That's correct spelling mistakes, etc., can be corrected if you go back to the port of entry who generated the I-94 card.

What i mean is: Porting should not be an option based on the LENGTH OF WAITING TIME in EB3 status. That is what it is most commonly used for, thus causing a serious disadvantage to EB2 filers (who did not port).
"Employment Preference Categories" have very real legal groundings, and i intend to challenge the porting rule based on those facts.

Well, remove the threat by telling Clearly and unmistakably that use of nuclear weapon by Pakistan would invite catastrophic counter attack. Not by using it. Remember, India has "no first use" policy....
Otherwise what happens...Pak would keep taunting that " Hey, remember we have nukes...wanna pick a fight with us?" and keep doing what they are doing. They are trying to take the option of war OFF the table. India should keep it in the table but use very very cautiously.

Based on what the so called religious leaders tell us, people still follow these books litterally and blindly, because mankind continue to look towards religions whenever we are not able to find answers to our questions. And this bahvior pattern has gotten embrossed into our genes during 100s of generations.
And scientist do not have answers for everything, yet. And for the things they don't have answers, because of their genes and their lack of ability to answer every question, they look upon religion for answers to questions that they cannot explain. But great scientist have never relied on "a religion" to explain GOD, although most have acknowledged their believe in the existance of GOD. But that in itself is not enough for us to take the word of the book each religion preaches litterally, and call people from other faiths as non-believers, evil, kafirs or every other synonym out there. Let us be honest. A lot of us who came through body shops had to pay lawyer fee or had to take a cut in pay. Many of us had to sit in the bench for a long time with out pay. At the end of the day, not all of us are the best and the brightest but we are ready to work harder than the average Joe. With or without us this country will go forward. We are here to get a greencard and to become part of the melting pot. Please admit it my friends. I fully understands why many Americans are against us. We simply take their job. Then we insult them. Then we say, if we go back the American economy will go to hell. The companies are here for cheap labor. The congressmen who support them are the biggest receivers of their contribution. That is the reality. Let us not forget that. :D
You cannot make a definite conclusion that everyone come through Body Shops and Stay on Bench etc. There are many who came to do Masters and got good jobs on H1B. Because of few rare incidents you cannot generalise that everyone do the same. We Indians(atleast the indians I know) never felt that way of American economy will go to hell blah blah if we are not there. Maybe you feel that way then it shows your arrogance. Actually the best strategy will be to build up troops in Kandahar, completely in secrecy. Afghan govt can help India if India plays some deft diplomatic moves. Then hit Quetta by launching an attack from Kandahar. Pakistanis won't even know what hit them. They will be waiting for attack to come from their eastern border.

I am working in US from 2002 in H1B visa. Looking at the scenarios, it does not seem that we would be getting our green card soon. It would be wise if we start looking for some altenate. I have a Canadian Permanent residency and i am thinking sometimes soon i will move to canada. I have learned a lot working in United states and had changed 3 employers during 7 year period. I am seriously thinking about two options, One is to start a business in India with the technology i am woking in and secondly to move to canada and market those products over the globe. I am thinking about patenting some existing design for some application which people have not implemented. Once i file a patent, with broad open areas, i am sure to rule over the technology for next 20 years.
I think we have spend the cream of our lives in this land and followed the rules of the land. If we are not required in this land lets move to some other country where we are welcomed. After the elections, Whether its Obama or Mcain nobody would care for us till the economy comes out of recession. Even with HR5882 we don't know how soon USCIS would process our green card. Akula says the commercial model of microfinance isn�t the only way.

�It�s an important complement to other forms of finance,� he says. New microfinance companies don�t spend time to build trust, Akula says. �As an industry, we need to go back to our roots,� he says.
The Reserve Bank is scheduled to report on the industry in January. The finance ministry is planning new rules.
Sequoia Capital�s Chadha says he�s concerned about �regulatory uncertainty� created by the state ordinance and prefers federal regulation. Nationwide rules would prevent individual states from damaging credit discipline by waiving loans, Microfinance Institutions� Prasad says.
�It is no different than needing good regulation for stock investing or starting a manufacturing facility,� SKS investor Khosla says.
�People, Not Profit�
From Yunus�s perspective, it�s essential that the industry move away from seeking maximum profits and get back to focusing on the poor.
�If not, you are not helping poor people�s lives,� he says. �You are not patient. You are not restrained. You don�t have empathy for the people. You are just using them to make money. That�s what blinds you when you are in the profit-making world. We need to see the people, not profit.�
Any such changes would be too late for Atthili Padma and Shivalingam, a young couple in Andhra Pradesh�s cotton-farming village of Chennampalli.
Padma, a 22-year-old mother of two, walked out of her house on Oct. 7 with her 18-month-old son and 4-year-old daughter, according to Maruthi Prasad, a superintendent at the police station in Shankarampet.
Padma�s Death
Instead of heading to her parents� house as she often did, she walked 2 kilometers in the opposite direction. She came to an old Hindu temple where villagers worship Lord Shiva, the god of destruction. Padma continued until she stood in front of a well once used to irrigate crops, her father-in-law, Pochaiah, says. There, with no one to dissuade her, she jumped into the well with her children.
The day before she died, Padma had visited her parents after arguing with her husband over loans they couldn�t repay, according to Mangamma, the couple�s neighbor.
Their marriage five years ago was arranged by their parents and the couple had become close and hadn�t fought before that day, Mangamma says. The loans totaled 20,000 rupees, Pochaiah says.
Padma�s death is recorded as a microfinance-related suicide in the list by the Society for Elimination of Rural Poverty.
�Sad Day for Microfinance�
Police arrested Padma�s husband, Shivalingam, on Oct. 13 for allegedly abetting Padma�s suicide. They also alleged that he�d harassed her to provide money to marry him, which is illegal in India, according to Narayana, a constable at the Shankarampet police station.
Police made two further arrests on Nov. 8: Share Microfin managers Sriram Raghavender, 27, and Polapalli Kumaraswami, 22, also for allegedly abetting the suicide, according to superintendent Prasad. The two managers and Shivalingam have been released on bail and are awaiting a court hearing, Prasad says.
Advocates and investors such as Khosla say microfinance -- when it works correctly -- is the best way to give the rural poor a shot at better lives.
The tragedies in India present the worst possible outcome, says Cashpor�s Gibbons, whose Nov. 15 speech opened a morning session of the annual Microfinance India Summit in New Delhi.
�This is a sad day for microfinance,� said Gibbons, who has promoted the movement for the past two decades.

