  • Are Young College Grads Too Lazy to Work? (http://economix.blogs.nytimes.com/2011/05/19/are-young-college-grads-too-lazy-to-work/) By CATHERINE RAMPELL | New York Times

Ive received a lot of passionate (and angry) e-mails in response to my article (http://www.nytimes.com/2011/05/19/business/economy/19grads.html) today on the employment fate of recent college graduates. While the messages from young people almost uniformly expressed frustration at the job market theyd been thrust into, some of the e-mails from older readers argued that todays college graduates were having trouble finding jobs because they hadnt worked hard enough. For example, a reader named Norman Berger asks why graduates wonder why they prove worthless to a potential employer when they follow this approach:

Take soft subjects, be lulled into complacency by grade inflation, have teachers who are tenured and dont care how rigorously you think, start partying on Wednesdays, take 3-4 courses per semester/quarter and spend 5-6 years to graduate, study six hours per week (at best), believe in all of the liberal causes which produce soft qualative rather than quantative thinking, learn to hate the capitalistic system, dont care when you get out of school that youll still be living at home, etc

As weve written before, todays college students do indeed spend less time studying (http://papers.nber.org/papers/w15954), and get higher grades, than their counterparts from a generation ago did. And most young graduates are leaning heavily on their family for financial support. More than one in five are living with their parents or other relatives, and many are getting help from family members for other expenses, as shown in the chart below.

But todays college students also have spent a lot of time working, well before graduation.

Sixty percent of the graduates of the college classes of 2006 through 2010 said they held a part-time job while enrolled in school, not including jobs held during the summer or between semesters. Another 23 percent said they were working full time or both full and part time during school, according to a new study released by Rutgers.

For 44 percent of students, work or personal savings helped finance their schooling.

Based on the finding that young people overwhelmingly were working in college, I dont think this is a generation of slackers, said Carl Van Horn, a labor economist at Rutgers and co-author of the study. This image of the kid who goes off and skis in Colorado, I dont think thats the correct image. Todays young people are very focused on trying to work hard and to get ahead.

  • Well I tend to go by the facts:

Bill Clinton was good for immigration , everyone was happy in his days

Eversince GW Bush took over, the USCIS has been consistently hitting below the belt to immigrant communities , right from Sep-11-2001. Not one thing was done for overall improvement in GC process. By this I mean congressional laws.

Another reason I worry about is that McCains advisors are in favor of H1 visa. At no point they mention that they will also support GCs for EB immigrants. This means if he comes to power, there will be high influx of H1Bs without anyone gettting GCs. This seems to be worse than what Obama is planning to do. Maybe a few of us will have to leave in Obamas policy but those who remain here will be better placed. Under McCains policy, there will be a huge pressure on wages by H1B competing against other H1B while there is no reform in GC process. These ladies Carly Fiorina, Meg Whitman are big time in favor of H1 visa so as "to bring down salaries" and so that "they' can make more money. This is their only rationale in supporting H1s. I am not against H1s but the GC process also needs to be fixed. If GC process is not fixed more H1s is not only detrimental to us but also to the newcomers.

Also when we try to get HR5882, the people like Steve King and Lamar Smith come from republican party. McCain is less likely to have any leverage on these individuals even if he comes to power. All of a sudden they can not change their stance on immigration. Another senator in the same bucket is Jeff Sessions.

You guys tell me, should we be more worried about Jeff Sessions and Steve King or Dick Durbin? It seems that Dick Durbin is picking on Indian offshoring companies but nothing to indicate that he is against immigration in general.

Here is a recommended motto for our currency(in replacement of "Satyamev Jayate")

    One Side : "Chalta Hain"

Other Side : "Khao Khujao , Batti Buzao"

Let's move on ( yes, that's the only option with any breed of politicians that may come to power in India).

Then check. Context is everything sometimes.

I checked, everything I said before, I stand by it.

There was no point, I said I did not believe it. I was showing the original poster that using a large black brush to tar a whole group of people is offensive and inappropriate. At least read my whole post before responding. I see I hit a nerve though. So it's ok for you t claim that EB2 means nothing and is ill gotten but not ok for me to talk about EB3?

So, I used your black brush to paint over your argument to the argument you claim to resolve. You should expect that, when you try to sling mud on others, you should be ready to get some mud on you too. You cant go complaining when you get the taste of your own medicine.

