    If I am correct, your PDs are current, right? Do you guys know if your case was pre-adjudicated and/or assigned to an IO? I keep reading from the forums that some apps with PDs as late as Dec 2004 and a couple of Jan 2005 got approved. Wondering why the earlier (eg. mine is July 04) not approved yet. Could we all join togther and write a letter to Napolitino(Thanks to SoP for the idea) and ask her to take some action on our cases?

    in resent SR, IO said my case is pre adjudicated and under review. we asked what's that mean, he doesn't know - if it's under review then how preadjudicated?

  • Mine case is labor 06/2002 EB3, I-140 approved.
    Spouse labor priority date is 06/2007 EB2, I-140 needs to be applied.

    Acoording to my lawyer one cannot have 2 I-485's and though i explained that no such return rule he said its a risk and will get RFE and delays and personally does not recommend.

    I am going to check with my wife lawyer on Monday and its well reputed law firm.

    Since we both have stable jobs i am probably going to opt for my I-485 which has been already been filed and just file I-140 for my wife's case. Any thoughts ?

    That is the reason to write congressmen and senators so officially they have to admit it in document and to follow FIFO. Otherwise leftover July 2nd application will be touched in Sept 2008 :)

    I believe, USCIS has a formal method of investigation. You or your lawyer will have to give details whatever USCIS asks for. In a normal course, this would have been done a lot sooner, but USCIS themselves admit that they are not yet finished with all July2-Aug17 receipts. Perhaps they will not entertain any formal investigations until they are done with all filings.

    I am one of the July2 (J Barret, 10:25am) filers on the waiting, and I know the anxiety we all have. You can write to your Congressman, but think of how USCIS is going to respond to the intervention. They will tell that they are not yet finished with all receipts.

    As all filings after May CIS receive won't get be processed/approved until October (2012 fiscal year), June bulletin will be interesting. The only new demand (EB2 porting as mentioned), EB1, EB2 ROW, and EB2 I/C who missed 07/2007 and get current (say 01/2007) will be an interesting number CIS has to come up with to tell DOS (assuming all those approved).

    After May, DOS will then have a full picture of all demand for the June/July/August/September for EB1 EB2ROW EB2 I/C. They will consider denial rate/RFEs/manpower (CIS can only handle specific amount) to decide how to distribute those visa numbers. I would say, they will try to use as much as possible in July before August (as mostly fine tuning to match 140K)

    HR5882 was sponsored by Congresswoman Lofgren and Congressman Sensenbrenner. This bill recaptures all the unused visa numbers that have been lost since 1992 due to processing delays in Employment based category and Family category. It is estimated that 216000 green cards will be recaptured which would help to eleviate the employment based backlogs.

    Please use the instructions provided below to make the phone calls.

    (1) Call the congressman/woman office and request to speak with the aide who handles Legislative and Immigration matters

    2) If they are not available leave a VM for them -

    "I would like Representative "Representative Name" to support HR 5882, bill to recapture the green cards lost due to processing and bureaucratic delays. As you may already know that this is a bi-partisan bill with wide bipartisan support in the house and will help improve American competitiveness & reduce the back logs associated with USCIS. This bill is non controversial measures that will help US to stay competitive with a highly educated and skilled work force and address family based backlogs also.

    To All congress-critters:
    In a nutshell, this bill allows USCIS to manage their workflow more effectively, which provides better customer service, and will eventually lead to better turn-around times.

    My MTR is still pending with USCIS since 6 weeks. I sent form 7001 to Ombudsman office and got a one line reply that 'your case problem request is currently being processed'

    Sent letters and supporting documents to 2 US senators, but i got standard reply from them saying they need 30days to find the status. Office of one senator (NJ) was very helpful but not sure how this helps in resolving my case..
