  • It's hard to believe that US economy will go down if they make some tough rules around H1 B visas or worse cancel H1 B program. I means, we can argue that it might create shortage for skilled works but if US really need some skilled workers, they can get it any time ( Like straight green cards for nurses etc). it�s few trillion dollars economy which won�t go down just because of H1-B visas holders.

    Yes. GC is always for future employment.

    What I had (mis-) understood till date was: there were 2 ways for employment based GC: 1) if I was outside US all along, and the employer applied my employment based GC for future employment, and 2) if I was working in US for the employer and he applied for my EB2 GC based on the job that I was offered and was working on.
    I understood that I was in the (2) category, and was wondering if my employer could switch my GC processing (Labor/I-140 approved) to the (1) type. Is this possible?

    I might have got mixed up with the Consular Processing vs AoS, but from what I read, those terms would really come into picture only after the 485 stage, isn't it?

    Of late everybody is talking about bad economy. I mean its all over the TV and newspapers. Apparently we are in a recession since past one year (since Dec 2007).

    However, odd it may though sound, I don't see any real economic slowdown in IT sector. I mean all my friends and acquaintances in IT industry in the US and India are retaining their jobs. I recently talked to my IT recruiter and she told me that as far as she is concerned this year has been like any other years. Bit sluggish at the year end, but loads of requirements lined up for January next year.

    Am I the only one who is feeling this way, or others also sensing the same thing. Maybe the real jolts are still lying in the future, in the coming year. Or may be its just a hoax. I would love to know other people's observation on this strange anomaly between what is being reported in the media, and what is being observed on the ground.

  • I have sent letter twice. They forward it as it is to USCIS and send a reply back that it has been forwarded to USCIS for action. Then you receive a letter or call from USCIS that your case cannot be considered unless your PD becomes current.

    How about you send the USCIS letter back to president again and tell him that this is not what you asked for. You already know PD is not current. The letter was for President to implement a fix A,B and C.

    I am on H1-B since Aug2009 and last year I transferred around 40K USD to parents. All these transfers were spread over the year in the denominations of 5K per transaction.(As and when I saved money).
    My question is, do I have to pay taxes in US on this money transferred to India. I know that my parents don't have to but I am not sure about myself.

    as long as primary is H1 and is working for the sponsored employer, switching the status between H4 and EAD should not be a problem, It is always good to have a set of approved AP.
    I might be wrong, please throw some more suggestions.

    Last year, One of my co workers went to china, just before he left, he got his green card, a month before he had got his AP. When he arrived at the POE, he made use of his AP instead of GC, when I asked him why he did that? He said he wanted to take advantage of AP as he paid for the AP :D
    Does that mean that his GC is invalid, the officer at POE could have cross checked whether he had a GC !!!
    Similarly, the officers cant check between EAD and H4..

    I believe the H1B status ceases after the date of your termination ( i.e. you stop working for the H1 sponsoring employer ). That is the zero tolerance policy of USCIS. Now, one should use AC21 and notify USCIS before the I-485 is approved ( with previous employer as sponsoring entity ).

    Call the office and tell them you did not get the answer to the questions and issues you raised and want to speak with the person who handles immigration policy matters. Follow up with this person. Letters go to junior staff and issues get lost unless you contact the senior staffers and seek appointment from them.