Bull crap. Don't make me open my mouth anout labor my friens. best we don't open this up.

Again you seem to be implying that we are getting our labor for free (or that we dont deserve it)... Can you say why? Agreed there are some (a lot?) who use loopholes etc, but then that is not restricted to EB3s alone.

I'm not in IT. the more I hear IT folks go at each other, the less I think of the field frankly. And yes, i do not know about you but I met several people who came in the tech boom, whose jobs a monkey could do. Sorry, just the truth.

I am not in IT either. I am into software research, but IT folks do the work that requires skills. In your home environment, you can slap-on machines and routers etc. and it works because you dont need performance, and because some IT and some developer sat together to bring out a product that was easy to use. In production environment, you need to support 1000s of "consumers". Performance reliability etc. is the key, and it takes a lot skills to manage. I am fairly skilled when it comes to computers, but still I will not match most of the IT folks that work in my company.

If monkeys could really do the job, and the managers hired humans, probably, the company was being managed by monkeys.

  • The palestine problem was created by British people without considering Palestian's approval for the same. What palestinians are asking is their legitimate right. So Hamas is not the first party to blame for palestinian's problem. But Britain is the first person.

You can blame Hamas for wrong approach to the problem which aggravated the problem in such a way that it can not be solved. Also due to Hamas, Palestinians are suffering like anything. God bless all innocent people who suffers.

British essentially turned over the issue to UN and pulled out of that region after second world war. As a conquering nation, Britain will certainly get some blame for almost all world issues of 20th century (like Indo-Pakistan division and aftermath).

In fact there was Israeli Irgun which was more like Hamas during formation of Israel. These activities stopped once state of Israel is formed. Perhaps same thing might have happened with Palestine as well. Isreal was willing to yield some areas for palestine state and Jordan, Syria and Egypt could have easily given up some of the land if there is any shortfall. Instead they drummed up Palestine passions and in the end grabbed some of Palestine land rendering them homeless. It is a tragedy that Palestines are now living like refugees in their homeland.

Bill Clinton tried real hard to settle this issue and the Israeli prime minister at the time virtually sacrificed his political career with that agreement. Arab countries should have talked sense into Arafat and probably should have given up some of their land for a lasting peace. But that was the last thing on their agenda.

  • Hi,
I applied for GC under schedule A in may06 .My husband filed as derivative. He received a notice of intent to denial last month .Reason being he did not have paystubs for a period of more than 6 months during 2000 and 2001.His employer at that time did not pay him even after he worked for 4 months then he took few more months to change his company(more than 180 days)In 2002 he went to India and came back .and in 2004 filed for a GC as primary petitioner and me as a derivative .last year he withdrew the petition after he received several RFE`S fearing the worst.Even though he no longer has GC filed as primary petitioner he received notice of intent to deny for the petion filed through me saying that his H1 was not legal as could`nt show proof for several months and that when he filed for AOS he used those years as work experience.
and now another problem is I applied for EAD in march and have not received new ead.my old ead expired 10 days ago.and now Iam not working.
We bought a house last year thinking that under schedule A we`ll get GC in no time. Now we know it is a terrible mistake. Now both of us can`t work and had to take my son out of daycare. and we have house payments to make.We put our house for sale weeks ago and so far no offers.I contacted local representative to expedite My EAD and also contacted USCIS to expedite it,
citing financial burden. We are spending sleepless nights and have no clue what to do for my EAD and his AOS.pLEASE HELP.
Did anyone face similar situation .Any suggestions are welcome.

Sad to hear your story. Talk to an attorney ASAP. Maybe to several attorneys to get different opinions and perspectives. Time is of the essence in you case. Contact a financial planner/realtor as well to see what you can do about your house payments.

    Good luck.

    Regards,
    Jayant

  • UN..

    from your experience...

I would like to file for my GC filed thru my ex-employer in 2003, i140 also is approved and hoping the dates might be current in October.

I know it is safest route to join the ex-employer before filing 485,but I am not sure if he has a project around that time for me. The HR is always ready to give the required employment letter to hire me as a full time employee once I get my permanent residence card.

Now, my question is it safe to take this route, cos once we get the EAD and advance parole we will start using them with the spouse starting to work(so no more H4 status etc)..or any hitches as to during the interview will we have a hard time as to why I was not employed during 485 stage etc..

