  • A friend of mine forgot (!!) :confused: to renew his EAD when it expired last September. He then applied for renewal 60 days after the expiration date and got his new EAD without any problem, no questions asked!
    I filed for my own renewal about 90 days before the expiration date and when about 85 days had passed and I was getting worried, I called USCIS and was told: " Do you need the card to show your employer that you are legal? No? Then, don't worry about it. As long as you applied on-time, you are fine." I actually received the EAD five days after the expiration date...
    These two experiences are from California Center.

    I cannot renew my Driver's License if I don't have a valid work permit. I doubt whether the Receipt notice is enough for the Drivers License office to issue a new DL. I changed my employer and the new employer may ask for a new one. But I'm hoping that I might get one in less than 3 months. Let's see

  • Guys this is a revision to the July Visa Bulletin. Meaning, even if the revision happens on July 29th to the July Visa Bulletin, it holds good for entire july.
    This is not August bulletin.

    Looks like people have misconception, that if their file goes to USCIS on July 2nd and visa bulletin is revised on July 3rd or later date, then they are safe. It is not so.
    If at all if there is a change to the August bulletin it holds good for August and not to July bulletin.

    Pls let me know if my understanding is wrong

    I think revision can't be retroactive. How can u say on July 15 that on July 3rd your number was not current when infact it was current at that time....

    As per a Lawyers Checklist that I came across:
    "I765: $180 (kids do not need it)
    $70 for fingerprint (kids below 14 do not need it)"

    Trust you may have got same answer from other sources you checked.

    �I was being about as facetious as one could be,� Mr. Dobbs said in an interview Tuesday as he prepared for his nightly broadcast, �Lou Dobbs Tonight.� For the last nine days, the show has included discussion of Mr. Spitzer�s plan to allow illegal immigrants to apply for driver�s licenses.

    Mr. Dobbs, a pinstriped journalist turned populist crusader against illegal immigration, is not a fan.

    �It�s an abuse of power!� Mr. Dobbs thundered. �He is being absolutely irresponsible. When the governor of New York embarks on this kind of irresponsibility, it is national news as far as I�m concerned.�

    And when Mr. Dobbs � whose broadcast is CNN�s second-highest-rated show � speaks, many people listen. His relentless mockery of Mr. Spitzer�s decision has thrust the driver�s license policy onto the national stage, helping fuel an uproar not only among New Yorkers, but among national groups opposed to illegal immigration as well.

    As it happens, Mr. Dobbs was recovering from a tonsillectomy when Mr. Spitzer announced the policy on Sept. 21. But the anchorman went on the attack almost immediately after going back on the air Oct. 8, saying it was �hard to imagine what this governor is thinking.�

    It only took him another week to conclude that Mr. Spitzer, in fact, was not thinking at all. �This governor is a genius,� he proclaimed disgustedly on Monday. �An overwhelming majority of New York voters oppose the governor, but he refuses to back down.�

    With the television set on mute, the scrunch alone of Mr. Dobbs�s brow conveys his belief that Mr. Spitzer�s new policy is, possibly, the dumbest idea in the history of dumb ideas.

    �I think he�s definitely had an effect,� said State Senator Martin J. Golden, a Brooklyn Republican who was on Mr. Dobbs�s show on Sunday to denounce the plan. �Everybody�s chiming in. I get e-mails from across the country because of Lou Dobbs. I got an e-mail from a soldier in Iraq saying, �Go for it, Golden, keep it up.��

    Mr. Golden is one of several New York elected officials � most of them with more experience on New York 1 than on CNN � who have been recent guests on Mr. Dobbs�s show. Many have expressed support for proposals by state lawmakers to overturn the license policy or to deny funding for it.

    But not everyone who goes on gets supportive e-mail messages.

    Jos� M. Serrano, a Democratic state senator who represents parts of Manhattan and the Bronx, appeared with Mr. Golden to defend Mr. Spitzer�s policy, but found himself under a verbal barrage from both the host and his fellow guest. �Oh my goodness, that was something else,� Mr. Serrano said. �I think it was my first time on national television. I wound up debating both of them � Lou paid very little attention to Marty Golden and instead just kind of dug in on me.�

    This next morning, Mr. Serrano said, his office was bombarded with angry e-mail messages from around the country.

    �One guy wrote, �We will derail the illegal gravy train from within,�� he said. �I don�t really know what that means. Another person said, �Go back to Mexico, you�re obviously Mexican.�� (Mr. Serrano is from Puerto Rico.) �I�m not na�ve, but I was still surprised at the level of ignorance,� Mr. Serrano said.

    (Mr. Dobbs�s correspondents have also stated on the air that illegal immigrants will need only a foreign passport to obtain a driver�s license, and that Mr. Spitzer�s policy was instituted through executive order, neither of which is true.)

    Mr. Dobbs�s guests and interviewees are typically opponents of the policy. A segment that Mr. Dobbs pitched on Thursday as �a lively debate� on the issue, for example, featured the host and two members of the State Assembly who oppose the governor�s plan, along with a viewers� poll on whether Mr. Spitzer should be recalled. (Ninety-seven percent said yes.)

    One person who has not made an appearance on Mr. Dobbs�s show, despite repeated invitations, is the governor himself. Christine Anderson, a spokeswoman for Mr. Spitzer, said scheduling problems had prevented the governor from appearing. The administration had made other officials available to Mr. Dobbs�s bookers, she said, including Michael A. L. Balboni, the governor�s top Homeland Security aide. But the show�s producers had declined.

