  • Like I said, after AILA's memo came out yesterday, all the lawyers who were saying "it wont happen" have suddenly flipped and now they are saying "Anything can happen".

    Sometimes I wonder what are we paying them for if we have to send them URL from AILA about various memos and directives? Isnt it a part of job description to keep an eye out on what's going on at USCIS ? It is available on websites for the whole world to see after all. I wonder how efficient these lawyers were when Internet didnt exist and everything was thru phones and postal services.

    And ever since the dates got current for the whole world in July, lawyers are snapping back when you email/call them as if its our fault that dates suddenly became current for the whole world ? If its too much burden, then maybe its time to look for some other profession. No one is putting a gun on your head saying : "Be an immigration lawyer".

    It is all about job stability and ego. They can act ignorant and slow and trap their clients in this perpetual state of anxiety. That is what their strategy is all about.

    If we (highly skilled and informed) suffer so much at their hands, imagine the plight of millions of undocumented immigrants who are at their mercy.

  • Defending one's country is one thing and defending fraud and corruption is another thing. Yes, there are lots of great universitites in India like IITs, IIMs, and several Regional Engineering Colleges. But guess what, when it comes to EB2/EB3 genuine IITs and overnight (okay maybe three months) bodyshop graduates are treated the same way. It is for the sake of our profession that we need to weed out these frauds.

    Don't make corruption in India as an incentive to thrash Indians. Majority of Indian H1b/L1 like any other community are well skilled professionals. It should not give you an incentive to thrash Indians or India. I am sure you belong to India and I am pretty depressed to see some one trash his own country to get some cheap publicity on this blog. I am not playing a race card but Yes I will defend Indians or Chinese for any attacks by bigots like you.

  • Note that it would certainly not benefit the other 60%+ from countries other than India that are also stuck in various steps (EB3, name check). So, unless you want IV to stand for IndiaVoice, you should concentrate your admirable effort on increasing the overall quota (with increased per-country quota), excluding dependents, etc.

  • Here is what I researched and found out-

    From the data for India

    For Permanent applications 2004 => Reduction in Recruitment (EB2 cases)

    From 1 April 1004 to 16 August 2004 => 430 appox(All countries)

    No data from 17 August 2004 to 28 February 2005.

    From 01 March 2005 to 30 September 2005, For Level III- 263 For Level IV-271
    = 500 approx.

    For 01 October 2005 to March 2006, For Level III- 2500, Level IV-1770
    = 4300 approx.

    Now, of the GCs approved last Aug.08 and Sept.08 were from the Texas Service Center.

    That meant Atlanta Processing Center was the Labor Approval Center.

    So, For 01 October 2005 to March 2006
    For Level III- 1100, Level IV-770.

    So, total left = (2500-1100) + (1770-770) = 1400 + 1100= 2500

    Therefore toatl from 01 April 2004 to Mar. 2006=>

    430(2004) + 400(mystery number from 16 Aug. 04 to 01 March 2005) + 500(2005) +2500(2006)= 3900 principal applicants.

    Multiply by 2 for dependents = 7800 EB2 India pending before Mar. 06.

  • I did clarify this with a Fragomen attorney and as per them though dates could technically be moved back in the middle of the month, this most likely may not happen in July and also maybe August since this depends on the number of approvals and not on the number of applications received. Even if there are tons of applications received, unless there are enough approvals happening simultaneously, dates would not retrogress in the middle of the month.

    Ok, if the Fragomen page is the source of this rumor: can someone who is a Fragomen client ask their attorney about what's going on here. That might help clarify things a bit. (Given that they are the largest immigration law firm, there's bound to be many IV members for whom Fragomen is preparing documents.)

    we can do something indirect too ..such as contacting your realtors ..show interest in buying and then back off ..the advantage in this (if large number of people take part and each contact 4-5 realtors) ..then we will have someone else lobbying for us (rather than ourselves beating our own drum)

    See if careerbuilder, ajb, monster, etc., will give you statistics on how many of those positions were filled.

    Try to see if you can get prevailing wage determination for eb2 positions across the country. I know off hand that an eb2 IT position in Edision is over $90,000; new hamshire is anywhere from $89,000 to $113,000; Austin, TX is about $106,000; Virigina is close to $106,000 (generally if it is bachelors plus five years of experience; it is in six digits or close to six digits).

    The above will give a pretty good sense of the positions being sponsored; the salary levels, and the demand. Only thing missing is to correlate U.S. university graudates over the next 10 years and the gap between demand and supply of the skilled workers. Analysis has to be more facts then words and can't be too long winded.

    Also, currently my company is processing my GC, will this be affected if we apply for canadian PR?

    US citizens can come in and stay in canada as a tourist for temporary purposes, but you need a Canadian PR for longer stays. So YES, add your son in your application. Your US-Gc application is not affected by processing canadian PR or vice-versa.

    It will be a waste of money. The US does not have to allow any immigration if it chooses so. Do you realize that getting a GC is not a right, but a privelege? It's a matter of grace and no court has jurisdiction to review if government says "no".

  • Travind I am not close to the family anymore I made the dude so uncomfortable he stopped calling me. Here are some avoidance techniques, but you need to be ballsy to pull them of and never exceed the limits of decency and you must have a sense of timing and humor to do these. I have used these techniques myself for avoidance
    1) Stare at his wife or sister and constantly compliment their looks, cooking, chai etc
    2) Make lots of sticky notes with their quotes in the meetings and stick it on their walls
    3)Break your pencil or pen at the meeting and loudly say cuss words like "shit that is good"
    4) Itch nervously when they approach you in any location they will leave you thinking you have some skin disease.
    5) Cough without closing your mouth directly in front of their face
    6) Wear ghetto clothes when you go to the usual locations they avoid you like the plague (sorry guys who wear kurta with jeans and leather chappals you are the most obvious target)
    7) Borrow cd's, dvd's etc and never return them or their calls they are bound to be nice since even in the worst case they are still trying to sell to you.

    There are more things to do but i'm guessing some other people will post their experiences , just one word of caution do not extend your torture because these people are human beings who have been proselytized by their diamonds etc that they dont realize and don't worry they will not learn from you.

Sure...no system works to justify its underlying intent accurately. Nevertheless, an attempt is made. Hence we call it a process. Harping against USCIS that it is plain discrimination is not going to get us anywhere. As times change, they have to change the policies to suit the prevaling circumstances as well. In the long run, if every other immigrant is a bangladeshi, I am sure they will be taken out from the diversity lottery program.