All the cases I see is people r filing 485 working with the current employer and plan to change jobs after 6 months..but my case is different..

Have you seen/known anyone getting GC without working for the sponsoring employer during time time of filing 485..?

and I dont think they are looking into case suspecting something..mine was a random pick transferred to NBC.. last year.

And My case was almost approved last Aug2008..during the interview..but visa numbers were exhausted already for the fiscal year (remember.DOS bulleting said visa #s are there but in reality they were long gone..they only gave statement so in the Mid sep2008)..

so..I think since it was lying there laying eggs, a different officer started looking into it all over it again..apparently, I assume earlier officer didnt put any note on it

  • If you were hoping for overflow from EB3ROW, it would still have to pass through the gate of EB2I.
Perhaps the person drafting the letter can explain their rationale on including this in the letter.

First off, we are here to get our GC faster so the effort is commendable.

However, I was also wondering about the old interpretation of the law. After the EB2-ROW numbers fall through to EB3-ROW and presumably make it current, the excess numbers go to EB2 China and India or does it go to EB3 China and India? Glad that someone else also caught this.

  • Do you really think they would send the G-325a to the consulate? Do the consulates keep all the records? For how long? I heard from immigrationportal, somebody said they only send G-325a to the consulate if one applied a visa within one year prior to AOS application. Can anyone confirm this?

If they send everyone's G-325a form to the consulates, would that result in another backlog? Thanks.

This is really a grey area, as per the field manual visa's issued by consulate/embassies less than a year are verified or checked. Less than a year is because the dept of states purges data a year old thats why less than a year time frame they send the copy to consulate for checks . But the grey area I am talking about is ,lets say i applied for 485 in july 2007 and i got my H1 stamped in sept 2006 by the time my case is processed it will be most probably oct 2007 (liek data fed in etc) now in oct 2007 when they process the checks DOS would have purged the data ,so in turn when they process your checks yourr visa issuance date shoudl be over a year as the consulates and embassies wil purge data one year old. I am talking about normal cases where visa stamping is very straight forward ,revalidation or extension etc.

  • You have no arguments that make sense. You are arguing that doing something illegal is a great thing to do. Not so. And yes, I do support the bill as it will weed out some fraudsters from amongst us, who give the H-1B program a very bad rep.
You still have not told me why you are support the Durbin-Grassley bill and you are OK with consulting on a "full-time" basis. The Durbin-Grassley bill bans this.
The present laws are more then enough to go after offenders. The law is not being enforced. What makes you think that if the Durbin-Grassley bill is passed, all abuse will stop? People who abuse the system will continue to do so. They will simply say that the job is "permanant, full-time" or whatever the bill requires the job definition to be and file for H1B. And the show will go on. I guess at that point you will then dance when someone else will propose another bill to restrict H1Bs to some other sector that includes you.

This is the first time, EB3-I is speaking up. Please don't stop us.

  • I beleive there will be no plans for legal immigrants by either candidates . If there will be any it will be for illegal immigratns because they are not paying taxes . I wish there was a rule not to pay any taxes till we the GC , that will change a lot doesnt it .

I think if Obama wins most of us here will qualify for higher taxes , I feel we already pay more with out a permenant status in this country . Any way taxes may not be a factor for choosing a president and I have no problem if Obama wins.

I dont understand why the immigrant opponets dont get the following .
    >> If I get my GC I buy home which means more money will stay in this country.
    >> If I get my GC , chances of me going back home and vacating american job odds are more .

I think people always combine H1B with GC , or illegals with GC ..which makes it difficult for average american to understand our issues .

  • A New Immigration Consensus
A bipartisan coalition of business leaders and mayors have joined together to make the case that visa reform is an economic imperative. (http://online.wsj.com/article/SB10001424052748703387904576279293334248326.html)
By MICHAEL R. BLOOMBERG | Wall Street Journal

Last month, President Obama convened a diverse group of business executives, mayors, law enforcement leaders, ministers and advocates at the White House to discuss a problem that threatens America's economic futureour broken immigration system.

We've tried before to fix it. President George W. Bush made comprehensive immigration reform a major legislative priority during his second term. Congressional leaders from both parties, including Sens. Ted Kennedy and John McCain, worked tirelessly to pass legislation. But the bill could not garner the required votes. Nor could a much narrower bill, the Dream Act, which would have granted legal status to the children of immigrants who enroll in college or the military.

