, intended :p) to make it more effective! Again, just reality but that is also the usual natural evolution of most organizations that start out as pure grassroots organizations.
I really do believe there are substantial number of folks out there who can be engaged more effectively in this process and I invite the Core Leadership team to put more thought in figuring out how to achieve this - I hope you take my suggestion constructively!

I have Labor and 140 cleared under EB3 (worldwide) and waiting for 485 to file. PD is December 2005. I am software developer/engineer
I asked my company lawyer to file for EB2 since EB2 is current. This is what their response is.
"DOL has come up with what they consider to be job classifications and separated those into the job zones. There are very few which make it to zone 5 and they include such things as surgeons, lawyers, physicists and the like, in other words highly specialized positions requiring a higher than normal education path and many years experience. There are no computer related positions listed under Job Zone 5. All our positions fall under Job Zone 4 which does not lend itself to EB2 filing. We can�t file under EB2 due to DOL restrictions to minimum requirements for positions."

I've been having similar thoughts for quite some time. Whether I should move back to india which is a one way street or continue here waiting to get my GC, citizenship etc.
Here is my analysis of the situation without considering the emotional parameters involved
1) India is currently on a fast track to development thanks for the IT industry. There are a lot of jobs and salaries are sky rocketting. A lot of people in India are living a life in India which we can only dream of here in the US.
2) BUT I also read about the growing cost of conducting business in India. Definitely with salaries increasing by leaps and bounds, rupee appreciating against the dollar, high taxes and infrastucture cost has already got companies thinking about their businesses in India.
3) Many are thinking of moving to southeast asian countries like Singapore, malaysia, phillipines, even China.
4) Even if they dont move out I am not sure if the current trend in salaries will continue. It will definitely correct itself in next 3-4 years. Companies would tend to hire more fresh graduates than hiring experienced personnel.
4) I am not sure with all these developments how would things be in India in next few years. If I move to india and then have to move to these south east asian countries then why not be in US and ride out this turbulent period.
but then if you include the emotional factors in this equation it totally changes everything.
As of now at least I am confused about what to do but I guess every first generation that moves out of their home town has to go through the same thought process, only the immigration to US is complicating things further.

llc and s-corp are same for the situation you brought up... however, you gotta be mindful of the "corporate veil"... http://en.wikipedia.org/wiki/Piercing_the_corporate_veil trap... which can affect any company llc or corp... dont worry, there is nothing bad in it... just make sure that you keep real good records and separate business operations from personal...
further i doubt that s-corp or corp is a promotion over llc as your post seems to suggest...

the problem is the employers. employee's loss is employer's gain. it is simple enough. if the point based immigrant is allowed in with a EAD or a green card (like in canada/australia), the employers lose out big time.

When I called TSC this morning, the automated voice gave the good news - our GC were finally approved on 11/4 after a 7 year wait. Online case update shows the approval, but 140 status still says received and pending.

It is risk that every person takes....If you are EB3 and have not applied for GC yet, I would NOT buy a house....This would be a High Risk investment
