NEED HELP!!! what are my options?
I485 denied on Oct 24th 2008. I did not get the letter and realized only when I checked on the USCIS website. My attorney also did not get the letter of denial or even the NOID.
I changed jobs in June 2006 by invoking AC21 (Priority Date - Oct 2002, I140 and I485 filed concurrently, I140 approved in Feb 2005).
The fact is that on all forums there is talk about revocation by previous employer. However please note that approved I140 could either be revoked or substituted. While those AC21 memos talk about revoked I140, the law is not clear when previous employer substitutes the approved I140. I know the substitution process is no longer legal since June 2007, however, it has been abused in the past. My questions to forum members:
1. Is any one in similar situation?
2. I have H1B only until June 2009, Can I work until then assuming MTR is resolved in 2 months (per some optimistic posts on IV)
3. if my employer were to file a PERM labor application--can I port my previous priority date?

Saimrathi, you are posting the same message on all threads. Anyway, I am sure some of the media will pick up the story and write about it. I think there are benefits from this campaign. The name Immigration Voice is out there. We may get more members of our community to join us and participate in future campaigns and we can learn from experience on how to carry out future campaigns, protests etc. We had to speak out in some way on what happened to us with the USCIS Visa Bulletin fiasco. I believe it was worth it for all these reasons.
wonder what would have made them change the dates? They even haven't seen any application yet?

are you sure you want to withdraw? All that you need to do i ssend a letter to USCIS indicating your receipt number. Make it clear to them that you want to keep the other one still going (mention its receipt numbers).
I would personally not withdraw simply because if they screw up and withdraw BOTH petitions, I can forget about filing another AOS for another decade...

The link is related to the fingerprinting background check. Almost 100% of the time the automated system returns an FBI record (an existance or not of a "rap sheet"). Only in rare cases when the finger prints are not clear USCIS sends a new FP notice.
The issue here is the FBI name check which returns less than 68% in the automated response. Around 32% of cases (485/n400) are delayed of which less than 1% really may have a negative record most of which are reported by IBIS and finger print check.
FOIPA only provides main file check report (not reference file report) which in any case is worthless for most applicants who have never committed a crime but are stuck in the name check due to a flawed soundex alogirthm that is applied for both roman based and non roman based names. Just now (12.30 PM EST) I got a mail from USCIS saying your application has been approved. I didn't do anything (never opened SR or contacted Senator) but last week I did had an info pass appointment which was useless. MY PD was Feb 2005 EB2 INDIA (The fun part is My AP and EAD are still pending for over 4 months)

here is my theory.
DOS and USCIS played a tactical move by making all the visa numbers current in anticipation of the CIR bill so that the legals wont complain to the senators about retrogression.
Once the CIR went down the drain, they are panicking about the outcome of their tactical error and trying to undo that move.

If you want to make changes in the existing law, we have to do far more than a letter campaign. In the coming months, there maybe opportunities where we can try provisions and bills as we see any progress on immigration reform initiatives. Lobbying effort for big changes will have to be huge.
The most important work we can do at this time is to increase our numbers. We must get as many high skilled immigrants on H1B, EAD, F1, J1, H4 etc visas under Immigration voice. Once we have good support, we can try to work on various projects that helps everyone. We must try to spread the word about immigrationvoice on various forums, websites, communities etc and seek everyone's participation.