Lawmakers of both parties, in both houses, must ensure that that happens before going home to face constituents who appear increasingly unhappy about a Congress they perceive as looking after its own interests, not theirs.
The lobbying package makes important changes, some of which were written into House rules in January. It would prohibit lawmakers and staff members from accepting gifts or travel from lobbyists and their clients. It would end lawmakers' ability to fly on corporate aircraft at cut-rate prices; senators and White House candidates would have to pay regular charter rates for such flights, while House members would simply be barred from accepting travel on private jets. It would lengthen, from one year to two, the revolving-door prohibition on senators and Senate staff members; the House limit would remain at one year.
It would require that senators pushing pet projects known as earmarks make that information available at least 48 hours in advance of a vote and certify that they and their immediate family members have no financial stake in the items; earmarks added in conference could be challenged and would have to receive 60 votes to survive. Lobbyists would also have to report gifts made to presidential libraries, now a financial disclosure black hole.
Most important, the measure would require lawmakers to include on their campaign finance reports the identities of lobbyists who raise $15,000 or more for them during a six-month period -- shining a needed light on an important source of influence. This agreement will be brought up on the House floor today, under rules allowing it to pass quickly with two-thirds support. Then it goes to the Senate, where it is expected to run into opposition from Republican Sens. Jim DeMint (S.C.) and Tom Coburn (Okla.) over whether the earmarking rules are strict enough; because it involves a change in Senate rules, 67 votes will be needed for passage. Leadership from Minority Leader Mitch McConnell (R-Ky) will be critical to ensure that the complaints of a few senators are not allowed to derail a change that is badly needed and long overdue.

Wouldn't that be quite common in most consulting scenarios? What if the beneficiary/applicant has never lived in the same state as the petitioning employer but has lived in and worked for the employer (at client locations, offsite assignments) in nearby bordering states, from before the labor was filed and until long after the 485 was filed. Do you see the USCIS ever having issues with that?

The GC is always for future job and you never have to work at that location until you get the GC in hand. So while on H-1 if you are at a different location, but with the same employer, there shouldnt be any issue. But if you are not working for the GC filed employer and if you never have any intention to work for them and used AC-21 to different employer, then that becomes difficult to prove the 'intent to work' at the time of 140 filing.
The question I heard someone asking, what if the employer filed for Labor in a state where they do not have office but list the client location as the location that you work upon GC approval. I am not sure if that is a possibility. Probably UN could weigh in on this one.

What is the use of talking about wars and innocent people when chances are that the advocate of his immigration policy is opposed to my main issue of EB reform. high low Taxes, 401k's, houses, Medicare etc will matter if you get to stay here in the first place. A average 6-9 years of paying taxes, supporting medicare and Social Security and we now need to think about moving to different countries where skilled immigrants are welcome....think about it. Just look at the CIR 2008 discussion to understand what i am talking about. Read the senators transcripts.

It is not illegal to work on percentage basis. But if employer-employee relationship is now followed the way it should be followed by law then there are issues. For example, you are not in the same medical plans as employees or your work insurance is not covered (or you are not invited in annual christmas party for employees - just kidding). Specially, labor approval procedure has heavy dependency on prevailing wages and salary offered. In percentage basis there is no salary offered. Think about it.

My wife has excellent benefits covered so I don't bother to take any benefits from my employer other than the money.
Anyone can be paid a fixed consulting fee, just not h1b. You can find US citizens working for hourly pay because they don't need benefits as they may get through spouse.

I think clearing an exam like IIT-JEE in no way makes a person Superior over others. I my self have cleared IIT-JEE and am EB2 India, but still I see this proposed/planned Law suit to be ill thought off.

No, they figured out that it is consulting companies that are exploiting loopholes. Tell me what proof you have that ALL consulting companies are complying with H-1B requriements.
Is benching that happens in consulting legal? Is paying salary according to prevailing wages in Maine and sending the contractor to work in Manhattan legal? Please tell me how these practises by desi consulting firms are legal.

I know friends who worked for IBM & KPMG on H1b travels to all states for short term contracts. What about those biggies? They are also desi firms?

Pls do not forget the fact that USCIS changed their stand now and saying that it is not legal to work else where other than employer location.
