Spouse labor priority date is 06/2007 EB2, I-140 needs to be applied.
Acoording to my lawyer one cannot have 2 I-485's and though i explained that no such return rule he said its a risk and will get RFE and delays and personally does not recommend.
I am going to check with my wife lawyer on Monday and its well reputed law firm.
Since we both have stable jobs i am probably going to opt for my I-485 which has been already been filed and just file I-140 for my wife's case. Any thoughts ?

Today is my day. After 13 years into this country, finally I am green. The reason being that all ‘otherwise unused’ numbers are provided strictly in priority date order, and the India demand has the largest concentration of early dates.”
There have been two reasons for China and India EB2 cutoff dates not moving forward as rapidly as had been the case in the past. The first is the unusually high demand for EB1 numbers and the second has been the increased demand for EB2 numbers represented by EB3 to EB2 upgrades.

The CIS reports that this demand slowed down in October, 2010 and has not resumed. On what basis you are saying that Oct'2008 PD will be similar to Jun'2007. Didn't you read the note in Sep'2008 VB that PD for EB3 category will retrogress further.

I see soft LUD on my 485 today, but the status has not changed. I had an interview in Jan 2009 and at the end of interview the IO told me that he could not approve my case as it was not current. So I believe my case is pre-adjudicated?