These defeats have led to a conventional wisdom in Washington that bipartisan immigration reform is impossible. But a new consensus on immigration reform has emerged in the business community that could break the logjam and provide a much-needed jolt to our economy. The idea is simple: Reform the way we attract and keep talented and hard-working people from abroad to better promote economic growth.

In the global economy, the countries that attract the world's best, brightest and hardest-working will grow and succeed. Those that refuse them entry will not. America has long understood this. We would not have become a global superpower without opening our doors to immigrantsand we cannot long remain one without continuing that practice. Smart, self-motivated immigrants spur the innovations and create the jobs our economy needs to thrive. Between 1995 and 2005, for example, 25% of high-tech startups in the U.S. had at least one immigrant as a key founder. Those companies alone have created 450,000 jobswith the vast majority of them going to Americans.

Our global competitors understand how crucial immigrants are to economic growth. They roll out the red carpet for entrepreneurs; we have no entrepreneur visa. They heavily recruit our advanced-degree students; we educate them and send them home. They woo the engineers, scientists and other skilled professionals who invent new products, launch product lines, and develop the technology of tomorrow; we erect arbitrary, senseless and bureaucratic barriers to recruitment. And we do all this even as our unemployment rate hovers around 9%.

Although each party claims to have the solution to our country's economic woes, neither has embraced a job-creation strategy based on immigration reform, which would not add a penny to the national debt. To spur them into action, a bipartisan coalition of business leaders and mayors has joined together to make the case that visa reform is an economic imperative. In nine months the Partnership for a New American Economy has grown to more than 200 members, including companies that together employ more than 3.5 million people.

We believe in the need to secure our borders, make it possible to hold businesses accountable for verifying the status of workers, address the reality that 11 million people are here illegally and cannot be deported en masseand increase lawful opportunities for those who want to come to this country and contribute to our prosperity. Nevertheless, our nation cannot afford to wait for Washington to get its act together and pass comprehensive immigration reform. There is too much at stake. Our economy demands that we take immediate action on the most urgentand politically attainablereform: making it easier for job creators to come and stay here.

Creating a visa for entrepreneurs who already have funding to start their businesses will lead directly and immediately to American jobs. Visa reforms to improve temporary and permanent pathways for companies to fill the current shortages of engineers, scientists and other specialistswhose annual visa caps are often exhausted within days of becoming availablewill spur growth at existing U.S. companies.

Providing visas to the brightest foreign graduates of our universities will allow our economy to reap the rewards of their work. At the same time, allowing immigrants who succeed in college, or serve in our military, the chance to pursue a career and build their lives here legally will strengthen the long-term health of the American economy.

Finally, developing a reliable way for employers to hire guest workerswho grow the nation's food, support our $1.3 trillion tourism industry, and fill seasonal gaps across industrieswill help support U.S. businesses and create additional, better-paying American jobs.

Those who focus on where the parties differ on immigration, rather than where they both agree, have paralyzed the debate in Washington for far too long. Despite this deadlock, there is an opportunity for both parties to seize upon the economics of immigration reform and focus on what all Americans agree we need: more jobs. Leaders of both parties talk about creating jobs, but they are ignoring the voices of business leaders who can actually create themif only Congress would give them the tools.

  • Very insightful.

So in essence they give the boiler plate RFE's to drag you into a trap and once you oblige with the irrelevant info asked for in the RFE's, then the game is over. so we need to be very careful with the information we provide and need to be consistent no matter what is asked for.

    Yes, that is correct.

I will give you what was asked for in my local office interview:

w2's tax returns from 1999 through 2006 to prove that I complied with my status upon each entry into USA.

    I-134 affidavit of support

    All passports

Updated and new G-325a (old one I had completed in 2003)

Letter from employer giving detailed job description; salary

    last three months paystubs

Company two years of tax returns

Company two years of DE-6 (state unemployment compensation report which lists all employees names including mine and other names can be blacked out).

    --------------------------------------------------------------------

My situation; entered USA on TN back in July 1999

Last entry before filing I-485 in May 2003 was December 2002 (therefore, he should not have asked for w2's; paystubs prior to december 2002).

I-140 was filed in May 2003 but approved in April 2004. left sponsoring employer at end of 2004.

