Even the ICE Investigator with whom I am working has agreed for anonymity, In case you think that I am a american guy with anti-immigrant agenda I challenge you to set up a tele-conference where I can login without revealing my identity and I can prove my intentions, nationality or what ever you want ... (except for my personal details and specific violation details). I am here to fight a violation, please don't blame if you/your organisation would be impacted by this investigation.

We are still waiting for a response for our second application (filed in Aug). We had A#s on our I-140s so mentioned the same A#s on both applications and also noted in the second filing that one is already pending.

The 12000 unused visa numbers from EB1 is not the total for the year 2011. It is almost certain that, this is the spillover from the first 2 quarters of 2011. Along with this, there are some numbers from EB2 ROW as well. The spillover will only get applied to all those countries which are retrogressed.
12000 visa numbers would move mathematically the dates to somewhere in Sept 2006 for India and China Eb2. The porting from EB3 to EB2 is still a factor, but that won't exceed more then 1500 (which are ready to be assigned visa).
In order to utilize these 12000 visa numbers, USCIS may possibly consider 15000 applicants so that they will get 12000 approvable, background check free and non-delayed cases.
So, i think for EB2 the dates could move to either Oct/Nov/Dec of 2006.
In July, the next wave of spill over could move the dates further into 2007.

Yes, USCIS works backwards, dont you see, mar 2005 is still waiting while May 2006 getting approved? There is no pattern even to the approval statuses, god only knows how they work.

If clerk is doing this as per instruction means, we are being noticed and that is precisely what we wanted anyways. I don�t think USCIS higher ups have any malicious intent. Whole issue may be due to lack of training of IOs.

With USCIS officials it might take a bit longer but we need to keep sending letters and they will realize the issue.

I am pretty new to the forum (as a member), I have been browsing the same for quite some time and found it a good source of information regarding immigration related activities. Right now I am getting removed from my project as one of the top 3 Indian outsourcing firm is dumping their L1 resources at my client site and replacing all the citizens, GCs, EADs, H1 etc. These resources are used in projects managed and controlled by my client (most of them are consulting assignments) and these resources are used on java/.net/oracle projects, these two are violations of L1 visa restrictions set by USCIS, I want to know how and where to complain against this violation and we have all evidence to prove the same (project documents, time sheets, work assignments etc). Please let me know exactly and to which agencies we should complain.
