  • Renewal of License or a New one for H1 or H4 or related visa... is fully based on I797... this rule has been applied since last 3years.. who all arrived in PA before 2002 or so... are safe they get the license renewed for more than 5 years but who are after that gets only renewed as per the I797 expiry date.. the problem lies what our I797 gets delayed, we cant drive ... sit home ... does anyone have a work around or dealt with such situation

    I have a question on my wife' AP renewal

    My wife would like travel to India and come back in November or Dec 2008.she would like to leave on August Last week



    Any way we would like appy for renewal of AP , the current which expires on Oct 30 2008.



    Let us say if we apply for AP Renewal July 2- or July 3 , the new AP may come before her Journey date Augut 2008 , OR It may not come before her Journey date Augut 2008 .



    Since her current AP expires on Oct 30 2008 , Does she need to come back to USA before Oct 30 2008 ? or can we mail extended AP to India , if she is travelling back after Oct 30 in November or December



    please advise us , accordingly we will make travel plans

    there are several ways in which we could implement the update process so that information is only shared to a predefined "pool" ... I know this takes work, but if the Core is looking for a person to pull together a Conference Call to compile this update and send it out, I would be glad to volunteer my services.


    lets wait to hear how CORE wants to have that pool generated.

    my thoughts, people can contriute, (a) money only (b) money and some personal time (to gather data and compile them) (c) money and personal time to organize state chapter meetings and meet with local autorities or senstors (this is state chapter leaders today) and (d) money + lot if time + lobbying (CORE)...

    I have seen some emails in GA chapter for some meetings.. Working actively in those state chapters and contributing should be a good "pool" who can get these updates... also, this will encourage genuine people to participate proactively in state chapters and grow IV, which is the main goal for any grass-roots org.

    5&6 raise an important issue - Could there be potential EAD and AP time lost between the actual approval dates and by the time these documents reach us in the mail?

    Guys, as we all know we can not build our careers on EAD and TD. For a permanent solution, join us in the DC rally!



    This is what happens after 485 receipts.

    1. If one has not applied for EAD and TD , one applies for them and wait anxiously for their receipts.

    2. Meanwhile some people start getting FP notices and one does not receive them he or she gets anxious. Finally one gets FP.

    3. Meanwhile one gets the receipts for EAD, TD. One keeps checking the status online.

    4. One goes and gives finger prints for INS.

    5. Finally one gets his or her EAD and TD after 5 to 6 months , One enjoys the moment briefly.

    6. Its almost a month since one received EAD and AP , Its time to apply for renewal.

    7. Repeat step 1

    8. Its almost 15 months since the first FP and one receives the second one because "Finger prints expire" ,


    One has to repeat these steps in a cycle for almost 6 to 10 years depending on PD and "Nationality"


    Meanwhile if USCIS changes any processes anywhere in the pipeline expect further delays.


    I think best thing is to do participate in IV activities.

  • I am talking about a person (like 485mbe - the one who has posted next to yr post) who has a PD of 2001 ..I am not saying that they should give Eb2's quota to EB3 ..but they should try to pull the category that is worst affected..or atleast give EB3 something ..
    my question to you is ..say in the year 2010, would u support a situation where all categories are current or at 1 year difference ...while a particular category (eb3 I in this case) is at 2001 ??.. even if you do ..my feeling is that USCIS will try to pull EB3 - I (if something like above happens)..but then they are just a govt agency ..and in the end they are similar to govt agency in India ..only difference is that maybe little better

  • If the suspense is killing anyone, like it was to me; its easy to call the USCIS #, and ask the cust service person if the application has been pre-adjudicated. He/She will ask for SRC/LIN # again, and tell you yes/No and date of pre-adjudication.
    If the first officer does not help, call another, and the next one will.

  • No need to use AP to travel when you are in valid H1 status, and are continuing to work with the GC sponsoring employer. You can use the valid h1 stamp to reenter without any risk to the pending 485

    Spouse can travel and reenter on H4 even if she has a valid AP provided that you maintain H1 status. Note that H4 is a derivative of H1 status. H4 status ends once EAD is used for work purposes. If the EAD is used for work, then it is safest to travel and re-enter on AP.

    Thanks for your feedback. We dont have valid H1B stamp on the passport although we have a valid H1B approval. My wife needs to go for stamping.
    My question is, Can I enter thru AP after a 4 week period whereas my wife can apply for a H1B visa at US consulate and enter using the stamp on her passport. I would be using H1B and working for GC sponsoring employer and wont use EAD during this period.