From Jan. 2005 listed one company and then from October 2005 to March 2007 showed that I was self employed.

Did not have any tax returns prepared or w2 for 2005 and 2006 and no three months of paystubs (self employed).

I was going to take another job offer with another company upon greencard approval; therefore; I gave that companies two year of tax returns but no DE-6 because I wasn't working with them yet.

    -----------------------------------------------------------------------

When I gave updated g-325a; it shows me as being self employed. He immediately picked up on this. I told him that it was allowed according to May 2005 memo and that I was in a period of authorized stay by filing the 485 in May 2003 and I had an EAD card and it was unrestricted employment.

Also, informed him that I was not porting to self employment upon greencard approval but instead going to work for another company. I gave him company job offer letter; told him since I didn't start working with them yet; then paystubs were unnecessary and that de-6 was also unnecessary since I hadn't started to work with them.

He asked for tax returns and w2's from 2001. As I was giving it to him; I questioned him why he was asking for this; I told him that I only needed to prove status from date of last entry until filing 485. (december 2002 to may 2003). He didn't say anything to this.

He got to 2005 and 2006 and I told him I didn't have tax returns prepared yet and no w2 since I was self employed. He asked for extension from IRS; told him I didn't file extension because I didn't owe any taxes. He dropped the questioning right there.

He then said case is approved.

Now; he way overreached in what he was asking for; if I didn't know these immigration laws then maybe someone would have gotten paystubs made or did fake tax returns, etc., and if USCiS officer suspected something and asked for certified IRS transcripts or called the company then he would have nailed me. Essentially; he was almost trying to get me to fake these things even though they are not required.

My situation goes something like this.

    1) I got 7th year extension in Sep 2005
    2) Visited India and got stamped and got new I-94 on return.
    3) Applied for 8th year extension without submitting new I-94.
but applied with old replacement I-94 came with I-797.
    4) So the same I-94 continued on subsequent I-797 extensions.
    5) Recently applied for 9th year extension with the same.

My Question is, do I need to submit last entry I-94 card that I missed which is expired now, for correction? Or is there any issue with this.
All these years I have the same employer.

I appreciate your help on this.

    Thanks
    -BMS

    There are two things

    1. when you got your 7th year extension 797 with I 94 , you were supposed to submit that I 94 ( on 797) along with the i 94 in your passport.
This is important most people dont do it .
    2. when u aplied for 8th year extension u submitted the 797 of the 7th year along with the i 94 attached to it( which you were suppose to submit when you left the country for 7th year stamping) hence the I 94 number did not change. Your I 94 are out of synch.

I would suggest to talk to an immigration attorney and i mean a real good one .
Otherwise you could talk to an immgration officer and expalin your case.
Or you could now go out get stamped and get a new I 94 9make sure this time you submit both the I 94s when you leave)

I had a very peculiar situation where i had to travel outside the country when my H1 extension was pending and it got approved when i was out of the country and when i got a new i 94 when i came back with a new number than the one with i 94 on 797 ( which was of a later date)
I spoke to immigrtaion officer and he heard me my circumstances and said i was in status and my i 94 were in order.
Last year i went to my home country and got stamped and got a new i 94 but i submiited the two i 94s when i left the country.

I would like to compare Mrs. Rolling_Flood to Lou Dobbs who only initiates controversy and never dares to challenge.
And now Rolling_Flood is enjoying his forum which is growing exponentially!

C'mon Mrs. or Miss Rolling_Flood, post you qualification here. (honesty please! :D)

You can see flood of post from EB3 folks who has superior qualification (education wise as well as experience) compare to you. Either you are out of your mind from rigorous GC fever or a one eyed person with poor imagination or simply you did not get a chance to work in a big environment like fortune 10 or may be fortune 100 companies. Or else you would know how/why/when a company files under EB3 despite the fact that the candidate has more than required qualification for EB2. Position requirement, layoffs, HR policies, Company’s Attorney Firm’s policy etc. comes to picture when a big organization files LC/GC for a candidate.

I guess you are like me working with a small deshi consulting firm with 3 or 4 consultants (working C2C). They can make almost anyone eligible (on the paper) for EB2.

Then ask me why I am not EB2? According to my company's attorney, I-140 will be rejected due to the stand of
    company's financials.