    �We don�t really have a position about his show,� Ms. Anderson said. �That said, facts matter, and what we have endeavored to do throughout this entire debate is to make an argument about the safety and security benefits to doing this.�

    But Mr. Dobbs said that Mr. Spitzer, and Mr. Spitzer alone, is responsible for defending his new policy.

    �The man hasn�t shown the gumption to come on the air and debate the issue with me,� Mr. Dobbs said.

    For those in South ( Texas, Oklahoma, New Mexico, Louisiana) best way to go to India is new Emirates direct flight between Houston and Dubai and then onward to India.
    I have had 3-4 friends fly this route since they started flying in November 2007 and they have nothing but praise for everything. These guys have excellent food and entertainment and no transit visa hassels plus duty free sopping in Dubai is good.

    Pluse - they put you up in a hotel if your Dubai layover is more than 8 hrs (for economy class passengers) and you get a free transit visa to visit Dubai. During my last trip to Bangalore, I went via Dubai (NYC - Dubai direct flight) and on my way back we had 11 hrs layover. My wife and I got a chance to see the city. Next time we are going to India we are planning on staying for a few days and go for their desert camp trip.


    I have heard pretty good things about the emirates in the past. I was considering it for my next trip.

    But a friend of mine traveled Emirates recently (Dec 07). His flight (and few other flights) from Dubai to India got canceled. He had to wait in the airport for 24 hours and some people for 48 hours for the next flight. That was not bad, he had to wait in line for 10 hours (yes, I am not joking) to get his booking for the next day. They did not provide the accommodation to any one. He says they were not even sorry that this happened.

    He says all the passengers slept in the corridors like how they do in busy bus stand platforms. It was unbelievable but true.

    I never flew Air India, Never through England. Hopefully never will. Thanks a lot OP for posting your experience. The Koh-hi-Noor comment was a kicker :)

    I agree with what you are saying. But, we need to compare the taxes too. Not sure of the taxes charged by vonage when compared with teleblend.

    She specifically wanted to know if I was on EAD and if yes, unfortunately they cannot hire EADs during the fourth quarter (now) due to hiring budget limitations that are typical during the fourth quarter.

    Q: Why does budget come in to picture here?
    A: Because policy requires the legal dept to be consulted for visa holders and EADs which means additional hiring costs plus time.

    But she said once the fourth quarter passes, EAD hiring is not a problem.

    What the employers are doing seems illegal. Govt issues us this card for a lot of money, and now we can't use it for work?

  • Lot of analysis. Here is my part. If DOS properly followed the INA as amended by AC21 act in 2000, EB2-I never retrogressed since year 2005. EB2 I might have been always �current�. EB3 including ROW might have been much worst situation than now. EB3-IN will always be in disaster state. Though it is unfair to (EB3) many, this is what the law. In later part of 1990s EB categories were retrogressed for IN, CH by about 2 years. When AC21 law passed in 2000, it did two very important things. One recapture of about 216,000 EB visas and it removed country quota in each EB category if excess visas available, in that category. That means it enforced horizontal spill over. In simple example, consider Mexico which is most subscribing country. Lets assume in a fiscal year, 40,000 Mexican are eligible for EB2 visa(and no other citizens in EB2), and millions of Mexican eligible for EB3 and in family based categories, still DOS should issue 40,000 EB2 visa to Mexicans irrespective of how much demand in other categories. Because of tons of backlogs in 485 (between 2000 and 2004), particularly in EB3, DOS issued about 185000 (out of 216000) to EB3. That�s why EB3 was current between 2000 and 2004. They simply ignored the EB2 demand by India and retrogressed in 2005, though total demand for EB2 less than the available pool of recaptured visas. Since the year 2007, they realized the mistake and now (since 2007) they are following correctly (though may not fair) the law. If they follow correctly the law, EB2-IN, Ch will become current soon. Till all EB2 become current, EB3 never see any spill over. Till EB3 �ROW become current, EB3 IN will not see any spill over. Till that point EB3-In will get only 2800 EB3 visas.

    Numbers made available from AC21 was the only initial reason to become current. Later after 2001-Sept until 2002- October ( TSC until March 2003) no EB I-485 were approved. Only the cases either transfered to local office or consular processing were getting Approval. It was weird situation because no numbers were getting used hence all numbers were available. So it remained current until 2004. Otherwise it would have been retrogressed by 2003 itself.

Or will all these database updates for the PIMS verification checks be complete by then? Any inputs will be highly appreciated. Thanks.

    From what I have gathered in the PIMS ruling is that cases approved after the PIMS ruling implementation will be put in the database first followed by cases that were approved prior...
    Anyone else gather this from the PIMS ruling please let me know...and correct me if I am wrong.

  • I see soft LUD on my 485 today, but the status has not changed. I had an interview in Jan 2009 and at the end of interview the IO told me that he could not approve my case as it was not current. So I believe my case is pre-adjudicated?

    Someone in the same boat? Hopefully the approval e-mail comes in the next few hours or next week. <<fingers crossed>>

    This is directly not going to impact your I485, indirectly it might if you get pink slip in your new job and then you try to get another job but they reject it because of foreclosure while doing background check. And if you remain unemployed for long time and USCIS rejecting I485 application.

    Also you might end up paying more in future instead of saving anything out of this entire foreclosure ..



    I got your point and I difffer with that. Your point is-only defective items should be returned and I am saying it doesn't need to be defective. As long as you are not completely satisfied you should be able to return it and price is an element in customer satisfaction. That's why stores do price match so you don't need to return their merchandise. Stores that don't do price match deserve their goods to be returned.

    Also, I didn't put words in your mouth. "Returning used merchandise is a fraud" - these words came out of your own mouth. Check your own post.