  • Your employer might think that it is difficult to find a project in the current economic condition. Anyhow your husband started working there should not be any issue. You can join another company after 6 months.

    Yesterday, I was told by the client that my project is going to end by this month end i.e Apr 30. Actually it was supposed to go for the next 2 years. I am currently in the project working for the project. They said the lay off was becoz of budget issues. But I see I am the only one that is target in this lay-off. I am working with the same client for the past 3 years. The lay off news was really shocking and devastating.
    I am currently 9 months pregnant. As the client did that to me, I thought that atleast I might have some options with my current employer. My employer is a desi consultancy. I never been on Bench for single day for the Past 6 years ( Day 1 that I entered into US to till now).
    When I spoke to my employer today he gave me a termination letter stating that my project end date will be my last date with them. It was more shocking. I will be on maternity leave anytime in month of may depending on the delivery. I don't see any possible options that any client can take me into project when I am in 9th month of pregnancy.
    As my husband is doing consulting, I filed the green card thru this employer, 485 is pending more than 180 days, 140 approved in EB2 category. We paid all the attorney fees and filing fees from our pocket. We spent nearly $10,000 for the GC process. My husband was on bench for the past 2 months. He got a job on EAD which is going to start next week.
    1. I see that my employer is terminating me immediately because he can avoid maternity expenses. I told him that I will take 3 months FMLA for unpaid maternity leave from Apr 30th. And look for the Job immediately after delivery and get into the Job. But still he is telling he won't provide me that time. Maintaining the status is very important for me as me and my husband depends on the EAD.
    2.My medical insurance is with my employer, If I get laid off in this critical situation, I won't be having insurance. We can't afford the delivery expenses without insurance.
    3. Even though my husband will get insurance with the new company, We are not sure that company will cover the pre-existing pregnancy that is in final stages.
    4. And also not sure that the insurance will be under the network of OBG/YN and the hospital I registered for delivery. His job is in different state but he will find out the options once he starts his job next week.
    5. Does anyone think that my employer is discriminating the law? He is terminating me immediately becoz I am pregnant.
    I am not sure whether he is doing the right thing but the situation I am in is the worst situation I ever expected of. Its lot of stress on me and my baby. We are unable to sleep for hour with all the tensions ahead. My husband's job is dependent on my valid status. If something screw up we both be in very bad situation. I really don't want any one in my situation.
    Please help me, if any one know any options where I can maintain my status during the pregnancy and maternity leave, Please tell me.

    Created an SR request : ~ September 20, just got standard email saying Intial Review is still in progress.

    We have an Info-pass appointment tomorrow. We chose the 45 day not response option. Not sure if that is ok when we get there.

    Is there anything else I need to know before I meet a rep during the Infopass appointment.

    We plan to take all relevant documents, along with a copy of email from a conference in Canada where my wife is invited.

    Any input will be great.

    There are people from India with PD 2005 whose I-485's have been approved lately.

    It wont happen again. after encashing I485 checks USICS will start I140 PP again to keep cashing money. once I140 backlog will be done then they will earn from EAD renewals.

  • So here come the thing. Thats why i asked in my original post is IV just for people who have applied for Green card ? I wanted to know if they could address these issues as well . Regarding inability to work and self esteem , just stay in home for few days and then feel how much you loose. Man , its 21st century and ability to work is basic right.

    Please do not misinterpret IV.
    If tomorrow there is a bill to stop all H1B from coming to USA or to make life difficult for H1B, do you really think we will keep quiet just because we have filed our greencards?

    Do you know IV worked hard for decoupling of H4 time from H1 in 2006 and we thought nothing may happen and started to focus on next action item. Then few months later it was changed. That was the first small step.

    I would appreciate if you ask your spouse if she/he can volunteer time for IV. You both can get more involved. Send us an email if you are interested. We are always interested in people who can volunteer more time than us (We do full time jobs too. A couple of us also are enrolled in a part time degree program). We are willing to have such an H4 be a leader in IV.

    IV is a platform that will allow you voice your plight. But you will need to come forward and be willing to actively work on it with others. If the strategy is right, you are committed and have right intentions there is no reason why IV will not help.

    Nancy Pelosi has long talked about her first 100 hour agenda and immigration is not on it. It would be amazing to see any immigration talk in lame-duck session.

    Although, it would be a good start because both parties agree on it but I don't think the strategic think-tank in either party will rush to do that before seizing each other's deeper 2008 Presidential agenda.
